The hudud bill to be tabled by Parti Islam Se-Malaysia (PAS) before the Kelantan State Assembly prescribes the death penalty for the offence of apostasy, the Malay Mail Online reports today.
The Syariah Criminal Code II 1993 classifies “intidah” and “riddah” as voluntary or deliberate pronouncements or utterances of words that violate a Muslim’s creed, known has aqidah.
These involve challenges to fundamental aspects of the Islamic faith of every Muslim, including Rukun Islam (Pillars of Islam), Rukun Iman (Pillars of Faith) and the distinction between halal and haram.
According to the report, the enactment does not define what would constitute a violation of Rukun Islam or Rukun Iman.
Under the proposed legislation, the immediate punishment for such an offence is imprisonment over a period to be determined by the Syariah Court “for the purpose of repentance.”
However, chillingly it goes on to say that if the offender fails to repent, the punishment may extend to execution.
“Provided that when he repents whether the repentance is done before the death sentence is pronounced or after such pronouncement is carried out, he shall be free of the hudud sentence and his forfeited property shall be returned to him,” the enactment says, as quoted by the report.
A senior lawyer consulted by FMT suggests that the provisions were also against basic legal principles and also opens up the grave possibility of arbitrary exercises of the power by state authorities.
“Firstly, what constitutes a violation of Rukun Islam and Rukun Iman appears not to be properly defined, leaving them open to interpretation,” he suggests.
“Secondly, the fact that the purpose of the punishment – even to the point of execution – is to secure repentance throws open the possibility of a citizen being coerced involuntarily into remaining in the faith,” he adds.
“It is a trite principle of law that admissions and confessions must be voluntarily given – they cannot be extracted by inducement, threat or promise.”
“Thirdly, and most importantly, it is a clear violation of the fundamental constitutional right of freedom of religion.”
The proposed introduction of the enactment by the PAS-led Kelantan State Government has brought two Pakatan Rakyat coalition parties into direct conflict with each other, with the Democratic Action Party (DAP) insisting that the implementation of hudud law was impractical in a multi-racial and multi-religious country and was against the Common Policy Framework agreed upon by the coalition….

Canada isnt perfect, but in my country, any member of parliament who tried to table a bill like that, would be dropped from his Party like a hot potatoe, probably be forced to resign, and could kiss any remaining aspiring career in politics goodbye. … it is islamic. Not only that, it tries to be more islamic as time passes.
pas (the political party) always wanted to lead kalantan (and eventually malaysia) towards the most authentic islamic society – with sharia (including hudud), rags covered women and ultimately, the whole nine yards.
The problem here has been compounded by the fact that non-islamic political parties (like DAP) has joined the main opposition coalition which pas is part of. These fools associate themselves with pas believing that replacing the existing order (lead by bn – national front) would result in a better future for all (realistically non-islamic) malaysian. Unfortunately, pas and pkr (anwar ibrahim’s) party will be the main benefactor of any federal electoral victory. As for the non-islamic population, they will be left with scraps (as it is now with bn government), but also quite likely with more islamic restrictions forced upon them – like wider coverage of sharia to include non-believers (as is the case in brunei).
Electorally, the choice for non-islamic malaysians is essentially down to two great evils, bn or pas/pkr government. Different sides of the same islamic coin.

Good move, a justifiable and understandable move, by the Kelantan State Assembly over in Malaysia. It’s the law. The law’s the law. Ignorance of the law is no excuse in a court of law. Sharia is the law, the sacred texts of the Holy Ko-Ran, that’s the real law, and it must be made the official law there. Gutsy.
These legislators know that their nation has drifted from its law, its core principles. They are also probably aghast at the spectacle here in the United States, with things breaking down because it has moved so far from its law, the Constitution. Time to make it real, to make things right. There, I mean, not here, where a return to the law is not even under active consideration.

Yes, the Hudud thing is coming in our way. Treatment for non Muslims here is getting worst. The police here are more interested in serving the fucked up government than anything to do with policing.
I feel like getting out of this stinking country, to Europe or the Americas……BUT what the hell, even there the Islamist are getting larger and intolerant and for sure I would face the same thing all over again, where do you run to then ???
