Pak minister of state for religious affairs: Stopping marital rape un-Islamic

Like every other reform proposed in the Women's Protection Bill currently under heated debate in Pakistan, the National Assembly committee member's proposal for criminalizing marital rape is up against the dictates of the Qur'an, ahadith, and Sunnah, and those who follow them as the immutable word of Allah, and his prophet, whom they believe to be uswa hasana and al-insan al-kamil -- the "perfect example", and the "best of men."

The proposed reforms, from the Daily Times: "Sex without wife’s consent rape: Kashmala"

ISLAMABAD: Kashmala Tariq, a member of the NA Select Committee on Women’s Protection Bill, proposed that a husband having sex with his wife without her consent should be tried under rape charges. Kashmala said at a Select Committee meeting that men should not have sex with their wives against their will. She said that married women should not be treated like "buffaloes". Kashmala told Daily Times that committee members Mehnaz Rafi, Zahid Hamid and Wasim Sajjad had endorsed her viewpoint.

And the rebuttal, also from the Daily Times: "No, it is unIslamic to stop husbands: Aamir"

ISLAMABAD: Dr Aamir Liaqat Hussain, minister of state for religious affairs, opposed Kashmala’s proposal that men having sex with their wives be tried under rape charges, saying that it was "un-Islamic to stop husbands from having sex with their wives even if they were doing so without their consent", sources told Daily Times. Aamir quoted Surah Nisah to defend his contention.

Sura 4, "an-Nisah" ("Women"), deals with rules for marriage and inheritance, and contains the verse:

Men are in charge of women, because Allah hath made the one of them to excel the other, and because they spend of their property (for the support of women). So good women are the obedient, guarding in secret that which Allah hath guarded. As for those from whom ye fear rebellion, admonish them and banish them to beds apart, and scourge them. Then if they obey you, seek not a way against them. Lo! Allah is ever High, Exalted, Great. (4:34)

And confirming the incredibly long odds faced by those who would change the minimum age at which girls can be married (as reported in this story), the article concludes by noting:

Noorul Haq Qadri and Sher Afgan Niazi defended girls’ marriages at an early age. Niazi referred to marriage of Prophet (PBUH) to Hazrat Ayesha (RA), the sources added.

I guess they have to make sure that, even the ugly, vile, barbaric, savage, sadistic, and misogynist husbands are able to have sex. What woman in her right mind would want to have sex with a male who, after visiting his 2nd through 4th wives, after being beaten, after being treated badly, holed up in her house, starved if he couldn't make enough money to support her and her "sister wives" and their forty children, chased after the sexy family goats, came home and demanded sex?

If women were allowed to grow up, fall in love, pick their own husbands, I'm sure this wouldn't be such a controversy among them. But, if you're 9 years old when you are forced to marry a gross, vile, evil old muslim male (uncle, cousin, or whoever) and are forced to have baby after baby after baby, and live a life of pure torture, I guess they need to assure that even gross males have sex.

But according to the Quran, woman are not buffaloes, they are not rank that high.

Besides, if they cannot have sex with their wives at any time of their choosing, they might not be able to rape their neighbors' daughter.

Seeking guidance on the subject, I looked to Ask-Imam.com (thx Pelayo), an electronic resource for answers to today’s ethical questions. From ‘Is it permissible to have a concubine in today's society?’

‘In short, permission to have intercourse with a slave woman was not something barbaric or uncivilised (sic); on the contrary, it was almost as good as a marriage ceremony.’; http://islam.tc/ask-imam/view.php?q=10684

And this Aamir Liaqat Hussain has the honorific of "Doctor" attached to his name? Disgusting...

Freewoman, I've always wondered what must be the rate of disease among the Muslim population who freely have sex with many women (not to mention the ANIMALS; are there communicable diseases here, too?). Can you imagine; no choice in the matter as to whether you're exposed, or not??? Eeewwww!

Vee, I'll bet if a muslim male were to have the AIDS virus, he would never tell his many wives. He would probably blame the poor women for giving it to HIM. I don't think it would stop him from spreading it around. I have no idea about diseases from animals (that is so gross), but I imagine they do have a flea and tick problem.

limes, that answer by Ask-Imam.com did not answer the question: the answer used the past tense and referred to the past, but the question specifically asked about today's society.

They're getting ahead of themselves .. first things first: Marriage, Islamic style, ought to be banned .. men having sex with children (as freewoman suggests) is always rape .. always ..

Pardon me for repeating myself .. but for those of you who have strong stomachs: Sexuality in Islam by Abdelwahab. Necrophilia is considered a minor vice .. in fact it seems to be treated in a lighthearted fashion. Rape is rationalized. This makes so much sense to me .. coming as it does from the religion of death .. I wonder why it is Western Psychologists avoid dealing with this material?

Sorry .. the writer is Abdelwahab Bouhdiba the book is Sexuality in Islam.

No doubt Naseem can enlighten us oh how enjoyable marital rape in an islamic land is, second only to being scourged as commanded in the koran.

Freewoman, you make a good point about the spreading of viruses. Everyone is concerned about AIDS but there are other STDs such as Chlamydia that is spreading amongst the heterosexual population of the world. These poor women could have this disease, end up barren because of what it does internally, and they will be blamed because they do not produce children.

Another thing that bothers me about Pakistan is that the men seem to think that it is ok to rape western women. We are seen as sluts, which means we are a constant target for their animal appetites.

Maggie, my opinion is , muslim males think we are sluts because they cannot control us or cover us. They have a limited vocabulary, limited social experience and limited self control. If muslim males were taught that they are responsible for their actions, we would see a lot less rapes or even jihad. They have not the slightest bit of respect for other individuals. If the women were allowed to have some say in their lives and their children's lives, I don't think they would be that way.

Where is Gloria Steinem and the other members of the National Organization of Women? Why are they not standing up and raising the warning against marital rape in Islam? After all, they once stated that marital relations between legally married men and women were nothing but sanctioned rape.
