EU proposal to bring Sharia divorce law to Europe

"Opposition to EU divorce rules plan," from DPA, with thanks to Sr. Soph:

Luxembourg (dpa) - A European Union proposal that would allow the laws of non-EU countries to be applicable in divorce cases ran into fierce opposition from Sweden on Thursday.

Liberal Sweden strongly resists the plan, which it says could force EU member states to dissolve marriages on the basis of foreign law, including traditional Islamic law, or Sharia.

"It is not acceptable that the planned rules would lead to Swedish courts having to apply foreign law," a Swedish diplomat told reporters at a meeting of EU foreign ministers in Luxembourg.

Germany is pushing for new rules under which international couples, prior to marriage, would be able to set out in a contract which country's laws will reign in a divorce court.

Germany currently holds the rotating EU presidency.

Actually I have read about this on http://islamineurope.blogspot.com with the title "Sweden: Don't give Islamic laws a place in Sweden"on 17th of April and I read that such a law has been pushed for by Islamic organizations and Imams in Sweden as well. I am glad that they decide to oppose it on an EU level. As soon as I read about it on "islam in Europe Blog" I left a long comment against it. I think it is absurd to even consider such request by Islamists. They don't represent the Muslim community as a whole. They just represent their own opinions and maybe some like them. So as unelected people they have no right to push for any laws for a constituency (Muslims) who never officially and openly elected them. As an ex-Muslim in Europe who left her native country because of Islamism I am scared to death by such attempts to creep barbaric Shri'a law into civilized countries. Here is a copy of my comment to the news on "Islam in Europe Blog":

"The Swedish authorities should never accept such a thing. The point is that these so-called "Islamic divorce laws" are objectively and truly unjust and demeaning to women and violates their unalienable human rights. According to these laws a woman has no right to get a divorce unless her husband wants to grant it to her, but a man can divorce his wife anytime he wants without her consent, and the custody of the children over 6 y.o. will automatically go to their father and he will decide whether the mother is allowed to see them and how often. This is an unjust and shameful system which should be eradicated even from the Islamic country in the name of human rights and sexual equality. It is a source of much evil in those places too. As an Iranian ex-pat I have seen first hand the damaging and tragic effects of these laws in the lives of many women. Many mothers live with abusive husbands from the fear of losing the not only the custody of their children but also the right to visit them. Many women who wish to divorce cannot get it from their husbands and are forced to live with them against their will. Many people from Muslim countries migrate away from their native countries exactly because of the existence of such unjust laws in their countries of origin. If these abominable rules and injustices are going to follow them all the way to their newly adopted countries then where should they run away to, to be safe from these laws. Besides I highly object the fact that some Imams and so-called Islamic originations own the monopoly on representing "the Muslim community" which is very diverse and complex. The Swedish or any other European government should not get tricked into thinking that by granting the wishes of a few Imams and Mullahs, they are doing the Muslims community as a whole any favor and showing them openness and tolerance. These Imams and Mullahs and Islamic organizations have no other intention but to do away with the Swedish law so that they can impose their own power and interpretation of religion and religious life on the Muslim community as a whole. I think they should not be trusted and they should not be allowed to speak for the community as a whole. Many of us immigrants from Muslim countries came to Europe because we prefer to live the European way of life and our rights must be respected as well and our destiny should not be entrusted to the hands of some questionable people that we never openly chose to represent us! If that happens it would be a tragedy!

The sooner Germany gives up the Presidency, the better. It is also doing its best to revive the wretched EU “constitution” which was scuppered by Dutch and French voters a few years ago. And all credit to the Swedes in this case.

i am against anything that would improve the life of muslims in europe.

let them having their sharia fully, including legal beating, legal honor killing.

The more muslim (especially women) leave our lands in a way or another, the better is.

Thanks for support JFGR! The thing that I never understood and still don’t understand is that if these Islamist are so enamored with the Islamic way of life and Shari’a, why on earth do they leave their native countries and come to the West were the way of life is totally against their mentality and every aspect of it is outside of their Shari’a-conditioned “comfort zone”!! I personally left my country precisely because I did not like the way of life there and I realized that Western values reflect my mentality and my desired way of life much better. I don’t mean that I didn’t like any aspect of my native country’s way of life, but mostly the values there were not my values and I wanted to live freely and speak my mind and have freedom of religion and some privacy in my life. So I left Iran and came to Europe, but for example all these Somalis and Arabs who long so much for the rule of Shari’a and feel nostalgic for the times when they could divorce their wife and take the custody of her children away from her without any hassle and stuff like that, then why they don’t go back to Arabia and Somali. All these things are readily available to them there!! The Shari’a reigns supreme there. Why do they have to come all the way to Europe which they know from the beginning that is not Shari’a-run and is part of the “Decadent West”, and try to complain why it is not run like Saudi Arabia and Somalia and Iran and then try to change it and make it similar to the hellhole they came from!!?

Wow, I'm glad I'm a man and not a woman. Coming to Europe once meet an opportunity to advance oneself and to gain freedom from a former oppressive life. Not anymore.. thanks to PC EU Officials .. Europe can be just as oppressive to your rights as a human being, regardless of one's gender, as your former country was.

Clarification for JFGR, I am not a Muslim. I am an ex-Muslim from Iran. I was born in a Muslim family. Both my parents are Muslims and technically I was born a Muslim, but I denounced this religion as soon as I had the freedom and safety to do so. It does not make the world a better place and it never did and it never will. Had I been a Muslim probably I would have never left my country or I would have moved to another Islamic country.
I wish Europeans would give up being so soft and multicultural and put their foot down and demand from their immigrants not only learning the language of their new country and assimilating with the native community but also decisively and thoroughly leaving behind their backwards customs and traditions which made their native societies the pathetic mess that they are!

…There is no reason to be so mean to me buddy! I am on your side! Besides I don’t agree that all these immigrants just come here as part of the global Jihad to consciously infiltrate Europe with Shari’a. Of course some of them do, I never deny that, but not most of them. But that is not to say that they cannot be used as an instrument of pressure when it comes to push Europe to the direction of Shari’a. Many of these people are just very confused and ignorant and they lived in backwards societies with not much education and a rotten culture which made their countries economically miserable and physically unsafe. So they came to West seeking a better life, but since they know no better they start to perpetuate the same stupidities that made their societies of origin nearly collapse, besides on top of that they put their nose up for Westerners because as they think: “Their women are so loose and half naked, and their TV shows obscenities, and their youth get drunk on weekends, etc…” They just want it both ways. They want the prosperity and stability that they have here in the West, but they are so ignorant that they want to oppose the very fabric and basics of Western society that made their safety, prosperity, and better quality of life possible and replace it with the same laws and rules which made their countries so bad that they had to run away from. They just don’t see these cause and effect! I think Europeans in dialogues and as a matter of policy should make this cause and effect situation very clear to them. It is a cultural shock for them and Europeans should force them to go through it and get over it instead of shielding them from it and pampering them. And certainly any attempt to change their national laws for the sake of these people is simply insanity. The immigrants should adopt themselves to the new conditions not the other way around. Forget about Global Jihad for a moment now. It is simply like going to someone else’s house and immediately upon your arrival telling your hosts: “Oh I don’t like your taste in decoration! You are so bad at it. Let me tell you how you should arrange your furniture. And if you don’t like my rearrangement in the common rooms at least you should redecorate the guestroom for me all over again besides it is so bad as it is… besides you should pay for it too!” What do we call such a person? Someone who has no manners! So we should stop inviting him to our house! So why are we still inviting them?!

I think the point she is trying to make is that the wussy Eurodhimmis fall all over themselves making concessions to muslims, concessions that are very detrimental to muslim women. Europe should be assimilating its muslims, not creating parallel societies. How in the world could a civilized, modern society establish a different set of laws for every ethnic/religious group of people and expect anything short of chaos and turmoil. Why not abolish all existing laws and tell immigrants to obey the laws of their homelands; the muslims can pretend they are in crapistan; the Hindus in India; the Koreans in Korea; etc., ad nauseam. The laws of a sovereign nation should apply to all of its citizens, with NO EXCEPTIONS.

If the damned muslims choose to immigrate to Western nations, they should be prepared to obey Western laws. If they cannot live without sharia, they should not leave their islamic sewers. I wonder if it has ever occurred to the left-wing, socialist, multi-culti eurocrats that maybe people immigrate to the West because they want to escape the repression and tyranny of their native countries. It is the hardline clerics and Saudi wahabbis and their minions that are pushing for sharia and traditional muslim culture and they should be either ignored or deported. What right do foreigners have to demand that the laws of another country be changed to accomodate their religion?

well if the Europeans will listen this law will not go through but we need to remember the brand of Islam taught in Saudi Arabia and followed by most Muslims in Europe teaches that Islam must rule the world and dominate and all other religions must be second-class to it as the EU of proposal to bring in sharia law in divorces is just the camel's nosewith the rest the camel to follow

Good on the Swedes and shame on the German government for even thinking of betraying its western culture. Would they have even started to consider allowing South Africa's apartheid laws to apply to mixed race marraiges in Germany? No, of course not. Then why consider allowing Sharia law to apply to anyone in Germany when it is just as bad or worse than apartheid?
