“Even the human rights lawyers should be embarrassed, it’s so ridiculous.” What isn’t ridiculous about the British government these days? Did someone slip something into the water of the Thames — something that induces suicidal madness in politicians and public officials?
“Walking free, the terrorist we can’t deport… because he’s kept his NAME secret for 21 years,” by Chris Greenwood, Daily Mail, August 8, 2014:
An Islamic terrorist has stopped Britain deporting him – by refusing to give his name for 21 years.
A judge ruled that the Algerian is a ‘trusted and senior’ member of a violent terrorist group and has helped suspects abroad.
But his lawyers have used human rights laws to prevent the Government from throwing him out of this country.
Officials cannot draw up crucial paperwork guaranteeing his safety without knowing his true identity.
Meanwhile, taxpayers have been left to pick up the multi-million pound bill for his legal aid and months of NHS hospital care.
Astonishingly, the terrorist, known only as B, is free to walk the streets because his bail conditions were ‘relaxed’ to allow him to go swimming and worship at a mosque.
The legal stand-off provoked a furious response from a senior Tory who branded human rights laws ‘a farce.’
Dominic Raab, MP for Esher and Walton, said: ‘It is a damning indictment of the human rights farce in this country that this man has been able to run rings around the deportation system.
‘If a dangerous criminal or suspected terrorist can frustrate deportation, by spewing out human rights objections while refusing to give his name so the claims can be checked, it turns the system on its head.
‘Even the human rights lawyers should be embarrassed, it’s so ridiculous.’ The saga emerged in a recent court ruling when B tried to halt deportation proceedings. But judges struck out his appeal. His lawyers had said the failure to resolve the stand-off was a breach of his human right to an ‘effective remedy’ by the State to his legal limbo.
But the judges criticised the failure of the mystery man to identify himself as a ‘deliberate distortion of the evidence’.
They said his ‘manipulation of information, his contempt and abuse of process’ must not succeed because it would encourage others to ‘behave in a similar way’.
The terrorist arrived illegally in Britain in 1993. The Special Immigration Appeals Commission found he bought a satellite phone and airtime for extremists in Algeria and Chechnya in 2000.
The terrorist originally gave his name as Nolidoni, later claiming to be Pierre Dumond. Both identities were false. He then refused to identify himself, as his lawyers cited two sections of the European Convention on Human Rights.
They said revealing who he is would put his family in Algeria in danger, a breach of article eight, and he could be at risk of torture, a breach of article three.
In response, the Government spent huge sums trying to independently establish his identity with a global investigation.
His fingerprints and DNA were taken but the Algerian authorities, as well as international counter-terrorism agencies, were unable to find a match.
An Algerian language expert was employed to study his speech to pinpoint where he was from. Officials were even sent to Canada to speak to a fellow Algerian whose identity he stole after obtaining his passport.
But no progress has been made. One source close to the case said: ‘He has admitted the name he was using is not his real name and the Algerians confirmed this.
‘Because of this the Government cannot obtain the individual assurances needed to secure his removal. It is not possible to deport him without these assurances because of our international human rights obligations.’ The terrorist is now on bail, with a nine-hour curfew and is banned from leaving a defined area without giving prior notice.
He is also banned from meeting a list of named associates, using his mobile phone or accessing the internet.
A Home Office spokesman said: ‘We continue to pursue every avenue to ensure this dangerous man is removed from the UK.’
Yeah, maybe by 2035.

it is the result of arguing that everything is relative, that there is no real good or bad. If you lose your moral compass you will not be able to pass judgement and since judgement is something bad in itself, good is bad and bad is good. Britain is lost.
But it will be a great example for other countries and so Brits can pat themselves on their shoulder for helping the rest of Europe understand islam just before they get their infidel heads chopped off for allah.

If he has no name then he doesn’t exist. So just shoot him on his head, and nobody will remember him. He has no name to be remembered, right?

Human rights laws that are explicitly designed to make it impossible to deport criminals and illegal migrants, and require providing them with economic and housing assistance while their state provided lawyers game the system are, on their face, a farce. When the law has degenerated into farce that renders the state impotent to enforce its borders or protect its citizens, you no longer have a state.

I’ve noticed more and more of the more mature element here thinking along those lines.
Meanwhile the naive and idealistic young together with their liberal enablers continue the delusion.
We’re headed for a crunch and patience is wearing thin. Muslim recalcitrence, whilst offering nothing back is being, at last, noticed and our tolerance is being tested as never before.
An example is Gov. Minister Saayed Warsi’s recent resignation because her demand of sanctions or castigation towards Israel was ignored.
Her petulance is noted, as also her silence on the slaughter in Syria and Iraq. Obviously it is quite plain that because this slaughter is mainly Muslim on Muslim seemingly it doesn’t count and this glaring imbalance is being quite openly commented upon.
Cameron is a fool, unfortunately the alternatives of Miliband and Clegg are even worse so there we have it. The rock and the hard place of the voting public.
Ukip whilst retaining a diplomatic silence on all of this is the answer and I’m sure that leader, Nigel Farage if given enough real power would finally say, enough is enough.

Why don’t they just assign him “Abdul Dickhead” and kick him out? Maybe UK stands for Unsure Kingdom.

Surely the Government has not forgotten to have the terrorist sign a promissory note not to leave. Relax, how could he possibly escape when limited to a 9 hour curfew?
What could possibly go wrong?

I suppose that stuff about “truth serum” that you see in the movies just won’t work on some people. Maybe the British should establish some type of “research/rehabilitation center” in the Antarctic where this fellow might enjoy staying as a guest …. in a room all of his own.

The governments of the UK and other country pretend that illegal residents necessarily need to be deported back to “their own” country. There is no law requiring this.
It would be quite easy to require one of the many foreign governments receiving foreign aid from the UK to accept a few undesirables (as Australia did in years past). Burkina Faso is a very poor African country – $5,000 would be a generous amount to guard and feed an Algerian terrorist.
Once in Burkina Faso, the terrorist would quickly remember his real identity and try everything to get back to Algeria.

Back a number of years ago, when unsolved crimes of rape were reaching their statute of limitations, and the rapists were *unnamed* due to not knowing who they were, someone with a thinking brain said: We should write out an arrest warrant for *…..* and the information in the arrest warrant would be for their DNA which they had as a result of the rapes. With DNA, the height, hair/eye color, etc. can be known and these were included on the warrant. No name was written until the guys were arrested…due to their DNA getting in the system for an arrest for a crime he committed and was caught.
This arrest warrant for the DNA of the guy, kept the case from reaching a statute of limitations and many more arrests for rape were made.
Perhaps the Brits could devise something similar for *B*. Why they need his name to put a *protection* order …why protect a terrorist…is beyond my reasonable way of thinking.
Henry says
Clearly ‘civility’ here, is being taken way to far to the detriment of society at large. If compliance for so basic a thing as a name is withheld to frustrate the system, surely the state should have the right to take common sense action to deport him in any case? And if not, what’s next? Is this ridiculous loop hole going to be plugged, or do future Jihadis get to play the same game with the system?

One of our main problems is that we have far too many people in positions of power and influence, and spouting their PC crap on message boards who still remain student activists into their 30s, 40s, 50s, 60s and even their 70s, and if you criticise the Jihad and praise Israel come down on you collectively like a ton of bricks. PC will be the death of us.
Colin Whiteoak says
If he entered the U.K. illegally he should have been deported immediately, no ifs, no buts and no wherefores. If you have no right of entry, you certainly should have no right to any legal channels which would enable you to remain. You should not receive a penny in legal aid either, for the same reason: you have no legal status in the U.K.
Aardvark says
Absolutely correct, Colin. The West is far too soft on these barbarians. Any illegal immigrant should be thrown out as soon as he/she/it is detected, and the cost of shipping them out should be recovered by annexing their property.

The other day I was speaking with a Muslim man who owns one of the shops near by, you know what he told me? Britain let in so many refugees and asylum seekers and he keep going on and said why they let them in so many Muslim refugees? he said there are so many English and British people need help. He is right he sees the things that the left and British politicians don’t see.
Ryan Muhammad says
The same “human rights lawyers” who are doing everything to defend this terrorist (pious Muslim) are the same “human rights layers” who go after those who speak out against jihad.
The term “human rights” has lost its meaning. No wonder there is apathy, indifference, or willful ignorance of the jihad taking place around the world against Christians and other religious minorities, and against Muslim females. Such real human rights violations are no longer considered to be “human rights”. But the rights of mujahideen to terrorize IS the new definition of “human rights”!

This is so ridiculous I cannot believe it. He is collecting benefits I assume so he must have a social security number and a name to go with it. That is his legal name in UK so use that.
