“He wrote “˜Talaaq”, three times on his wife’s Facebook wall.” Why not? We hear that “The accused man is still absconding. According to the police this is case is a first of its kind. City Qazi Sayeed Mushtaq Ali Naqvi has ruled that this way of divorcing a wife is against Shariyat” — that is, Sharia. However, Sharia courts have already determined that Muslims can divorce their wives via text messaging.
But what if hubby decides he wants her back? “If he divorces her finally, she shall not be lawful to him after that, until she marries another husband. If he divorces her, then it is no fault in them to return to each other, if they suppose that they will maintain God’s bounds. Those are God’s bounds; He makes them clear unto a people that have knowledge.” (Qur’an 2:230)
The only catch is that the new husband must consummate the marriage before divorcing the woman. Only then can she return to her first husband. Muhammad made this clear: “Narrated ‘Aisha: A man divorced his wife and she married another man who proved to be impotent and divorced her. She could not get her satisfaction from him, and after a while he divorced her. Then she came to the Prophet and said, ‘O Allah’s Apostle! My first husband divorced me and then I married another man who entered upon me to consummate his marriage but he proved to be impotent and did not approach me except once during which he benefited nothing from me. Can I remarry my first husband in this case?’ Allah’s Apostle said, ‘It is unlawful to marry your first husband till the other husband consummates his marriage with you.'” (Bukhari 7.63.190)
