Sana'a: Human rights activists and lawyers should put pressure on the government to ban marriage of young girls, said a Yemeni lawyer.Lawyer Shatha Nasser, who defended an 8-year-old girl who was divorced last week in a Yemeni court, called all civil society organisations and human rights activist to form a coalition for amending the current law which allows marriage of children under 15.
"Our next step now is to do all that we can to make the minimum marriage age in Yemen 18 years," Shatha told Gulf News.
"But this cannot happen if there is no cooperation between lawyers and human right groups," she said.
Eight-year-old Nojoud was in the news last week after appearing in the court requesting a divorce from her 32-year-old husband after a two-month marriage. Shatha said there were a lot of child marriages in Yemen.

On April 15, with support from Shatha and judge Aboud Al Khaleq Ghowber, Nojoud paid her way out of marriage. The amount of 100,000 Yemeni riyals was given by an anonymous donor in the UAE, and Nojoud happily became an 8-year-old divorcee.

According to the International Centre for Research on Women's 2007 statistics, Yemen is one of 20 developing countries where child marriages are common. Nearly half of all Yemeni girls are married before the age of 18.
Most women have their first child immediately after their first menstruation cycle and are likely to have many more. Yemen's fertility rate is very high, with an average of 6.3 children per woman, and the country also has some of the highest mother and infant mortality rates worldwide.
According to research on early marriage in Yemen from Oxfam and the United Nations Population Fund, many girls like Nojoud develop irreparable psychological scarrings from early marriage and the forced sexual encounters that accompany it.
"I hated nights because they usually meant that my husband would come to my bed. I used to run from him and he would chase me and beat me and do his thing. I pray that my younger sisters do not face the same fate," said Nojoud. Now Nojoud is living with her uncle and his family in relative safety.

As a survivor of childhood sexual abuse myself I can certainly empathize with this child. Let's hope her uncle and family are not proponents of "honour killings".

Aisha likely only 8 years old when Mohammad "consummated" (raped) her, if the act was on or near her 9th Islamic birthday. This is because Islam adopted the pagan Arab year, called a lunar year, which is a crude approximation of a true year (the time it takes for the Earth to revolve around the Sun). Now known as an "Islamic year," in keeping with Islam's habit of adopting innovations,then eradicating the inventing culture (i.e., Arabic numerals were really Hindu numberals), the Islamic year is 11 days short of a true year. This means Aisha was up to 99 days (9 x 11) short of her real 9th birthday when the ageing Mohammad mounted her.

If most of the girls are under 18, then it is safe to say that Yemeni men regularly rape children. Children under 18 or some argue, 16 are unable to form sexual consent since they are not mature enough psychologically. Even if the girl "goes along" with the sex, it is still rape.
In this case, the man is clearly raping the girl, even if she is in some insane cultural justification, his "wife".
This said, why do Yemeni men want to have children as their wives? I don't mean this in the naive sense, since of course there are evil pedophiles in every culture, but rather than when a pedophilia is widespread in a culture, we must ask why that is the case. Is there some sort of deep seated insecurity amongst Yemeni men that they are not taking mature women as their companions. I suspect however that companionship is not the real issue, but rather Islamic understandings of women as property ie a field to go into is at stake here.
As I have said before, Islam forbid Muslim women from marrying Jews and Christians because we really do honor our women (overall) better than Muslim men. Why hold the threat of death over women for marrying non-Muslims if there is not a great demand to do so?
Has anyone done any sociological studies around the relationship between Islamic theology and the levels of rape in Islamic cultures? In particular, child rape?
I recall being told by a Muslim once that our society was sexually decadent. Given the need for multiple witnesses to rape, and the denigration that a women experiences even if exonerated, leads to a climate where girls (and boys) and woman can not report rape. I would speculate from this that in Muslim society the rate of women/children/boys being raped is vastly higher than in Western society.
When a religion calls child rape "marriage" one really must wonder why it is not something worthy of scorn throughout the whole world. I'd be embarrassed to be a Muslim.

What is so strange is that if Mohammad was running around today, preaching, raping, etc... he would find himself:
1. Dead. Some dictator would have shot him for trying to overthrow his government.
2. In a mental hospital for the criminally insane. There he would be screaming out his message to the doctors and other inmates.
3. In prison for pedophilia. And if was in the US, he could then share a cell with Warren Jeffs. They could shout revelations from God at each other.
Too bad Mohammed lived in the 6th Century and not the 21st.

Also, it's funny how the plight of Muslim women doesn't seem to matter much to "women's rights" and/or "human rights" groups in the West. I wonder why...

You know in the world of compromise people are supposed to ask for a lot more than they expect to get. If you need a $5,000 salary increase you must ask for $10,000 or even $15,000. The Yemeni lawyer will be happy if they increase the minimum legal age for marriage to nine (9). As of today, there is no minimum legal age for marriage under Islam. A 50 year old mad can legally marry a one or two year old infant. He will be legally allowed to abuse her sexually as long as he does not perfrom a vaginal intercourse until she is at least 7 or 8 years old, everything else is allowed under Islam.

In the North Italian city of Treviso, a North African immigrant has raped a ten-year-old girl in a local playground. (Here is the news on the leading Italian newspaper, Corriere della Sera: http://www.corriere.it/cronache/08_aprile_25/treviso_violenza_bambina_1e0d1418-12c6-11dd-8993-00144f02aabc.shtml). Do you suppose anyone will realize that the rapist probably thought he was wholly in his right and doing his Islamic duty?

Tapper: I've wondered the same thing myself. The only answer I've been able to come up with is the deafening silence from Western women's groups over this is what Michael Savage says "Liberalism is a mental disorder." However , let's not underestimate the power of the internet to go viral on stories like this leading to rapid positive change in standing up for what's right..basic human dignity for these muslim women.
