The European Court of Human Rights says France violated the rights of Somali pirates who had attacked French ships and has ordered compensation for them over judicial delays.
The nine Somali pirates should get thousands of euros because they were not immediately brought before a French judge, the court ruled.
One is to get 9,000 euros (£7,000) and the others sums of up to 7,000 euros.
The judges faulted France for keeping them in custody for an extra 48 hours.
The pirates had held French citizens hostage after seizing a French-flagged cruise ship and a French yacht in 2008.
The French military captured the pirates on the Somali coast in two operations, after the hostages had been released for ransoms of $2.1m (£1.3m) and $2m.
Indian Ocean shipping has been plagued by pirate gangs operating off Somalia in recent years, but international naval action in the region has sharply reduced the attacks.
Days in custodyBefore transferring the pirates to France, the authorities held one group for four days and the others for six days and 16 hours.
But the extra 48 hours of custody on French soil violated the pirates’ right to liberty and security under the European Convention on Human Rights, the court ruled.
The convention’s Article 5.3 “was not designed to give the authorities the opportunity to intensify their investigations for the purpose of bringing formal charges against the suspects”, a court statement said.
The judges argued that the time between their arrest and transfer to France was already enough for France to draw up charges, instead of delaying for another 48 hours.

So, if I understand this right, first they get $4.1million ransom and then the European Court of Human Rights wants to throw between €9,000 – €7,000 to each of them because after they held people hostage, they were held for an “extra” 48 hours in the process of capture, I am now so confused.
They can hold people against their will, under constant fear of imminent death for an indefinite period of time, until they receive their $4.1 million BUT when they get arrested and are held for a few hours “too much” they can sue AND win and are awarded between €9,000 and €7,000……….

No kidding. If this indeed was a hostage-rescue mission, and they had already paid ransom, then the French already did the pirates a huge favor in not killing them on sight.
Also, I assume that kidnapping charges were still filed (although late). Is there any punishment at all under the European law for taking hostages? If so, then I suppose that punishment would offset the fine paid for a 48-hour delay in justice.

I agree with you, Wellington, but I’d much rather have a responsive political process in place than having a grand leader. Robert Spencer announced a tongue-in-cheek campaign to become President, but in fact Robert’s place is supplying the facts to fuel the anti-Jihad movements.
I think the government crafted in the original constitution was much closer to a responsive government to the one we have now. In the first place, all forms of gerrymandering, including racial quotas, absolutely corrupt the political process by allowing the politicians to mold their own constituencies. The Republicans (I’m from Texas) are as bad or worse on this as anyone. Politics is the art of negotiation between diverse constituencies, not proportional representation.
In the second place, the original constitution balanced the popular vote (the wealthy class is as prone as socialists to give themselves subsidies and bend the system to their unfair advantage), against the interests of states as bodies and property owners. This allowed a true negotiation among diverse interests.
In the third place, the limitations on campaign contributions requires that any viable candidate spend full-time on raising campaign funds, rather than reading or extensively debating issues. I’m not concerned that a candidate not know about Islam, but I’m terribly concerned that once a candidate announces, there will literally be no time to learn anything about it.
The subversion of the entire political process insures that it is unwieldy and unresponsive to obvious dangers such as the threat of Muslim immigration. It also allows a non-entity such as Obama to rise fast and gain the Presidency, with almost no critical focus on his actual thinking, background, philosophy, and origins.

The Dutch are equally insane. A bunch of Somali pirates were tried and convicted in our courts. After sentencing negotiations were started. Those Somali´s who wished to return home were set free after serving one third of their time. The others would be allowed to apply for asylum upon release. Half of them stayed, . There has been no follow up in the news on this insanity. Perhaps because it was deemed unwise to inform the Dutch .After all , they might not be inclined to foot the bill for keeping these criminals in the country.

Okay, pay the pirates and order the people they held hostage to sue the pirates for restitution. Since the pirates now have assets in France, France gains jurisdiction for the suit. Former hostages get recompense and pirates get nothing.
