Boston: Muslim Leaders Sue Press for Defamation

BOSTON -- A leader of the Islamic Society of Boston has filed a defamation lawsuit against the Boston Herald and WFXT-TV, alleging news reports unfairly linked him to radical Islamic terrorists.

The complaint filed Wednesday in Suffolk Superior Court by Osama Kandil alleges that a series of Herald stories published beginning in October 2003 and a WFXT broadcast in November 2004 destroyed his reputation. The lawsuit accuses the Herald and WFXT of "sensationalizing a story that Dr. Kandil ... was linked to radical Islamic terrorists and that both he and the ISB (Islamic Society of Boston) presented a danger to the community."

Kandil, chairman of the Islamic Society of Boston's trustees, is a biomedical researcher and U.S. citizen living in Egypt...

The complaint is the second filed in three months by an official of the Islamic Society of Boston. Dr. Yousef Abou-Allaban, chairman of the organization's board of directors, sued WFXT in February, alleging the Fox television affiliate erred in identifying him as a member of the terrorist group the Muslim Brotherhood. That complaint involves the same WFXT story cited in Kandil's lawsuit.

The complaint by Kandil also focuses on a front-page Herald story from Oct. 29, 2003, that reported he was allegedly linked to a network suspected by investigators of supporting Islamic terrorists, and that he was leader of an Indiana-based group "known for its anti-Western rhetoric." A Herald story more than two months later reported Kandil "has deeper involvement with organizations and individuals suspected of funding terrorism than previously disclosed."

In a statement, Kandil said reports linking him to terrorism and an anti-American agenda were false. He said he believes in "moderate and tolerant Islam."...

At the end of the article, the Globe reporter quotes Ibrahim (Doug) Hooper of CAIR, who cluck-clucks about the "growing cottage industry of those who seek to create false links between terrorism and American Muslim leader and organizations." Almost have to admire Dougie for his chutzpah!

FOX TV and the Boston Herald have been the only local media to do any investigation and coverage of the ISB. The Globe gives a free pass to anything Muslim (while frequently criticizing Catholics and Evangelicals), and the other local TV stations simply don't cover these issues. Gotta give credit to FOX and the Herald.

This is a transparent attempt to try to silence critics of Islam. What Muslims don't know is that these type of suits rarely succeed.

This is brilliant! In libel law the burden is on the plaintiff to demonstrate that what was reported by the defendant is not true. They are going to find out the hard way why the 1st Amendment is still around after more than 200 years. The more noise they make, the more unwanted attention they are going to receive from the multitudinous swarm of investigative reporters who will smother them. Lights, camera, action!

Hey,that's nothing,since the "Finger-food"
case at Wendy's that appeared to be a winfall

women that is suing McDonald's for $14 Million
because she claimed to have found a rodent head
in her BigMac.

Last year McDonald's settled a suit by a Sikh
that ate fries while not being told that the cooking oil may have come in contact with
animal oils from other food preparation,the money
was to go towards promoting the Sikh faith via
educating the public through literature from
selected Temples that got the money.
CAIR Canada loves to coach Muslims on knowing their Rights and even have Lawyers to cash-in on
minor cases of offending actions that the rest of us usually brush off as trivial.

Khan: So true, but they waste my valuable time and staff resources with these frivolous suits. Hell, just filing an Answer and Affirmative Defenses costs the G-man $2000+. They're killing us with our own laws.

Not to mention staffing, paperwork, reading, filing, drafting cross/counter claims/suits, MSJ's, MTD's, subpoena's, depo's, yada yada yada yada frickin yada.

I's part of the islamic d'awa don'tcha know!

I only wish the taxpayers knew how much $ it costs for each of us, each time some muslim files a summons & complaint for their perceived persecution. If we could educate the masses as to where the hell their tax $ is going, I'd say there'd be quite a few outraged citizens.

As for me, and my staff, we'll fight to the end.

The US government makes libel very difficult to prove in order to protect freedom of the press from those who would try to censure the press with lawsuits. Not only must the plaintiff prove that what the defendant wrote was false they also have to prove the defendant KNEW what he wrote was false. That's what makes libel suits so hard to win. Which is what Muslims are about to find out.

I also wouldn't be so sure that Muslims win by filing frivolous lawsuits. If the suit is deemed frivolous the plaintiff can be held responsible for the costs incurred by the defendant in fighting the suit. The defendant can also countersue. Example: Michael Jackson was sued by a group of former employees. The employees lost and Jackson countersued. Jackson won the countersuit and the former employees ended up owing him $1.5 mil. All the former employees who sued Jackson were forced into bankruptcy their finances and credit destroyed. So I don't think Muslims should count on lawsuits frivolous or otherwise.

True,initiating a law suit could be costly,but not when they have the full cooperation and suport from the infamous ACLU.
Due to Title 42,the ACLU`s legal costs will be paid from the taxpayers money,so they can and they are initiating thousands of law suits/year,without having to pay a dime..
