A warning for Annapolis -- going unheeded, of course. In "Wrong approach to peace: US, Israel ignore leading scholar’s insights about Muslim attitude to peace deals" in Ynet News (thanks to Morgaan Sinclair), Yoram Ettinger says that Israeli and American negotiators would do well to read Majid Khadduri. And indeed they would -- I have argued the same thing here. But has anyone at State actually read Majid Khadduri? At best, doubtful.
Policy makers in Israel and the United States are premising the Annapolis Conference on foundations that have led to a series of bloody collapses in Oslo, Cairo, Hebron, Wye, Sharm el-Sheikh, Camp David 2, and the disengagement. They are formulating the conference on the assumption that Palestinian leader Mahmoud Abbas has adopted a mentality of peace, thus granting yet another victory to the simplistic world of delusions in the Mideast’s complex reality. Professor Majid Khadduri, may he rest in peace, from Johns Hopkins University in the US was the world’s leading authority on Arab definitions of peace and war, and he noted that they view peace as a tactical means for achieving their strategic objective – defeating the enemy. Peace constitutes a temporary break in the ongoing war against the enemy and/or infidel. Khadduri’s book, War and Peace in the Law of Islam, clarifies the meaning of the amazing 1,400-year sequence – since the 7th century - of wars, terrorism, and the violent violation of agreements, alliances, and conventions between Arabs, between Muslims, and between Arabs and non-Arabs.The insights in the book include the following: “If a catastrophe had befallen the Muslims, (they) might come to terms with the enemy…provided that the Muslims should resume the Jihad after the expiration of the treaty…treaties must be of temporary duration, for in Muslim legal theory the normal relations between Muslim and non-Muslim territories are not peaceful, but warlike…If the (leader) entered a treaty which he was incapable of fulfilling, the treaty was regarded as void…the Prophet Muhammad has set the classic example by concluding a (628 A.D.) treaty with the Makkans, known as the Hudayabiya Treaty (whereby) a peace treaty with the enemy is a valid instrument if it serves Muslim interests…the Prophet and his successors always reserved their right to repudiate any treaty or arrangement which they considered as harmful…Muslim authorities might come to terms with (the enemy), provided it was only for a temporary period…a temporary peace with the enemy is not inconsistent with Islam’s interests….”
Meanwhile, Mahmoud Abbas’ textbooks, religious clerics, newspapers, and official TV and radio stations resonate with Khadduri’s theories day and night while preaching for the “liberation” of Jerusalem, the Galilee, Jaffa, Ashdod, and the Negev desert, the destruction of the Jewish State, glorification of suicide bombers, and Jihad. The Palestinian educational system, which promotes deep hatred, supports the main conclusion from Professor Khadduri’s book: The Palestinian-Israeli conflict is not over the size, but rather, is about the existence of a Jewish State located in a region defined as an “Islamic estate” by the Arabs.
‘No permanent compromise is permitted’Khadduri adds that “Jihad, reflecting the normal war relations between Arabs and non-Muslims” and says it was “a product of a warlike people.” He says that while the “concept of Jihad underwent certain changes, these changes did not imply abandonment of the Jihad duty, it only meant the entry of the obligation into a period of suspension – it assumed a dormant status, from which the (leader) may revive it at any time he deems necessary…No (permanent) compromise is permitted with those who fail to believe in God.”...

Separation fence is the way to go. Let Israel complete its separation fence. Ignore the whining. Then let's also build a separation fence from the Muslim world. Ignore all their demands. Not even respond. The Gulf States will continue to sell us oil, because, let's face it, oil is just a bit more important than Allah to the House of Saud and its coterie. Cut off ties apart from that. In the meantime, work towards greater energy independence.
In other words, build a wall between the West and the Muslim world. Make no concessions to them. Make no accommodations. Then we'll see them grow up in a hurry.
Part of the reason Muslims keep indulging their maximalist Islamic fantasies is because we allow them to. We are indulging children in doing so, children who just happen to enjoy a good beheading now and then. But even murderous children can grow up once the adults start behaving like adults and put them in prolonged time out. And if they don't grow up, no big loss.

I am astounded at how the West continues to believe what it wants to regarding the palestinian mess rather than trying to see things from their viewpoint. There has been one setback after another over the years, mounds of writings that clearly set forth their mindset and sites like these that further simplify things for the average reader yet so-called leaders continue indulging in wishful thinking. I see clearly why the Destroyers are confident of ultimate victory-first over Israel, then over the rest of us. They really think we are stupid and I hate to say it but they are correct in thinking so. Exactly how many times does it take before some "leaders" finally realize where the Islamaniacs are coming from? Their wishful thinking rather than clear thinking has been a disaster up to this point and worse things are in the cards unless those in power start looking at things realistically.

Further proof that the "tiny minority of extremists" is really driving the global Islamic movement, as has been stated many times before.
It does not take a majority, nor even a significant minority. Those Muslims who consider themselves "peaceful" or who wish to assimilate with the West or otherwise partake of the global community are completely irrelevant to militant Islam. Indeed they will be its first victims before they move on to the rest of us.
And so all Muslims CAN and must be held accountable and are rightly painted with the broad brush.

Islam is like a dormant disease. As soon as the host's immunity is compromised it rises up and starts the killing process. Their 'prophet' said so, and proved it with his deeds.
There is no peace with Islam, only what was done in WW II, total defeat and unconditional surrender (by them). All else is delusion, the Israeli peace plan is doomed before it starts. The only real defense is to maintain a very strong immune system, ignore their pleas and cries like siren songs, and keep them down, always underfoot, for this enemy is religiously vile, a cult of death. Beat them as an old fashioned slave master would, and they respect you, a race of slaves (to Allah). There can never be peace, only total defeat and destruction so they can never raise their monstrous jihad again.
"No permanent compromise is permitted" is permitted from their side, but no permanent peace is permitted from ours, only total defeat. No need to sugar coat it, this is a permanent state of war.

The message of Western governments to its people is: whether Muslims are 0.001% of the population or 10% or 20% or 50%, be happy as you get violated by them, because if you speak up, you are an Islamophobe. I think the disease is not dormant but manifest, and Western governments are feeding the disease, not treating it.

Try your local public library. I recently wanted to read a portion of a textbook and my local branch had it sent to them from a neighboring community college. I would venture to guess that his book is in a college library available to you through an interlibrary loan.

Also, I forgot that many libraries will allow you to request that a book be added to the library collection just by filling out a form. They evaluate it and will let you know if they decide to purchase it for their holdings.

I agree. I was thinking of all those 'sleeping' cells within their masjids who claim to be 'peaceful' and moderate Muslims. They are neither, always plotting and tacitly supporting the jihad. They're as much the enemy as those who blow themselves up to kill, or blow up their children (dressed in party colors) to kill. The jihad is the monster, and all those 'peaceful' Muslims are its enablers. But yes, our governments are clueless about the nature of this threat. When they wake up, and the sands of time are running short, they will have to declare a war against this evil cult, and only total defeat will be acceptable. There is no compromise with this 'religion of peace' while they have any hopes of their Caliphate. We must be very hard on them, and make them pay for their idolatry of Mohammed's idiocy. We can never have peace, same as we will never have peace with malaria or rabies. Only total defeat, because deep down this is what they want, to be defeated. Hard choice, but this will be our job in history, to put this evil cult down, permanently.
There is no peace with pandemic disease. It (Sharia-Caliphate Islam) must be put down.

It is such a hard question, because we are dealing with human beings, even if they are (often hopelessly) brainwashed. At the least, for the simple sake of maintaining our existence, we should stop all immigration from Muslims nations until we have a method for differentiating between those who wish to immigrate for a better life with the proviso of assimilation and those who wish to immigrate for other reasons.
These other reasons include outright jihad, but far more frequently include simply immigrating for material reasons without any desire to assimilate. Unfortunately, in the case of a totalitarian ideology like Islam, even in its milder forms, a lack of desire to assimilate means a concrete desire to work in some way or another for the subjugation of others. And with all the Wahhabi Gulf State oil money flowing through "civil rights" and other Muslim organizations in the West, an unwillingness or even an indifference to assimilate often becomes outright hostility to the Western host country's norms, traditions and values.
I think it is not violent jihad that most endangers the West, but PC-enabled, Gulf State (esp. Saudi)-funded anti-assimilation and pro-sharia activities, legal, cultural and otherwise. It is cultural creep, the slow institution of sharia in stages (you see this at public schools already and will see more and more of it with each passing year), that is the greatest threat to the West. Violent jihad is the most obvious manifestation of Islamic imperialism but legal and cultural jihad and dawah are the real threats to the West.

On a more serious note, I think the controversy at LGF is something we just can't ignore. One of the things William F. Buckley did during the Cold War was take on and pretty much dispose of the John Birch society. This situation may be analogous (I don't know the European politics well enough to have a definitive judgment).
The forces against Jihad may need to follow WFB's example.

Sure, cultural jihad is more insipid. But it is not irreversible. If schools institute back door sharia, like halal meals, this can also be stopped. Ditto for prayer time at work, or public footbaths. All this is easily reversible. What is not reversible is their entry into our democratic process to undo our laws that separate church (mosque) and state, which is what Shari wants to do as their primary goal. Here is the real threat, that once they succeed in instituting sharia laws inside our civil and constitutional laws, they become harder to undo. What also is alarming is their demographic jihad of their multiple wives breeding like rabbits. That is a serious threat because once those offsprings are old enough to vote, they will again try to vote in sharia compliant laws, even if against our First Amendment. So a constitutional change might actually happen if we let them proceed with their political agenda.
Now, realistically, we did not allow Communism to change our Constitutional laws, nor did we allow Nazism to change our laws, so why should we worry about Islam? Mostly because they have a very persistent agenda to take away our freedoms, our equal rights, and replaced them with their Islamic sharia laws, what they think are their god's laws, in total contempt of our laws, those which insure our freedoms. So in a way, this enemy is more formidable than the old Communism or Nazism was, because they think they are acting upon some command from their god. This means they really are a cult, not a religion, trying to undo our constitutional governments. How do you stop that?
Remember these Sharia pushers are oblivious to the harm they are doing to us. In their blind vision of Allah dominating the world, they think themselves the 'victims' of our refusal to obey them. This is madness, but that's what we're up against, that they play the victim card to the hilt, making us feel bad about resisting their constant aggressions against our freedoms. While they keep pushing us, they claim victimhood! It's humorous, but it is a real threat nevertheless. And since they are so imbecillically stupid, there is no way to reason with them. So we simply have to take adult responsibility and stop them. The real question is this: Do we have leadership good enough to first understand the problem, and second implement a solution? That's the real question here.

Folks like Robert Spencer keep urging Muslims to reform their faith, to stand up to the radicals within Islam, to bring sane interpretations to their holy texts and bring their religion into the modern world. I hope this is possible, which is why at this point in time I think it imperative that the West, particularly America, try working with some Muslims against others. BUT, I often wonder if there are so many menacing and rotten tenets in Islam (jihad, dhimmitude, sharia, etc.) that any Muslim sincerely responding to the urgings of someone like Mr. Spencer would find out that so much reform of Islam is necessary that after proper reformation there would be little left of the Islamic faith. If so, then calling upon moderate Muslims to seize their religion from the radicals is a fruitless request and desire. In short, Islam may very well be utterly hopeless.

Unfortunately, 'the people in charge' continue to live in some delusional fantasy land where treaties and the notion of "giving them enough to make them happy" will lead to a lasting peace that everyone can live with. Unfortuntely, if you look back through history you'll find that such arrangements have NEVER worked. We're doing nothing but aiding the enemy.

Duty of the Muslim Towards These Treaties

Note: This piece represents the perspective of a Muslim scholar on the peace treaty and is presented here since their perspective is often ignored in the media and is important for the Muslims.
And now comes the most important question, that is: What is the duty today on the Muslim as regards these treaties?
The answer:
(1) The first duty is to firmly believe in their invalidity and that because they contain invalid conditions they were born dead the very day they were given birth to; because it is not lawful for the Muslim to conclude an agreement with the unbeliever for abandoning jihad and abrogating this religious duty, nor for giving up hostility towards the Jews and affirming love and amity for them; for this is leaving the millah. These treaties also contain provisions making it incumbent to screen out such Ayahs of the Quran and ahadith (statements) of the Messenger of Allah, peace and blessings of Allah be on him, that declare this enmity towards the Jews.
This undertaking constitutes a collusion with the unbelievers for concealing the Deen and knowledge and for suspending the Ayahs of the noble Quran and ahadith of the Messenger of Allah, peace and blessings of Allah be on him, that explain the essence of obligatory relationship with the Jews; and this in fact is driving the Muslims out of Islam and stripping the Ummah of its belief and history.
And since these treaties contain such conditions and stipulate them clearly, they are therefore invalid and it is not lawful for the Muslim to believe in them.
(2) The second duty of the Muslim is to believe that these treaties do not bind him and that it is not lawful for him to give effect to any of their contents except under compulsion and necessity to the extent compulsion is a valid ground for compliance.
This is so because they contain the above noted invalid conditions and because they have been concluded without the consent and consultation of the men of religion, learning and judgement and because they will spoil the Deen of his sons and progeny, besides spoiling his worldly interests.
(3) The third duty is to work towards overthrowing these treaties. Their position is like the position of every abomination that may be found in the land of Islam and that which it is a duty to abhor and reject according to the conditions and requirements of rejecting as far as practicable, and to see that there does to accrue to it a worse abomination and that an abomination is not met by another abomination.
(4) The fourth duty is to believe that the Jews, as long as they adhere to their false religion, waging war against Islam and its followers, they are members of a community on whom Allah 's wrath has fallen. It is a duty to fight and confront them as long as they remain on their course of action in fighting Islam, disbelieve in it and commit aggression upon the Muslims.
To detest them is the Deen to be followed for Allah's sake by a Muslim.
(5) The duty to unite the Ummah towards attaining this objective of putting an end to the sway of the Jews in the world and to their tyranny upon the Muslims and their capture of the base of the Night Journey of the Messenger of Allah, peace and blessings of Allah be on him, and of al-Masjid al-Aqsa.
(6) To believe that the Jews could not have been able to establish their sway in the world to such an extent except after the elimination of Islam from the Arab states and their constitutions and legislation - except as Allah had His mercy - and the slogans of nationalism and secularism had taken the place of Islam and there had taken up this issue the secularists who fought the Jews under slogans other than Islam, and isolated Islam from this issue. Then when they were unsuccessful, and this is Allah's way of dealing with His creation, and they announced their humiliating surrender and threw themselves under the feet of the Jews, they gave it out as the highest degree of wisdom and reason. Hence they failed in their war and Allah debased and disgraced them in this life before the hereafter, on account of their moving away from Islam and their discarding of the Book of Allah and the sunnah of His Messenger,peace and blessings of Allah be on him. And on that account to believe that there cannot be any victory in this issue and any dislodgement of the Jews from the midst of the Ummah and an ending of their sway in the world except by means of Islam in belief, in method and in jihad.
(7) To pray to Allah Subhaanahu wa Ta'ala day and night that He unite the words of the followers of Islam, that He unite their ranks and that He return them to their Deen; and that He prepare for them the means of their victory over the enemy of Allah and theirs.
And all the praise belongs to Allah, Lord of all beings.

I want to go on record as saying that the GOD I worship is a GOOD God. The GOD I worship loves everyone - Christian, Jew, Muslim, atheist and all other beliefs of religion. Charleston, thanks for the al-Hudhaifee reference, which pretty much confirms our suspicions on why peace in our time in Israel is largely impossible, unless we win.

So there is no possibility of peace between the Jews and Arabs on this issue, since the idea of living side by side in peace is an abrogation of their belief that Jews follow a false religion, and so must be fought. Why not let the Jews follow what religion they wish, without interference from Muslims? That is not the Muslim way, since Islam must dominate, and not be dominated, by their barbaric regressively ignorant belief system. The idea of religious freedom and tolerance is just not part of their nomenclature. It appears their waiting for their Dajjal is about right for them, the grandest deceiver of them all, it fits. Not fighting Islam is not an option, per their belief system, and they will do whatever they can to deceive, make false treaties, and plot and scheme as long as they have breath to overthrow Israel. This makes the survival of Israel our beach head in this war against Sharia jihad, and all efforts will need to concentrate on this issue in the future. Odd, but the Arabs are in fact creating their own hell by refusing to live side by side with Jews, and bring down the hatred of the world against them. How totally upside down sick!
There can never be peace with Islam, either by treaty or submission, until they are totally subdued, abased and humiliated, for being the primitive barbaric savagery they present to the world. Their Dajjal must have already come, because they are living his deceitful cult to the letter. There will be no peace until full victory over this primitive cult. Save Israel from their Dajjal, and then we may have peace in the world. Let Freedom ring!

I disagree. They could have very well read Majid Khadduri, but if the ideology says to ignore what he says, they're going to ignore him.
After all, they ignore everything else about the Islamic ideology.
So it doesn't rally matter if they read him or not.

If you look at it this way, the Palestinians actually achieve peace quite a lot - they get temporary breaks from violence where they regroup to fight even harder and acquire more concessions. No wonder Arafat won the Nobel Peace Prize - he probably brokered peace 25 times!
