Muslim cleric denounces Islamic State for its imposition of the jizya tax

More comments interspersed below.

“ISIL’s ‘caliphate’ makes a mockery of Islam: clerics,” by Waleed Abu al-Khair, Al-Shorfa, July 1, 2014:

The recent announcement in which the “Islamic State of Iraq and the Levant” (ISIL) said it was creating an “Islamic caliphate” and installing Abu Bakr al-Baghdadi as caliph makes a mockery of Islam, clerics and experts told Al-Shorfa.

In a June 29th audio recording, ISIL spokesman Abu Mohammed al-Adnani announced the group was establishing an “Islamic caliphate” and that al-Baghdadi had “accepted the pledge” to serve as “Caliph of the Muslims”.

The declaration means Muslims must pledge allegiance to al-Baghdadi and that the legitimacy of all other “Islamic states, emirates and organisations” will be annulled, al-Adnani said.

The ISIL would now be known as the “Islamic State”, he said.

‘Distortion of Islam’

With this declaration, ISIL “reached the peak of its exploitation and distortion of Islam”, said Al-Azhar University professor of sharia and law Sheikh Mahmoud al-Jabali.

“This announcement demonstrates the extent of its disrespect for the centuries-old Islamic legacies,” he told Al-Shorfa.

“What this gang is doing in announcing the caliphate and the instalment of the caliph is nothing but lies and fabrications and an indication of the growing injustice exercised over people in the areas where they are now present in Syria and Iraq,” he added.

In Islam, there are religious conditions and guidelines to be met in the creation of a caliphate which are not found in the case of the al-Baghdadi state, al-Jabali said.

ISIL’s declaration “is a void announcement because it lacks the minimum pre-requisites of the Islamic state, which assumes the state has extended its control and authority on all territories”, he said. “And what is meant by ‘control’ is control through words and persuasion, not by blood and killing, as ISIL is doing”.

When did a caliphate ever extend its control and authority through words and persuasion, not by blood and killing? Three of the four Rightly-Guided Caliphs were murdered. The Umayyads solidified their authority by defeating the Shi’ites at Karbala in 680. The Abbasids violently overthrew the Umayyads. The Shi’ite Fatimids and the Ottomans established their domains by force of arms.

It is clear ISIL is distorting the concept of the caliphate for its own purposes, “which is something that no one can be convinced with except he who is ignorant in his faith”, he added.

Furthermore, when choosing a legitimate caliph, multiple candidates should be presented in order for one of them to be chosen in a process similar to an election, al-Jabali said. There would be six initial candidates, with a final selection between the remaining two, rather than a unilateral declaration of authority.

This idea applies more to an established caliphate than to a nascent one, and rarely, if ever, happened in practice. Here again, caliphates were established by force, with one strongman asserting his authority, not by orderly elections from slates of six candidates and a runoff between the top two vote-getters.

ISIL’s declaration forewarns an increase in the rift between ISIL and other al-Qaeda linked groups, said Maj. Gen. Yahya Mohammed Ali, a specialist on terror groups who is retired from the Egyptian army.

The announcement “foretells of further bloody fighting between ISIL and those opposing it in the areas under its control in Iraq and Syria, especially against al-Nusra Front (ANF), and other al-Qaeda-linked organisations”, he said.

“Al-Adnani’s announcement was a clear message to al-Qaeda, because the announcement of the caliphate annuls other ‘Islamic states’ and the mandate of their rulers, whether they belonged to ISIL or any other organisation,” he said.

Thriving on ignorance

“Regrettably, ISIL, al-Qaeda and others thrive on the presence of those who lack religious knowledge and exploit their ignorance to brainwash them, turning them into obedient tools in their hands,” Ali said.

The declaration of the “Islamic caliphate” and the naming of al-Baghdadi as caliph is “the completion of the bloody farce being played out in Syria and Iraq”, said Sheikh Moaz Abdul Kareem, who was a preacher at the al-Omar Mosque in Aleppo, Syria, before moving to Cairo.

ISIL’s resort to the title of caliph is nothing but an attempt to hide behind an Islamic, historical symbol in the face of opposition from most people who are not convinced with their presence to begin with, he told Al-Shorfa.

“One of the conditions for a caliph is that he should possess extensive knowledge in religious sciences and be a scholar of religion, but this condition is not found in al-Baghdadi, who is not one known for extensive knowledge in religion,” Abdul Kareem said.

On the contrary: al-Baghdadi has a Ph.D. in Islamic studies.

“If, for argument’s sake, we accepted that ISIL is seeking to create a caliphate, the pledge of allegiance would not be made by his entourage and his soldiers, but by all the people of the territories which will be ruled by the alleged state,” he said.

Historically, this never happened, either.

“This is one of the first conditions which must be fulfilled in appointing the new caliph, which is not found in this case, especially in the wake of the huge revulsion shown by the people of Syria against ISIL due to its unacceptable practices, which it conducts in the name of religion, such as oppressive detentions, the imposition of ‘jizya tax’, extortion and executions,” he added.

This shows that Sheikh Moaz Abdul Kareem is simply being deceptive. How can he denounce the Islamic State for imposing the jizya when it’s in the Qur’an? “Fight those who believe not in Allah nor the Last Day, nor hold that forbidden which hath been forbidden by Allah and His Messenger, nor acknowledge the religion of Truth, (even if they are) of the People of the Book, until they pay the Jizya with willing submission, and feel themselves subdued.” (9:29)

‘Empty words lacking meaning’

The purpose behind declaring the state is to “ensure the existence of this gang known as ISIL” and the existence of additional gangs that follow it through voicing their allegiance, Abdul Kareem said.

Furthermore, ISIL is trying to lay its hands on available funds and resources in the areas it controls, he added.

Al-Adnani’s claims regarding setting up all the religious aspects of the “Islamic state” are no more than “empty words lacking any meaning or substance”, he said.

“Everyone knows how sharia and hadd punishment are applied in ISIL controlled areas, and against whom, as the majority of those on whom religious rulings are being applied are those opposing ISIL, not the criminals or the murderers, and clearly they are being killed in cold blood under the cover of religion,” Abdul Kareem said.

    My guess as a total NON-expert : imams who speak publicly about this are privately terrified of the huge tornado Al-Baghdadi has spun into existence.

    Every Muslim is being sucked up into it and no one knows how much chaos and blood will come. Equally awful is Infidels’ attention captured with such violent tactics.

    Anyone with access to media or the internet now has gotten a vivid idea of just what Islam produces when it goes on a rampage. So the reactions we encounter are a mix of taqiyya and horror — in varying percentages.

      Well said.

      Don’t forget the selectivity of particular traditional verses, and then the elasticity of their interpretation of these Koran verses by different credentialed Muslim-faction imams here and there to suit their individual situations du jour and traditions. Different pulpits, different thundering condemnations….or…….smiling agreement and benediction.

      I’d call this Hypocrisy with my Western mindset, but varying Eastern trained mindsets, read “Muslims”, call this “piety” and their “duty”. Depends upon who is saying what under which circumstances.

      Wonder why we can’t figure our what’s going on? It’s “Cultural Wiring”, love it or hate it. But don’t deny that it’s a basic consideration to be wrestled with.

      So, picture yourself, Dear Reader, with your Western traditions inside your head in your wood paneled office at the State Department/Pentagon/White House West Wing trying to issue a policy paper after a survey of these declarations indicating which Muslim faction/tribe/movement to support with cash and arms and materiel amid all of these shifting sand dunes. Young American and Allied lives will depend upon your decision.

      When, not if, this armament/cash/materiel will be used against us is the reality.

      Maliki and Karzai are patiently smiling.

    This will always be happen when Islam is the majority. But they blind to see what happen when they live as minority. We must respect them while they aren’t.
    The question is, why something like this happen in this modern time?
    Of course because of the other faith (non Muslim) or other race, are no longer respect their own race or religion. See? More and more Christian didn’t respect their own Christianity.
    You build Multiculturalism – diversity in EU and US for your own destruction.

      This “multiculturalism” thing is a relatively new trendy catch-phrase. It’s politically correct. Our earlier waves of immigrants learned English as they worked here and assimilated into becoming “American”.
      Somehow that’s not true today. I haven’t a clue how this “newthink” of maintaining separateness evolved, but it’s something we have to solve at great risk to our former unity.

    So, where’s the declaration of takfir? Al-Baghdadi believes to be following islamic doctrine. If he isn’t then what’s wrong in publicly excommunicating him? Are they just going to let him keep declaring himself a muslim while claiming his actions are non-islamic? The contradiction should be obvious, but the PC MC MSM are so eager to whitewash islam that they don’t do the right questions.

      So, where’s the declaration of takfir ?”

      I expect it’s because, at the moment, these ‘clerics’ find the behaviour of Baghdadi and his murderous army somewhat **embarrassing**, what with all that beheading and crucifying. Not that they innately object, it’s just that they know even the tools and apologists in the West find it too hard to swallow.

      If Baghdadi ever manages to establish himself, as the ‘strong horse’, I doubt we will hear any more nonsense about IS being ‘unislamic’.

    There is nothing wrong or immoral with Jizya, b/c those paying also get benefits that even we Muslims are not entitled to. And should always be comparable in amount to the amount of zakat that Muslims are expected to donate; same order of magnitude. Among the benefits, for example, they are exempt from joining the Muslim army and potentially fighting defensive wars against their own Christian or Jewish brethren, even those who have committed acts of violence against innocent Muslims.

    What ISIS and the others don’t understand about Jizya is that we Muslims are bound to offer security & protection to those paying it, i.e. no threats or anything.

    And there are more ways to pay Jizya than just money. While the Jews are rich and will never be in this situation, poor Christians can offer their young daughters in marriage to Muslims and of course we should consider their Jizya paid for the next 5 years if they have done so.

      Joke post from a joke user. Zakat is 2.5% of the yearly income, jizya has always been crushingly heavy with the intent of humiliating non-muslims. Those two taxes are not “comparable” or in the “same order of magnitude”, and historically the jizya was collected through force, mafia style – it’s no coincidence that the term “mafia” comes from the arabic and originated in a region who was once under islamic rule. And it’s not that non-muslims were exempt from joining the muslim army – the janissaries were originally non-muslims abducted from their families – because they had a special status. It’s that muslims were too afraid of letting non-muslim owning weapons (for fearing a rebellion) or letting them fight (especially when muslims were fighting against he native trying to get their land back). Think about it: if non-muslims were paying the same amount of tax as muslims and not being drafted to the army them human nature would cause muslims to convert out of islam and not the other way around. When muslim conquered a new land they were in minority so they couldn’t risk letting the conquered getting their hands on weapons and starting a rebellion. And can you imagine a muslim leader, indoctrinated to believe that jews and christians are always scheming against muslims, tak, let’s say, christians from a land he just conquered to fight against christians who were trying to drive the muslims out of their lands? Why would christians being forced into battle against their own people side with the muslims? No, non-muslims were forbidden from owning weapons and fighting because muslims feared for their safety. Would they need to fear for their safety if they treated non-muslims fairly?

      Even if we were to overlook the jizya, there are plenty of degrading conditions in the pact of Umar that make it quite clear that non-muslims in a muslim state don’t have the same rights as muslims. Heck, let’s let Abu Waleed explain by his own words how “wonderful” life is for non-muslims in a muslim state:

      Besides the barrage of lies about jizya and the status of non-muslims in a muslim state, poor stj makes a remark about Jews that was probably straight out of a deleted scene from Borat. What do you think it would happen to a jew who couldn’t afford to pay the jizya in the hands of someone who seems to think all jews are rich? We know what happened to Kinana when he told muhammad he had no treasure hidden. He was tortured with fire on his chest and, since he neared death without saying anything, muhammad had him beheaded. And since muhammad is the example muslims are supposed to emulate…

      stj also seems to believe that it’s ok for poor christians to sell their daughters into marriage with muslim men as payment for the jizya. So much for “security and protection”, non-muslim women in a muslim state are to be used as chattel for the enjoyment of muslim men. Notice that he said that “There is nothing wrong or immoral with Jizya” because those who pay it, even if they do so by selling their daughters into marriage, are entitled to the “benefits” explained by Abu Waleed in the above video, so he doesn’t see anything wrong or immoral with using non-muslim women as currency. So remember, if you think it’s immoral to sell a girl into marriage to someone who will regard and treat her as subhuman trash you’re an “islamophobe”.

      There is nothing wrong or immoral with Jizya =
      There is EVERYTHING wrong and immoral with Jizya

      Muslims are bound to offer security & protection to those paying it, i.e. no threats or anything =
      Muslims are bound to offer further harassment, crucifixion, beheadings & more to those paying it, plus threats or rape, genocide, kidnapping, and so on.

      1. Curious name… “squeezethejuice.”

      2. Why are you explaining the jizya, which is unjust in the first place? You don’t have the right audience here. There are 83,000 unique visitors / month to this site that see jizya for what it is: oppression.

      3. “Poor christians” would rather die than see their children marry a muslim.

      4. Maybe you should try a new “faith” for a while. It might give you the opportunity to live your life as a moral contributor, without the distractions of silly, contradictory, confusing rules.

These ISIS operators are smart, they know a sucker when they see one, especially when he’s on his knees holding it open with head turned around nodding and winking “c’mon.” Bill Maher will do the heavy lifting on the intellectual part about Moslems “arguing” among themselves to feel their way into modern democracy blah blah blaaah, with the MSNBC crew doing the 24/7 grunt work.
