Boston Marathon jihad murderer appears in court for the first time since 2013

Dzhokhar TsarnaevWhat a bizarre scene. There is no doubt that Dzhokhar Tsarnaev is guilty. He is captured on video at the scene, he took evidence of his involvement back to his college dorm, he wrote about the bombings and his role in them on the side of the boat in which he was hiding. And yet protesters still showed up to defend him. When it comes to Islamic jihad terror, some people cannot and will not shake the propagandistic notion that Muslims are always and ever victims, no matter how many bloodied, lifeless bodies they leave in their wake.

BOSTON (AP) — Boston Marathon bombing suspect Dzhokhar Tsarnaev returned to court Thursday for the first time since he was arraigned in July 2013, and he received a shout of encouragement from the mother-in-law of a man who was shot and killed while being questioned by law enforcement after the bombings.

Security was tight at the federal courthouse in Boston for Tsarnaev’s final pretrial conference. Tensions ran high, and one bombing victim had a testy exchange with protesters outside.

During the brief court hearing, U.S. District Court George O’Toole Jr. made no rulings, saying he would rule in writing on pending motions, including the defense’s latest push to move the trial out of Boston.

David Bruck, one of Tsarnaev’s lawyers, told the judge that the defense plans to file a motion to delay the trial, which is now scheduled to begin on Jan. 5 with jury selection. Bruck did not say how long of a delay the defense will seek.

At one point, the mother-in-law of Ibragim Todashev called out to Tsarnaev in Russian in the courtroom. Elena Teyer said she told him: “We pray for you. Be strong, my son. We know you are innocent.”

Later, in English, she yelled to the law enforcement officers escorting her out of the room: “Stop killing innocent people. Stop killing innocent boys.”

Tsarnaev never flinched or acknowledged the shouts.

Three people were killed and more than 260 were injured when two bombs exploded near the finish line of the April 2013 marathon. Tsarnaev, who has pleaded not guilty to 30 federal charges, faces the possibility of the death penalty if he is convicted.

Tsarnaev, 21, wore a black sweater and gray trousers and had a scruffy beard and a curly hairstyle similar to the one seen in earlier photos. He smiled to his attorneys and one patted him on the arm.

The courtroom was packed with FBI agents, police who worked on the case and more than a dozen survivors and family members.

Outside the courthouse, a man who lost his right leg in the bombings had a testy exchange with a small group of protesters holding signs supporting Tsarnaev and questioning whether authorities have proof that he is responsible for the bombings.

Marc Fucarile held up his prosthetic leg and moved it back and forth toward the demonstrators, saying: “That’s proof right there.”

One of the demonstrators said to Fucarile: “You should care that they get the right guy.”

Fucarile replied: “Get a life, lady. Go to work.”

At his last court appearance 17 months ago, Tsarnaev still bore signs of the bloody standoff with police that led to his capture and the death of his older brother, Tamerlan. His left arm was in a cast, his face was swollen and he appeared to have a jaw injury. In court Thursday, he had no visible injuries.

Tsarnaev’s trial is expected to last several months, and seating a jury alone could take several weeks to a month.

Judge O’Toole questioned Tsarnaev about whether he had waived his right to appear at previous hearings. Tsarnaev answered in a clear voice: “Yes, sir.”

Asked by the judge if he believes his lawyers had acted in his best interests, he said: “Very much.”

Earlier this month, Tsarnaev’s lawyers argued anew that “emotionally charged” media coverage and the widespread impact of the attacks have made it impossible for him to get a fair trial in Massachusetts….

    Once again, I feel compelled to point out that we in the West are different from these other cultures in that we respect the rule of law.

    Now I am no expert on US law (except in that it inherited a lot of from us in the UK) but I would say that the phrase “”There is no doubt that Dzhokhar Tsarnaev is guilty. “” published during his trail would be contempt of court in the UK.

    He may well be guilty and we may think the evidence is overwhelming, but in a country run by the rule of law, that decision is for a court and ultimately a jury of his peers to decide.

      And of course they will.

      That does not stop ordinary citizens as well as pundits from voicing their opinions on the matter, nor should it! And there obviously is no publication ban on the proceedings or we wouldn’t have been able to hear these details.

      Free speech. The right to dissent. The right to voice the majority opinion even if it hurts!

      Of course there are many other examples today and in history where there was a rule of “law” that demanded obedience–such as Sharia. Under Sharia there is no right to speak one’s true opinion if it hurts the feeling of any muslim, or points out the deficiencies (to put it diplomatically) in Islam, Mohammed or Allah.

      Okay I’m going to say he’s guilty. Guilty as sin! There. Yes I have a clear bias in this case. Rendering me unfit to serve on his jury (which I couldn’t anyway as I don’t even live in the U.S.).

      Certainly ”sub judice” prevails in the UK, the Commonwealth, and Israel. It is generally applied to the mainstream media, and refers to publishing biased and inflammatory commentary during a trial; **because it may influence the jury**, and whilst contravening it *may* be cause for a contempt of court action, it is often allowed to pass.

      ”In the United States, there are First Amendment concerns about stifling the right of free speech which prevent such tight restrictions on comments sub judice. However, State Rules of Professional Conduct governing attorneys often place restrictions on the out-of-court statements an attorney may make regarding an ongoing case. Furthermore, there are still protections for criminal defendants, and those convicted in an atmosphere of a media circus have had their convictions overturned for a fairer trial.”

      Robert is writing on an American website, so, given the above, questions of sub judice and contempt of court don’t apply.

        That is fine…USA law should be applied. But it doesn’t alter the fact that these ridiculous calls people have made for mob justice are counter-productive.

        He should have a fair trial………if he is guilty as most of us accept then he will be found guilty.

        To Mirren10 I would say that contempt of court applies to ALL publications in the UK, not just the “mainstream”.

        Whether it is a better system than the USA one……well there are arguments on both sides……..I would rather everyone had a fair trial without media influence……not every trial is a clear cut case like this one maybe is.

        In any case, let justice take its impartial course………believe that the system will give the right result…..that is what matters.

          Any calls for mob justice, Neil Jennison, are indeed, as you stated, and to say the least, counter-productive, though I did not detect mob justice at work here in this case but only certainty and justified ire based on OVERWHELMING evidence.

          Which goes to another matter, and that is the distinction between a court of public opinion and a court of law. Now, I grant you that a court of public opinion can sometimes be wrong (well, for that matter, so can a court of law—–just look at the OJ Simpson case for confirmation here), no doubt about it, but not in this case I would argue. And so one doesn’t want to get too lost in abstract theory to the extent that the court of public opinion is completely dismissed. Yes, by all means, try this young man pursuant to the rules of law here in America, but this shouldn’t mean that a person can’t conclude, based on common sense and evidence, that this young monster is guilty as hell. Hopefully, you’ll get my meaning here.

      I think I asked you this question once before, and I don’t think you replied. (Correct me if I’m wrong).

      Shouldn’t obedience to ”the rule of law” rather depend on the law ? Nazi Germany passed the Nuremburg Laws; and laws against free speech, and criminalising criticism of the National Socialist government. Judges and juries convicted people, and sentenced them to death, under these laws; and as St. Croix has pointed out, Sharia is a ‘rule of law’, and does the same.

      Should decent people obey such laws ?

        That opens a million questions……..is the law always right? No of course not. You quote the laws of Nazi Germany …..an extreme example…..but a fair one. We in the UK are suffering laws that stop us telling the truth about Islam….these laws are evil.

        So yes, laws can be evil. That is why a democracy should not ban opinion and belief ….otherwise it ceases to be a democracy. People voted in the USSR…….but they had no democracy because so many opinions were banned.

        This is where we are heading in the UK……I have no time for racists like the BNP or the National Front. or loonies like the Revolutionary Communist Party or the Socialist Workers Party…….but ban them, or restrict what they say…..and we lose our freedom and democracy.

      Actually the UK has shown up the USA
      The murder of Lee Rigby happened AFTER the Boston bombing and yet the British have already tried and convicted his murderers.

      If Dzhokhar Tsarnaev were innocent his smart ass lawyers and defenders of Islam would not have needed to manipulate the US justice system in obtaining such a lengthy delay.

      Indeed so. Which is why I disagree with the US system of televised trials and I hope we in the UK do not follow that route. It is right and proper for justice to be open…..in that citizens and the press can witness a trial. That it way it can be properly reported and justice can be seen to be done…….but televising of trials makes them theatre…..that is not good for justice.

      We in the UK are flirting with televising trials…………it would not serve justice.

        The same argument was used when it was first mooted that Commons deliberations should be televised. Personally I see nothing wrong with televising trials – not everyone can get to the Old Bailey.

    The most “funny” thing is.
    This guy and his family ran away from tschetschenia and asked ithe USA for Asylum because they were persecuted by “evil” Putin(the only person besides the chinese who knows how to treat radical muslims((being attacked,killed and enslaved all along the russian-muslim southern boarders
    by muslim parasites for more than 1000years made russians fully aware how peacefull the religion of poos really is)

    USA(off course) gave those bludgers asylum,shelter and money.
    And gratefull as muslims are :they said thank you with bombs.

    Now the most interresting part is:
    Just a few days after the bombing te parents moved instantly back to tschetschenia.
    Can you imagine how persecuted this liars really have been?They simply lied to paratasitize in the USA and returned after everything went wrong.

    I say there is something intrinsically wrong when dozens (if not hundreds) of eye-witnesses, including law enforcement personnel, attest to this man’s overwhelming involvement in this crime, and then our court system allows him to plead ‘NOT GUILTY’ and appoints him a lawyer for his defense! THE EVIDENCE IS BEYOND ALL DOUBT — HE’S GUILTY AND NEEDS TO BE EXECUTED WITHOUT FURTHER DELAY!

    We are caught in a trap of our own making and IT’S KILLING US!

      You should live in the former USSR or modern day Zimbabwe to see the paucity of your arguments.

      We in the west have due process………..if (as we all believe it is) the evidence is overwhelming, then he will be convicted.

      That is the rule of law.

      FFS without a court process who decides “the evidence is overwhelming”? The state? Pakistan, Iran, North Korea would love the West to go down that route!

        Neil you have made some interesting points. Whilst in general I would back almost all you have said, there is the fact that at the trial many people were shouting his innocence. It can’t be a one way street. If people are allowed to protest his innocence then surely those convinced of his guilt should be allowed to reply(even if they are outwith the judicial process)

    His lawyers are worried about him getting a fair trial. Did he give his victims a fair treatment? It’s preposterous. When an ordinary citizen is suspected of having killed and goes to court, there are never worries about him getting a fair trial in a state under the rule of law. In this case the evidence is more than overwhelming, it’s obvious he did it. We all saw the videos. But muzzies are pampered in the West. We’re digging our own grave.

    A Christmas Wish : That this piece of barbarian trash will be corn holed and used as a sex slave by the biggest toughest cons that some American Prison has to offer . 2 : That before his execution he will be kidnapped and have legs cut off by some prison gang ; just like him and his brother did to those they maimed and killed at the Boston Marathon . P.S : Be glad it was the CIA at Guantanamo and not me .The danger is that when it comes to punishing these savages I could become more savage than they are !     I myself have doubts about his guilt, so he should have a fair trial, and I do agree with his attorneys that he will not receive a fair trial. All of the emotional responses and media will in fact make it difficult for him to get a fair trial, and have caused a sort of blindness to some things that are being overlooked. I doubt I would join a protest on his behalf, but here are some points no one has questioned:
    1. Video footage of the younger brother show he was carrying a white back-pack, but law enforcement reported the bomb was in a black back-pack.
    2. There was reported another explosion at the library, or the courthouse, I forget) and it was announced on loud speakers there there was a drill, and then this was denied. They said there was no drill, no explosion, and that there was a fire in the library. Many people heard the explosion and the announcement about the drill on the loudspeakers.
    3. The Boston Marathon is used every year as a drill, and it was also being used as a drill in this year, as reported by the Boston Globe. (EMS were tested a device called Safety Pad, which was to handle mass casualties. In the past the Boston Marathon has been used as a drill for the coordination of various local and federal agencies, and it was obvious that something like this was going on at the Boston Marathon.
    4. It was reported that there was a 1 hour gunfight at the boat, and then it turns out he had no gun and was not armed. There are also plenty f photos of him climbing out of the boat, and he clearly has no wound to his neck.
    5. On the older brother’s trip to Russia, he did visit Chechnya, where he attended a CIA conference. One explanation of the lack of follow up on the Russian warning, is they did not respond because they already knew some information about him, because he was being handled by the CIA or FBI as an informant.
    6. Then there is our double amputee, that was taken away in a wheel chair. After having both legs blown off, meaning both femoral arteries are severed, it is not likely a person in this condition would be conscious, let alone sitting up in a wheel chair. They would bleed out in 2 minutes.
    7. Then there is Mr. Cowboy hat, the Hispanic man who was interviewed and shown all over television with his bloody flag. There are many photos, one that has been used over and over again all over facebook, where he is standing leaning on a fence at the sight of the second explosion, and his flag is not bloody. he is the same guy who was seen helping wheel away the double amputee, which is also after the explosion , and in this photo he doesn’t even have the flag with him.

    This is just 7 out of a much bigger list of things I would like to see covered at the trial. We also have the Saudi guy who was mysteriously deported after he was a witness and not a suspect, and I could go on and on with many more things that are highly questionable. But if I were a resident of Boston, or if I had attended the marathon, or possibly been injured, or lost a loved one, I doubt that I would be noticing these things or asking these questions. I would be reacting emotionally, and ignoring facts, just wanting someone to pay for the crimes. I do not think he did it. I think he was a patsy.

      Yes definitely there was a Governmental Conspiratorial Element to this Islamic Terrorist Attack!
      1: Because the U.S. Kalif, just like the Old Canadian Dictator Pierre Elliott Trudeau, instituted Foreign Policy and Emigration Procedures which make such attacks possible.
      2: Because so many Police and Law Enforcement Personnel are White; how could they possibly report the Bag as being white!
      3: All video footage and reports were obviously scrubbed and edited by Men In Black, sorry I should have said white!
      4:The Amputee was obviously an injured refugee from one of many U.S. led bombing campaigns and exploited in a Government cover up .
      5: Mr. Cowboy was not really Hispanic [ how bigoted of you to describe him this way !] but rather a rich Orthodox Jew or Zionist who obviously funded the whole Islamic Terrorist Hoax !
      6:All Islamic Terrorist Sympathizers and Supporters should be deported back to the dictatorships they so greatly admire along with their leftist lackeys.
      7: If you are looking for better L.S.D. to enhance your Left Wing Hallucinations as obviously the shit you get from Harvard and Berkeley isn’t very good! I’d suggest you try the Bikers from The Socialized Republic Of Quebec or The Peoples Republic Of Ontario. If you get really stuck you could try a great Canadian Marxist University like U.B.C. or Macmaster, Perhaps Dr.Fu Manchu or The Great David Suzuki himself will cook it up for you!
