Obama Admin Moves to Block Restitution for U.S. Terror Victims

The Obama administration has intervened in a landmark legal case brought by the American victims of Palestinian terrorists, urging the court to limit restitution for the victims out of fear that a sizable payout could collapse the Palestinian government, according to a copy of the court filing.

Deputy Secretary of State Tony Blinken argued in a filing to a New York City court that a hefty payout to the victims of Palestinian terror crimes could burden the Palestinian Authority (PA) and interfere in Obama administration efforts to foster peace in the region.

The victims are entitled to as much as $655 million from the PA following the conclusion of a decade-long lawsuit that exposed the Palestinian government’s role in supporting and paying for terror attacks in Israel.

The administration’s intervention in the case has drawn criticism from U.S. lawmakers and some of those affected by the decision.

While the administration supports the right of terror victims to sue in U.S. courts, it remains particularly concerned about the PA’s solvency.

“The United States respectfully urges the Court to carefully consider the impact of its decision on the continued viability of the PA in light of the evidence about its financial situation,” Blinken writes in his “statement of interest.” “An event that deprives the PA of a significant portion of its revenues would likely severely compromise the PA’s ability to operate as a governmental authority.”

Blinken goes on to warn that the case could impact U.S. security interests and its role in the Israeli-Palestinian peace process.

“A PA insolvency and collapse would harm current and future U.S.-led efforts to achieve a two-state solution to the Israeli-Palestinian conflict,” Blinken writes.

Representatives to the PA had been lobbying the Justice and State Departments to get involved in the case for some time. The PA maintains that it does not have enough funds to pay a bond requirement and has petitioned the judge in the case to drop it.

However, a lawyer representing the victims argues that if the Palestinian government can continue paying terrorists currently imprisoned in Israeli jails, it can pay the victims of these terror acts.

“We are gratified that the Department of Justice supports the rights of survivors of international terrorism to enforce their rights and collect the judgment, but disappointed that the State Department failed to take any stand against the PLO and PA’s policy of putting convicted terrorists on their payroll as soon as they are jailed,” lawyer Kent Yalowitz was quoted as saying in a statement. “If the PA has enough money to pay convicted terrorists, it has enough to pay the judgment in this case.”

Ron Gould, a plaintiff in the case, told the Washington Free Beacon in an interview that there was no reason for the Obama administration to intervene.

“There was really no reason for them to even get involved,” said Gould, whose daughter Shayna was shot in the chest and nearly killed by Palestinian terrorists. “For the Obama administration to stick their fingers where they don’t belong is unconscionable.”

The PA “still seems to have the money to pay the families of the terrorists on an ongoing basis,” Gould said. “They do have the money to pay the piper for losing the court case.”…

Indeed.

    Robert loved the first line….comment, “Whatever else Barack Obama may be, he is always consistent.
    Always on the side of Islamic Supremacists, against Israel, and against effective counter terror effort.”.
    Since he is standing by Islamic Supremacists, whose ultimate goal is Sharia law, is always denying any association of jihad as a religious command of Islam, thinks Israel has no apparent reason that he can understand nor wants any effective counter terror efforts that would bring concern to sharia compliant muslims…just supporting sharia should be considered treason. So in effect he is saying there are no victims, unless of course they go to mosque.

    Sue the pants off the Pallies for their terrorism! Keep the lawsuits coming. Then sue the Saudis for promoting jihadism around the world. Then sue the Iranians.

    Sue all Islamic governments that have aided or allowed terrorist organizations. Civil lawsuits may actually force governments to stop the terrorism.

    Obama has his priorities wrong. His FIRST JOB is to PROTECT AMERICAN citizens and their interests!

      To mortimer- I love your 4:29 pm Aug 13, 2015 post. It makes so much sense and is a great way to combat terrorism. But the Saudis and the Iranians have loads of money. And God forbid they should actually want to help the Palestinians living in refugee camps by designing and building apartment buildings for them.

      This is a very good point. Why has the bin Laden family never been sued? Why have our dear friends the Saudis never been taken to task over the hate they promote in their schools, and export around the world? Talk about incitement to religious tolerance and violence -they practically invented it. Could it have inspired thousands of murders around the world? Yes.

      As for Mr, Obama, well, his heart is always with the other guy. At this point it’s just an involuntary reflex.

    In other words, its continued ability to put terrorists on the payroll.

    2016 cannot come soon enough for me. It would be difficult to imagine *any* American president, of whatever caliber, to exhibit such naked support for Jihad, and such open contempt for its victims.

    So many of my good American friends keep telling me how ashamed and embarrassed they are to have Obama as President. They are literally counting the days until he is gone. But the very thought that Michelle may be even considering one day going into politics positively terrifies them

        Unfortunately, those who in the last presidential election and the one before, who couldn’t have helped but do better than the current crop, were slandered and kicked out of the public square… Hopefully, there are some good ones laying low, waiting until the possibility of running is still there, but the time for them to be falsely attacked and maliciously destroyed is shorter. Hopefully.

    The “palestinians” barely have any money of their own anyway. they exist on handouts from mainly USA and EU. So any compensation would end up coming out of the pockets of those nations’ tax payers

    This seems to be the way for the muslim leader. He can’t stand for anything to happen to is muslim friends. I’m extremely disappointed with our government it makes me sick. I believe the only way to get a loyal congress is to vote out of the ones we have now. Trump may not have the sick political manners but you can bet he will get the job gone. He is the only one that has experience in running a very large company.

    A few years ago, Rasool Obama and H Clinton, ‘gave’ Abbas (Abu Mazen the terrorist), $193,000,000 to ‘help him with his ‘budget shortfall’, Hillary’s words…More recently John Kerry wanted to give the PA 200, mill plus. I don’t know if that happened or not…But it does show that the US want’s to keep him solvent.
    using tax payers money to do it, knowing full well that some of it will go to support jihad and terrorism…
    That makes every American taxpayer fund terrorism, like it or not. There is nothing in the US Constitution that supports the redistribution of wealth from us (taxpayers) to foreigners.(leaches)..

    The PA is like a young child. They have been supported and funded by other nations since their formation, and keep relying on being bailed out if they can’t manage their finances. Their government is full of corrupt leaders who pocket millions of dollars for themselves.

    I say to the PA- you can’t encourage terrorism, name streets, camps, schools, and town squares after terrorists, and then whine when your being held accountable for your actions. You can, however, make a commitments to CHANGE.

    GROW UP.

      Great point…. It’s tough to grow up though, and why bother, when you have the “Great Enabler” going in and ‘respectfully’ begging the court on your behalf? Similar to a parent ignoring or explaining away its’ grown child’s rotten behavior.

    The anti-American, anti-Israel, Islam adoring Obama administration intervened in a landmark legal case brought by the American victims of Palestinian terrorists, urging the court to limit restitution for the victims.

    Of course the Obama regime don’t want their top favorites – Muslim terrorists, to be be punished. They much prefer Muslim terrorists are REWARDED.

    If the Palestinian Authority is short on cash, it should ask for financial assistance from Suha Arafat. The billionaire widow of PLO leader Yasser Arafat resides in Paris and lives off the fortune her husband skimmed off the top of aid payments from the United States and the United Nations and a pension from the Palestinian Authority of about $17 million per year.
