New York: Muslim suing Costco for religious discrimination

Note the paradox: he is claiming that he was subjected to religious discrimination, when what really happened was that he was prevented from discriminating against non-Muslim customers by refusing to act as cashier for those with pork and alcohol.

NEW YORK (WABC) — A man is suing Costco for religious discrimination.

He tells Eyewitness News exclusively that when he refused to work with pork, the major retailer sent him outside to gather carts.

“Just because you have a different belief, that doesn’t give anybody the right to treat you different,” said Jean Camara, suing Costco.

That’s why Jean Camara says he’s doing what he’s doing, suing Costco for religious employment discrimination.

The devout Muslim says he was working as a cashier’s assistant at the Costco in Sunset Park Brooklyn in September of 2012 when pork came across the conveyor belt.

It’s against his religious beliefs to touch either pork or alcohol.

Camara says after telling his managers this, they transferred him outside collecting the shopping carts.

Camara says they never told him why he was reassigned.

“I think that as the case progresses in the trial we are in now, I think the facts are going to come out and they’re going to speak for themselves,” said Chauncey Henry, Camara’s attorney.

Camara says he asked his managers if he could work in the electronics department, but his requests were repeatedly denied.

He ended up filing a human rights complaint against the company.

16 days later, he was fired for insubordinate conduct.

“We all share different beliefs so we all should be treated equally no matter what belief we have,” Camara said.

“It’s not OK to discriminate against someone for their religion. It isn’t OK. It isn’t OK to treat them differently others because of what they believe in. I think that everyone is entitled to the same treatment. I think that’s what this case is about,” Henry said.

      Right. When you go to work for a company, you don’t expect them to let you choose what department you’ll work in. And if you have special restrictions because of your religion or disabilities, it’s the *company* that has fewer restrictions on where to use you.

      Was there a spot open in the electronics department? If so, had there been a request by another employee ahead of his for that spot? Was this guy as knowledgeable about the products in the department as another of his fellow employees who was better suited to that job?

      When you go to work for a retail store, they put you on the job that needs doing. Your job is to do the job that needs doing, not to demand that they put you in the job you want to do. And to use your religion as a bludgeon to make them bend to your will.

    Surely it isn’t surprising that, on one estimate, 80% of Muslims living in the West are unemployed and on benefits? In the private sector, you have to make a profit, or go broke. So who would be so stupid as to give one of these serial whinging troublemakers a job, so they can then spend their working days looking for something to be offended by, rather than actually doing what they were being paid to do in the first place? No doubt if this vile creature was given a job in electronics, as he was demanding, he would then be claiming to be offended by some of the programmes playing on the in-store televisions.

    Oh, the hypocrisy. It’s muslims who are constantly demanding preferential treatment because of their religion. No jell-o in school lunches, special prayer breaks where non-muslims are expected to pick up the slack for them, foot-baths in airports, etc.

    The brashness is staggering – the mohammedan asked to be moved to the electronics department. Would he have filled the suit if he was working at that department? And why is he claiming “religious discrimination”? Is the management required to cave in to all his demands? He couldn’t work as a cashier’s assistant because of pork and alcohol (a position that isn’t exactly heavy on prerequisites), so the management found another position for him. It’s up to the management to check an employee’s qualifications and decide whether they’re fit to a position or not.

    They should have fired the bastard as soon as he refused to touch pork and alcohol and sued his ass for applying to a position when he knew beforehand he couldn’t do it.

    How many cases where Jews who won’t touch pork sue their employers for finding another position for them?

      You write “it’s up to the management to check a potential employees qualifications and decide whether they’re fit”, but how much you wanna bet that it’s illegal or “discriminatory” to ask someone if they’re willing to handle pork, if you simply assume they are Muslim, or worse, if you’re brazen enough to ask if they’re Muslim outright?

      In fact, it is the plaintiff who is being religiously discriminatory by refusing to handle the purchases of many non-Muslims.

      I hope his lawyer is expensive.

    The answer of course is money. Lots and lots of money, and probably sympathy for the Islamist supremacist movement.

    Jews don’t eart pork either but I have never heard of one suing because they want to change their job description. If you take a job working on a cash register then you have to put every item through. Do we now have no pork or alcohol registers just to suit them?
    What’s next? No uncovered women through this registers because it offends the muslims? How far are we going to bend for these parasites?
    What did the Muslims do twenty years ago? Did they not work in the same supermarkets selling the same products? How come they didn’t sue anyone then?

      Good point, Peggy. A Jewish person would either do the job or look for a new one. You don’t have vegetarians—I am one—or teetotalers and people in AA suing, either. This is purely a Muslim “grievance”, and is more about pushing Shari’ah compliance than anything else.

    An employer cannot force an employee to perform duties the employee considers immoral…( Not sure but I think it’s in the ‘Brown Act’) and the employer does not get to decide moral values for the employee.
    In this case Cosco created a remedy by reassignment. I don’t think this guy has a case just because the remedy doesn’t suit him.

    For quite some time we have heard “diversity is our greatest strength” – there is nothing great about the nonsense we now see on a daily basis. Is the guy really handling pork or alchohol? Isn’t this stuff packaged up? I don’t see how there would be a conflict with his religion. He is not being asked to directly handle pork or consume alchohol.

    How is it that you apply for a job knowing what the requirments are and then expect a place to be made for you based on your religion? He wants electronics well The Jewish person wants books and the Christian person wants shoes. We can’t tell our employers which department we want to work in. He said he refused to handle pork or alcohol, the department that they had is collecting carts. I am sure that senority gets off the registers and carts.
    How did we get here as a country that people sue when they are offended, claim racism when someone doesn’t agree and sue because they don’t like a position they were put in based on their request to be moved? Crazy, the world has gone mad.

    Islamic lawfare is exactly what one can expect when hiring Muslims in jobs where they might have to be responsible for dealing with a) pork, b) alcohol, c) not being allowed to wear a niqab or burqa for safety reasons, d) any sort of uniform. They will fight you legally in order to put their big toe in the door to let the Sharia in. Then when you hire a Muslim, he or she must be allowed to pray five times a day. Is it any wonder why the people of this culture have done nothing positive for the world since Mohammad began his killing spree?

    As with all religious discrimination/accommodation claims I would insist that any remedy itself be neutral. That is, no legislative or judicial remedy is exempt merely because it can be called a remedy.

    As usual he wants special exception for himself while using his religion as a shield. I have seen many muslims in store having to handle all kinds of meat products. In fact most jobs in these stores requires you to handle pork or alcohol items, whether you are a cashier, or in stocking, or in unloading, He wants a special exception to bump off a person in electronics who had more experience or seniority in favor of himself.
    If this guy wins then they lets give all the other religious minorities special exemptions, Jews, Hindus, Mormons, food allergies people, those who were former alcoholics and so on.

    I have never seen raw pork sold at a Costco. It is always in packaging. If the man touches shopping carts, walks around the building or even drives around town he is touching, breathing and coming in contact with microscopic quantities of pork compounds. This is unavoidable. Living requires that he come in contact with ‘pork’ and therefore there is no reason for him to avoid the packages since he is already exposed.

    A cashier’s assistant….translation means: sacker or bagger. That is the employee that *assists* the cashier. It is common practice to send sackers or baggers out to bring in the carts when said carts are left all over the parking lot or put in the cart stalls.

    It is common practice to use the sacker or bagger in this job or to take back to the shelves items that are brought to the checkout but not purchased by the customers. One who is hired as a bagger or sacker…or if he wants to feel better than other sackers or baggers…a cashier’s assistant…is used in many jobs around a grocery store. Cleaning toilets, break rooms, and the awful menial job of collecting carts are some of the duties of a sacker.

    The store should bring in other employees who were hired to sack groceries and ask them in court just what their duties were. Ask them if they were allowed to choose just what jobs they performed and in which department.

    He took a job at Costco knowing he’d have to touch the plastic that surrounds pork, which isn’t touching pork. Then, he refuses to do his job. Costco is nice enough to reassign him, but not to a dept. he wanted. He didn’t do what they wanted. They didn’t do what he wanted. It sounds to me that this was a perfectly appropriate reassignment. Hey, Costco, you hear that. Don’t settle with this stealth Jihad coward who obviously took this job in order to sue you. I hope he wastes tens of thousands of dollars and loses, God-willing. And, get out of America, damn it.

    DARURA cancels the need for these endless demands. As long as an employer says ‘no’ to Muslims demands, they will apply ‘DARURA’, the law of relaxing the rules so Muslims can get what they want and need to survive.

    If we don’t remind Muslims of DARURA at every opportunity, they will continue to demand 1) the right to discriminate themselves against ‘others’ and women, 2) the right to never hear criticism of Islam, 3) the right to circumvent rules that apply to all employs, 4) the right to impose Sharia law on non-Muslims.

      The west should expect more abuse by Muslims, like in this case. No one, living in the west, should be surprised by any similar act or even more aggressive ones by Muslims, which are on the way very soon in a place near you!

      This is what one gets in a society where its leaders and large masses of its population sprint, without second thought, to kiss a*s of its never satisfied enemy, especially the more aggressive he gets, while despise and look with contempt on many of its own!

        When you tell an employer you won’t do something you were hired to do AFTER you were hired for that job, you have no right to complain when you don’t like what comes across your belt.So go get a job where you don’t have to work with pork you idiot. Suing the company isn;t going to do anything but make enemies. aBut maybe that what his goal is anyway.

          It’s like if I get a job at a bookstore that I know sells risque, sexy books and magazines, or books on religions or philosophies I don’t agree with, then I refuse to handle such publications at the cash register. Then, when I’m assigned to a job cleaning the store of some such, I whine and complain that I’m being discriminated against for my religion,and I sue the store.

          It’s nonsensical garbage. He should have checked the requirements of the job first, and then if they were incompatible with his religious beliefs, he shouldn’t have accepted the job. That store has the right to sell pork and alcohol, and bus and taxi companies have the right to insist that their drivers accept blind people who have guide dogs, or unveiled or unscarved women, or people who are carrying beer or pork products in shopping bags, or even people who are wearing Christian crosses, Jewish yarmulkes or Hindu vindis. If you cannot handle it, then look for another job, or better yet, take your whining butt out of the country.

          I’ve read that a major reason why ethnic, non-Muslim Chinese in France (especially in the Chinatown in Paris) tend not to hire many Muslims is because the latter are generally seen as “too complaining”, and unwilling to work very hard, or adjust prayer times so that they don’t inconvenience the employers.

      Exactly! It’s so idiotic that he says he doesn’t know why they reassigned him! Hello if he refuses to do his job as a cashier because of his religion then he can go do something else like gather shopping carts. He expected them to cater to him and that’s not how it works here in America. You get paid to do the job they assign to you if you don’t then they assign you another job to do, it’s simple! He’s playing the Islamophobia card!

          It’s not inbreeding or genetic inheritance that causes this kind of low IQ. It’s Islam’system of beliefs and doctrines that are the culprit.

          Proof: Many westerners who are whites, blacks and mixed develop the same mind set and violent behavior upon converting to Islam. Some of them, at least seemed to be very intelligent. Take Cat Stevens who was mixed, with a Swedish mother and Greek father who had converted to Islam.

          On the other hand you have many, once isolated groups of indigenous people, all over the world who in the past inbred among themselves for generations, yet you won’t see in them the same mind set, belief system, readiness for extreme violence to spread then impose their religious beliefs and wage Jihad on others.

          Indigenous people such as: Many groups and tribes living in the Amazon jungles, Peru; Innuits in Canada; Eskimos in Greenland and other extreme northern parts; Sami people in northern Norway; Nomad people of Siberia; Many indigenous tribes in central and western Africa; indigenous people of Australia, New Zealand and Tasmania;……etc.

          And it’s not just the ideology of Islamic supremacism that leads to Camara’s kind of demands. The West’s ideology of multiculturalism encourages guys like Camara to try to get all he can from anyone who dares to not kowtow to his preferences.

          When you have an ideology that goes beyond defending each person’s legitimate rights under the law, and starts to demand that the law force people to ditch their own preferences and business plans and policies to whatever religious idiosyncrasies a given person or group holds, then you can expect some members of that group to take advantage of that trend in the law and public opinion.

          Camara’s gambit tests the resolve and self-respect of kafir society, and we’ve invited him to do so. Why should he not give it a go?

      Employers will have to spell it out in the job interview with the help of a top lawyer. For instance, ask the candidate, ‘Is there any reason you cannot handle pork or alcohol because that is what we sell?’

      If they say ‘no’, they are not eligible for the job. They have to find another job where there is no pork, like working in a stone quarry in Pakistan.

        I check the names. If I receive a CV from anyone with an islamic name, it goes directly into file 13 (i.e. the waste bin). There’s no shortage of job applicants, and avoiding the ones who will probably cause trouble is only common sense.

    Perhaps they should move him to the books and magazines department and he can refuse to sell anything that isn’t Islamic theology and protest anything Muslims would find offensive (such as children’s books with pig characters).

    Or maybe they can move him to the women’s clothing department and he can refuse to sell anything other than bedsheets.

    Or maybe they can move him to the arts and crafts department and he can refuse to work with any art which depicts animals because that leads to idolatry.

    Or maybe they can move him to the music department and he can refuse to sell any music which is not praises to Allah, since secular music and musical instruments are forbidden by Islam.

    Or maybe they can move him to the photography department and he can refuse to work with images of people because Mohammed did not allow images of persons.

    Or maybe they can move him to the toy department where he can refuse to sell the dolls because they have faces and good Muslims don’t allow faces on their dolls.

    Or maybe they can move him to the pets department where he can refuse to work with dogs because Islam views them as unclean.

    Or maybe they could move him to the seasonal aisle and he could refuse to handle the Christmas, Mardi Gras, St. Valentines Day’s, St. Patrick’s Day, Easter, or Halloween decorations.

    What the heck, send him outside to bring in the shopping carts. How could he object to that?!

    I’m a religious Jew. I had SUCH a hard time when I entered a nursing home to do my internship and encountered the smell of bacon. I had never before seen bacon, smelled bacon, and I found the smell revolting. In the morning, the whole nursing home smelled of it and my stomach would turn, and I dreaded coming because I couldn’t stand it. And then I had to sometimes feed it to patients, and I didn’t know what to do with myself!!!! I didn’t want to touch it, as it not kosher, and i didn’t want to by mistake touch it, and then maybe i would by mistake lick my fingers…? I would wear gloves, and feed the patients, feeling so gross. Eventually, I got used to it (took a few months!!) and I ended up returning the nursing home to work there- and it didn’t bother me (I think they got a new cook!).

    I never thought to complain about it!!!!!!! This was my job, this was my role, this was what I had chosen to do.
    We live in a beautiful country of religious tolerance, freedoms and liberty. That DOES NOT mean that we can demand of others to change the environment around us to conform to our religious beliefs. If you can’t handle it, get a different job, put on gloves, suffer working with the shopping carts. It’s a small sacrifice to pay for upholding ur religious beliefs. But don’t take advantage of this countries religious tolerance to make demands of others.

I love the Lord God of Israel, but by gosh, bacon is delicious. I understand your respect for the Commandment, but I’m not Jewish. I’m glad my church allows bacon!

      He was not asked to handle bacon as you were. The pork was wrapped in plastic as all meat is sold that way. Therefore there was no way he had to touch except to push it along the conveyor. He is just doing the usual Muslim thing of making a big issue out of it. Obviously if t you work on a cash register you cannot choose what items come along it.

      I am also a Jew, although not observant. I also never eat pork products, or shell fish 9 or any fish, for that matter).

      About 30 or so years ago, i was living in a rural area of a southern state, and got a job as an assistant manager of a restaurant.

      TWO OF THEIR MAIN DISHES ( depending upon the meal, and time of day) were bacon and ham and pork chops; and fish products of different types.

      I never ate any of them. However, when I had to cook, or serve or whatever, i did so.

      I was never (I worked there about 8 or 9 months then moved out of state) why i did not eat bacon, etc.

      When I was in the army, I merely said I was allergic to pork products, never questioned.

      This creep just wants to extort money.

      And, after all, this IS NEW YORK WITH CUOMO AS GOVERNOR AND DE BLASSIO AS MAYOR- THE MAYOR WHO COMPLAINS ABOUT COPS NOT RESPECTING HIM, BUT CONSIDERS SHARPTON A FRIEND.

      Cosco is one of the MOST LIBERAL (politically) large firms in America.

      Probably the last firm that would discriminate.

    it would be easy enough to just not hire muslims. But the problem is, thanks to PC liberals, after each interview you need to detail exactly why you did not hire them and have it reviewed by head of HR. I suppose you could find a reason but it often ends in lawsuits for muslims not getting hired, like that stupid muslim who sued Abercrombie and Fitch.

    If that’s the case why didn’t the Personnel Department just ask him what job he’d like,
    what hours does he want to work
    how much salary would he like,
    would he like to be picked up and dropped off to work,
    would he like somebody to wipe his ass….the list is endless.

    As a Contracts Manager here in the UK, the first thing I ask when negotiating with anyone is have they read AND understood all paragraph’s of their Contract of Employment?

    If they confirm this, I get them to sign the said Contract, then, they have no comeback at a later date.

    This buffoon is clearly trying it on, he was offered another position within the company, he has broken the Contract in my opinion so eventually termination of contract is on the cards for refusing to carry out his job.

    I US needs to handle lawsuits like they do in the UK. The loosing party has to pay the court costs and the legal fees for the entity they sued.

    Employers are going to have to have signed agreement with employees spelling out what they will be expected to do. If they have a religious exceptions to please make them known up from.

    If you listen to what the complainant is saying, one might wonder whether or not he was an EMPLOYEE.
    The management has the right to put him pretty much wherever they want, as long as it isn’t something so derogatory that it can be seen as punitive. If he didn’t want to work with pork and alcohol and they transferred him to stocking shelves, that would have been very much their right to do so as well. Now, if they fired him when he first gave his objection, that of course, would be different.
    ANOTHER nuisance lawsuit.
    Should we be surprised?

    Business in America need to stop bowing down to muslims! They are suing business owners who refuse to give in to their demands. And lawsuits against police. For example: A female muslim was arrested (it didn’t state what for) and when they asked her remove her head and face covering for her mug shot, she refused. She is suing the police department! They are a lawsuit crazy bunch. Do not hire them unless you tell them first that you will not be making special concessions to them!

    It strikes me as ungrateful of the plaintiff to sue a company that tried to accommodate his (stupid) religious beliefs by giving him a new position (at the same rate of pay I imagine) as opposed to simply terminating him for refusing to complete the job as specified in his employment contract.

    I got in trouble off a Muslim store manager when I was also a manager at McDonald’s many years ago for refusing to allow the Muslim staff to take time off to eat during ramadan – right in the middle of the busiest period of the day. My defence was, and still is, that it is their choice to come to work and if they cannot perform what is required of them then they shouldn’t be working. It was discriminatory towards the other staff members who had to pick up the slack.

    Could a Christian say he doesn’t want to touch the gossip magazine? Of course not, if he felt that way he should look for another job. Also, I don’t believe it is unlawful in Islam to touch alcohol I’m not even positive that there is a total ban on drinking it. Either way, if your religious views are that strong you should not work at a place that sells pork. A company cannot run this way. It is not discrimination he doesn’t get to pick his next favorite position. The company decides where he is needed. They can’t give in to this and every person of conscience should be writing letters of support to Costco.

    Islam identifies what is deemed unclean (dogs, pork, spirits, infidels, etc.) for the Moslem. They are all equally vile and there is not a pecking order per say that prompts the faithful to avoid one with more vigor than the other. You can choose to fixate on what you think is within your power to control and ignore or be oblivious about the infidel detritus, dog hair and dander that settles on the clothes and lodges in the lungs and mucous membranes that is a consequence of human interaction in a public space. Ablution rituals before prayer will not address the cross contamination and DNA sampling of any prayer rug in any mosque in America will bear this out. They defile their hokey places because the perimeters for cleanliness are unachievable. Moslems constantly demand the unachievable because this is their lot in life and they want all of us to share in the misery that is Islam.

      The article says they did fire him for insubordination. If he doesn’t want to work around pork then don’t work in a grocery store! He chose to work in a place where pork is present. His real agenda? That pork will be banned as offensive to Muslims? Or that when the world doesn’t revolve a Muslim’s belief system, the world needs to change-not the Muslim. Costco should counter sue for the cost of going to court.

    Did he state these facts when he applied for the job? NO, because he would not have been a cashier. That is falsification of a application. Grounds for termination. You don’t apply for a job and get hired THEN tell your employer “I CAN’T DO IT”. He is lucky they gave him a 2nd chance.

    when you go to work in a GROCERY store in AMERICA one should know they will be working with MEAT products — if your religion does not allow you to be around said products DON’T TAKE THE JOB — don’t start trying to CHANGE THINGS because of your religion —- adapt…….simple — if you can’t work around pork don’t work in the grocery — FUNDAMENTAL CHANGE TO AMERICA – THIS is how it starts.

My religion requires me to wear slippers and pajamas all day. My religion requires me to consume several beers a day. Oh, and my religion requires regular raises and bonuses.

    So, I’m ready to join the workforce. I hope no one discriminates against me!
