Hamza wins go-ahead to appeal over 'unfair' trial

Courtroom jihad in Britain. The British dhimmis will now have to spend another huge sum of money to reconvict this jihadist thug -- all because some members of the British press had enough spine left to report on his words accurately. From the Telegraph, with thanks to JE:

The radical Islamic cleric Abu Hamza was given leave to appeal yesterday against his conviction for soliciting to murder on the grounds of the bad publicity he had received before and during the trial.

Hamza's lawyers claimed he was unable to get a fair trial because he had become the most notorious person in Britain after the attacks of September 11, 2001 and July 7, 2005.

Edward Fitzgerald, QC, said putting Hamza on trial six years after the last of the speeches was delivered was comparable to putting Hitler on trial after the end of the Second World War for speeches he made in the 1920s.

Mr Fitzgerald told the Appeal Court that almost every story about terrorism since those events had been accompanied by a picture of Hamza with his hook.

"In many ways he was the most notorious person in Britain," Mr Fitzgerald said. "People would say, 'Abu Hamza, ah, this is Captain Hook'."

It was now impossible to put Hamza on trial in the circumstances that prevailed when he made the speeches between 1997 and 2000.

"The lapse of time has left him exposed to an unfair trial. He couldn't be tried in the atmosphere when he made the speeches. He could only be tried in an atmosphere poisoned by these events," Mr Fitzgerald said, referring to the bombings in New York, Madrid and London.

So where are you going to try him, Fitzgerald? Fiji?

The cost to the British tax payer keeping the turd Hamza in prison with his own personal arse-wiper is a scandal. Now we get the blood sucker Edward Fitzgerald, QC pretending he is acting up for justice by taking this case to appeal, all for his monetary gain of course and more unnecessary drain on the exchequer.

I read somewhere yesterday that whilst leave for appeal has been granted, Hamza should not get too optimistic. If that comment from one of our leading judges is a fair summary of what will be the outcome then why are we wasting public money?

The case whether it is upheld or not is of no real concern now because as soon as Hamza comes to be released he will be extradited to the US to face terrorism charges there.

Sigh,some days it is so hard to not to get discouraged. There is something deeply,perversely wrong with the West in how we grovel and give into these people.The obsession with an imaginary and excessively pious sense of fair-ness is sick, perverse and to me a harbinger that the West is going to lose this war. Cultures and peoples who won't defend themselves have no right to live and in fact will not live on. Why do we Westerners have such self-hatred and such a death wish? Is life too good, so good that we have collectively lost touch with reality and become delusional? I don't get it, why and for what reason are so many people so groveling to their would be and most likely eventual murderers and enslavers? These people are like the mentally ill man from Germany in the fairly recent infamous canibal case who met the the killer on the Internet and let him slaughter and eat him. Is it guilt, what is it? Has multi-culturalism and western guilt so- throughly triumphed that it has repressed the most basic human urges for survival, both collectively and individually? Sorry for my rant, but I am a bit discouraged, between this and how much water the media and the police are carrying in the defense of Islam in the Jewish community center shootings in Seattle. The first concern wasn't about the dead Jews, but it was about worrying over an imaginary backlash againest Muslims.When do the mass conversions of the stupid Western sheep begin? Maybe we should all waddle our overfed, braindead posteriors to the nearest masjid, take shaddaha and just get it over with. Most people are mediocre sheep looking for a shephard to do their thinking for them. Most humans can be controlled by their stomachs, their genitals and through fear of death. Most westerners/sheeple will take the path of least resistance and follow the strongest shepards,i.e. Islam when push comes to shove. What is there to fight back with a crushed,deballed pacifistic Christianity, and thread bear secularism of consisting of thread bear,empty, left over enlightment platitudes and catch phrases like democracy and freedom emptied of their original meanings and so vastly removed from their original context as to be presently irrelevent. Western civilization R.I.P. We Jihad watchers are sadly in the minority. Most people I know are stupid and believe such stuff as the 911 conspiracy theories and simply dismiss any criticism of Islam as racist hate, no matter how carefully argued.We are done, perhaps those who love freedom can create our own enclaves, flee into the Mountains like in Ethiopia and Montenegro during the Middle ages and let the Muslims and dhimmis have the lowlands. Fighting Islam takes and integrity and strength most of the self-hating,overfed,over-medicated sheeple int west don't have and will not be recovering en-masse anytime soon.

But we did put on trial Hermann Goering and von Ribbentrop based on what they had said, what they had written, and what they had done...............they were sentenced to death.

That is the nature of a trial. Abu Hamza spent 20 years being a nuisance until the USA wanted to extradite him under the new Extradition Act when the British Govt woke up and threw him a lifeline so he would not be sent anywhere near a gallows.

Lawyers are masters of deceit and duplicity, but in this case we have a big fat Egyptian bouncer who is wanted by Syria, Egypt, Saudi Arabia and the USA - but who has enough "friends" to throw him a lifeline when he needs to spend some R&R in a British prison where his everyy whim is catered to.

Abu Hamza must be an SIS agent or work for MI5 - the amount of protection he has enjoyed over the years suggests that someone has cut a few sweetheart deals with Muslim Motormouths over the years

I have a feeling this appeal will fail miserably. Hamza looks like what he looks like. His words speak for themselves. Is the media supposed to airbrush good looks on the defendant?

If you are kind, goodhearted soul, if you think the ACLU today has anything in common with the ACLU in, say, 1954, you are dead wrong. It has as little to do with the ACLU in 1954, as the U.N. today has to do with the U.N. as originally conceived, and as it seemed to be, for the first few years, with some exceptions, even in the year 1954.

The names of some organizations may remain the same. Outwardly, they may seem to stand for the same ideals. But they do not. Just as, say, the English or History Department at a famous university may bear no relation, in the kinds of people who now dominate it, and the kinds of courses they now offer, to what that History or English Department was some 40 years ago, and we all know -- do we not? -- why. It is the same with the ACLU. Do not be fooled. Do not support it. Do not contribute to it. All of its works and days, for the past five years and more, have contributed to making our ability to defend ourselves against the instruments of Jihad more unsure, more fiendishly difficult. And the same is true with the entirely new situation created by the foolish pretense that Islam is merely a religion and not a complete system, totalitarian in its aspirations to be a Total Regulation of Life, that beyond the ritualistic (shehada, zakat, salat, Ramadan, hajj) is entirely a system for political or geopolitical conquest and domination of all non-Muslims. All over the Western world millions of Muslims have been permitted, in the last few decades, to enter. It was in fact salutary that Osama bin Laden, and so many others, have quickly revealed their intentions through sensational acts. Suppose they had waited another decade, or two, and the Muslim immigration had been allowed to continue?

Wait. Perhaps it is still being allowed to continue? No, that cannot be. Or can it?

But Hamza DID make those speeches, right? They are public record. So is Fitzgerald suggesting self damning evidence is inadmissible in seeking justice? Is this like saying that the victim of a crime cannot accuse the perpetrator of the crime because he was there to witness it? I can understand a statute of limitation running out, but crimes against society, and humanity, should not be so quickly forgotten. British justice should reevaluate its ability to bring justice, if they can't try Hamza for his soliciting murder and terror, without having to find a jury from Mars, or at least tried by reasonable men and women who can come to a conclusion based on the evidence served. If their system of justice cannot do this, then why bother with justice?

We see these events and become discouraged. But the very sense of fairness (now taken to an unnecessary extreme, I'll grant you) that is inherent in western thought is what has made our culture great.

It's like the old Western movies....the bad guys cheat like crazy, but the hero always does the right thing and still, right wins out in the end. This is the essence of western culture: the responsibility of the individual to self govern (freedom to make his own decisions), AND self-police (restraining himself to remain moral.) With freedom comes responsibility. We do not descend to the level of the wrong-doer, even if expedient or retributive or seemingly just.

My hope is that the world (even some of the Islamic world) will begin to tire of this technique they see Muslim fighter using of hiding within the civilian population to attack others, and will begin to agree that it is terrorism, and is never right. Unfortunately, morality as we understand it is not what is taught to Muslim children and converts. It is exactly the same as the communistic threat: the end justifies the means. Even so, I have hope that right will prevail in the end.

I'd tell him, "if we give you another trial and find you guilty AGAIN, you get the gallows". The trial would cost WAY more than what he's worth and there's no sense in supporting him for the rest of his worthless life.

The Canadian media sponsors a public channel for Political news and one programm is the Supreme Court challenges , 7 un-elected old farts from wealthy/white/safe backgrounds get to decide on how we behave and what laws the rest of us must live by.

This week was a challenge to the "Terrorist"
Laws and deporting nationals that lied to get Citizenship and may be plotting to kill Canadian civilians , Terrorists know that even if caught before a Jihad mission that they only need to claim they fear torture if returned to their homeland.

So there was a group of Nabobs actually listening to a Lawyer argue that the "Charter" must protect all Citizens and not create a separate class that can be deported for Terrorism charges or convictions , the tragedy from this was how the Judges claimed that Liberty and Freedom give you Security, and not National Security creating a Freedom or Rights.

The Muslim lawyers and paving the way for the Islamists to do Jihad for Allah's cause while denying Canada the Right to protect all peoples living here, just wait until Ahmed or Fatima start going into Courtrooms with C4-belts to be suicide bombers, those Judges will change their minds pretty fast when it's their life in danger.

I've said in the past that as much as Bush
is perceived as a backwoods yokel I'm betting that history will prove him right and 9/11 was the begining to the end of modern democracy as we knew them, the proof is in how the Leftists has sided with Islamists and treat terrorists as the "Victim" of the USA.
Hopefully the Jihadists will kill off the idiots on the Left to cleanse the gene-pool from those that lost their Survival instinct Gene , then the Muslims will see the real price of freedom and how our parents fought the Nazis for
their childrens freedom and not to please Allah.
Islam will implode unders it's own weight like a bridge that's too big to carry any more weight , the basis for Islam is to create an enemy to unite them in hatred to kill for Allah, but once the enemies shrink the world will be like Iraq where Muslims murder other Muslims because THEIR Quran is the real one.

There is only one way to stop Abu Hamza. It involves... well obviously the woolly minded law lords don't think it is right to convict someone for calling for people to be murdered, too many poppers and cannabis in the British legal circuit I am afraid.

Abu Hamza is responsible for the deaths of Western hostages in the Yemen, some British, the British government is to scared to take him to task about this and has probably been forced to order an appeal. Maybe they have been told what may happen should they not do.

Maybe someone has been paid money to do so because let's face it, the British government is notoriously corrupt.
