Irfan Khan was prosecuted, but the charges were dropped. Now he is claiming that the prosecution was “malicious” — emanating, apparently, from the ingrained “Islamophobia” of the U.S. government. The son of a Muslim cleric convicted in Florida of supporting the Pakistani Taliban has filed a lawsuit against the U.S. government.

Irfan Khan claims he was maliciously prosecuted and falsely imprisoned for 319 days, mostly in solitary confinement. The lawsuit filed this week in Miami federal court seeks unspecified damages under a law that allows private citizens in certain cases to sue the federal government.

Khan is the son of 78-year-old Hafiz Khan, who was sentenced to 25 years in prison following his conviction in March of funneling money to the Pakistani Taliban. Irfan Khan was originally indicted as well, but prosecutors abruptly dropped the charges before trial.

A federal judge ordered the acquittal of another son, Izhar Khan, citing lack of evidence.
