Pakistan: Lawyer for blasphemy accused says government skirting law in her case

Asia BibiNote what he says about how angry devout Muslims are at him for taking the case. They don’t care if Asia Bibi is innocent or guilty; for them, the accusation itself is proof of her guilt, and the dirty kaffir must be put to death.

“Asia Bibi’s lawyer speaks out: Pakistani government is solely responsible for situation,” Asia News, August 3, 2015:

Lahore (AsiaNews) – “Many legal requirements have been ignored in the case of Asia Bibi, the only woman to be sentenced to death for blasphemy in Pakistan. The authorities must put aside religious sentiments and verify the facts, first. However, they are subject to the influence of religious fundamentalists and do not stop the militants from attacking those accused of insulting the Prophet Muhammad, or setting fire to their homes“, says Saiful Malook, Asia Bibi’s lawyer, speaking exclusively to AsiaNews.

The Supreme Court lawyer , a Muslim, took over the case last October, after the Lahore High Court rejected Asia Bibi’s appeal against the sentence passed by a lower court. Pope Francis blessed the family of the woman, who is in prison since 2010 after being accused of blasphemy. Worldwide, associations and Christian groups breathed a sigh of relief when the Supreme Court blocked the execution and ordered a retrial in late July.

On that day, Saiful Malook had to remain in court for two hours to avoid any possible backlash. The Muslim lawyer has been very cautious since he took over the case on behalf of Salmaan Taseer, the Punjab Governor assassinated by his bodyguard for asking pardon for Asia Bibi.

“I have asked reporters – the lawyer recalls – not to take pictures. I am the father of three daughters. Special security agencies have taught me how to avoid threats when handling similar cases. People, even judges, say I am crazy to have taken over this case. They say I am the enemy of my daughters, handshakes became rarer. I was a proud Vice President of the High Court, but now my acquaintances shake their heads. Religious parties hold grudges against me. ”

According to Saiful Malook, the Pakistan government is evading its responsibilities in the case of Asia Bibi, and is solely responsible for her suffering.

“Blasphemy is within the hudud (crimes against God), but none of the judges asked if the State in person or an authorized officer have filed a complaint of blasphemy against Asia. Sharia (Islamic law) says that the accused must confess their crime and all testimonies verified before the trial. All these requirements have been ignored“.

However, the lawyer maintain’s that the case of Asia Bibi has become highly political. “Hundreds of organizations – he explains – are calling for foreign aid to protect Asia Bibi’s family and give her legal assistance. Her benefactors should stop this trafficking”.

    Huh, why? It seems they can use legal assistance and aid.

      This does not surprise me. It’s likely partly that Saiful Malook realizes that charges of foreign Infidel involvement will make things more difficult and dangerous for him; and that despite his decency and bravery in taking this case at all, I would be very surprised if he actually ethically opposes Pakistan’s blasphemy laws.

    Regardless of what happens in the courts, her blood is halal as far as the Muslims are concerned.
    Just as with lesser knowns like Younis Masih who spent 8 years in prison before finally being released in 2013. He was accused of blasphemy against Muhammed after he complained about noise levels at an Islamic religious ceremony in his neighborhood. Though free he has to remain in hiding–because once accused of blasphemy his blood is halal for any Muslim to spill. And there probably will be no consequences–except maybe hero worship for the killer.

    Pakistan’s Christians have suffered many many extrajudicial executions for “blasphemy” regardless of whether the State ever officially executes anyone.

    –April, 2008 Jagdesh Kumar, 25, beaten to death by Muslim workers in a factory located in Karachi. He was accused of making blasphemous remarks.

    –2012: “A 35-year-old man detained in a lock-up in a Quran desecration case was beaten to death and his body was torched by a lynch mob who stormed the Rajo Deero police station. Officials said over
    1,000 people from Sita village and its surroundings attacked the police station at 8am to take out from the lock-up the man who had been handed over to the police some hours earlier by Memon Masjid area residents while accusing him of setting fire to the Quran.”

    Then there are the unofficial executions while in custody:
    2003: “Samuel Masih, a Christian, was arrested for allegedly defiling a mosque by spitting on its wall.
    “While in police custody Masih contracted tuberculosis and was sent to Gulab Devi Chest Hospital for treatment. He was killed by a police officer, Faryad Ali, who was one of the guards escorting him. He used a hammer to kill him in the presence of other officers and claimed that it was his duty as a Muslim to kill Masih.”

    Remember Julie Aftab, who when 16 had battery acid thrown into her face by Muslims for affirming her Christianity when confronted by them (just like Asia Bibi affirmed hers when confronted). When police came the men lied and said she had insulted Islam (“she said Muslims live in darkness and are going to Hell!”), and the police let the men go. Julie Aftab had to leave Pakistan. She at least lived (31 facial surgeries).

    This is the Pakistan which we fund and require nothing from in return. The same Pakistan where as reported by the NY TImes in 2009, Pakistani journalist Ansar Abbasi said to Judith McHale, U.S. Secretary of State for Public Diplomacy and Public Affairs, “You should know that we hate all Americans. From the bottom of our souls, we hate you.” A sentiment proven to be true, again and again, yet the jizya rolls on. Pakistan that not only has used that money for jihad and jihadis, to fund its nuclear project in violation of all agreements, but that does not protect it’s Christian (and Hindu) minorities from the Muslim mobs and that now holds a sword over the neck of Asia Bibi for a trumped-up charge of blasphemy while torturing her with prison.

    Even as her lawyer maintains the inherent righteousness of blasphemy law “blasphemy is within the hudud (crimes against God)” and just argues that this case does not meet the shari’a standard. An argument that does not seem to be working anyway.

      Fantastic post!! I have been following this case in particular and knew about certain others; the persecution of Christians (and other non Islamic religions)is on the increase. We need to put pressure on our governments to stop aid to these muslim majority countries until there is freedom of religion there as they have in the West. Bless you brother!!

        More importantly, we need to stop taking immigrants from these Muslim countries where jihad, sharia law, and blasphemy laws are popular, which is almost all Muslim countries.

    One of the main families of executioners in Pakistan is Christian. The Christian Masih family have been traditional executioners in the area of what is now Pakistan since the days of the British Raj. They stayed on as hangmen in independent Pakistan and the current member of rhe family performing the job is Sabir Masih. His great uncle was the hangman who hung former Prime Minister Zulfikar Ali Bhutto. Recently Sabir has hanged many Islamist terrorist suspects. Despite many Muslim prisoners scheduled to be executed feeling insulted that the hangman is a Christian the Pakistani govenment keeps the Masih family on the job.

      shams78 would have you believe that castration was some sort of sadistic Jewish fetish–but this is, of course, utterly false. Instead, castration of boys was a *Muslim* requirement, because they did not want any filthy Kuffar to interfere with their Infidel sex slaves.

      Moreover, pious Muslims are taking sex slaves *today*, in Nigeria, in Mauritania, in Sudan, and in the Islamic State. Unlike with marauding Vikings and Jewish slave traders, for Muslims, this barbarity is *hardly* ancient history.

    If Pakistan ritually, publicly, officially murders Asia Bibi on this sharia charge of ‘blasphemy!’ – or if she dies under murky circumstances in prison – then ALL external official western-government ‘aid’ to Pakistan should STOP immediately; and the stated reason should be that we refuse to give money or any other kind of help to the regime that can torment and murder an innocent woman, and that engages in multiple and multiplying gross and ongoing violations of the human rights of minorities, in particular, of non-Muslim minorities.

    Hideous Islamic Saudi Arabia, hideous Islamic Iran, and hideous Islamic Pakistan should be treated like the world’s other hellhole, non-Islamic North Korea (which is the only non-Islamic country that equals the horror of the most thoroughly Muslim lands): condemned, despised, excluded, shunned, and subjected to massive and crippling sanctions, by all free and semi-free countries. Diplomatic relations with them should cease, or be cut back to the barest arms-length minimum of icy politeness.

    End ‘aid’. End trade. Don’t allow them to visit. And don’t allow Muslims from those countries to visit, study in or – worst of all – migrate to and settle in non-Muslim lands.

    Well, they will not and they should not. In fact, right now they should up the ante, rather than tone it down.

    The British Pakistani Christian Association, and Barnabas Fund, and other Christian NGOs will keep right on supporting her family and lobbying western governments on her behalf, demanding that the pressure on Pakistan’s horrible government be increased.

    Seriously, the campaign ought to be led by the world’s Christian leaders right up at the top. It should be *all* Orthodox patriarchs speaking up; and the Pope (Asia Bibi is a Catholic, she is one of his flock, he *ought* to be down on his face in front of the high altar in St Peters’ in Rome fasting and praying on her behalf, or else sitting in sackcloth in the middle of St Peters’ Square calling all Catholics within travelling distance to join him in a Novena on her behalf…and alternating that, with hammering on the door of the Pakistani Embassy in Rome , with his crozier, *demanding* that Asia Bibi be released from prison and put on an Alitalia plane to Italy, with her family); and the Archbishop of Canterbury ringing the bells of St Paul’s and Westminster Abbey and calling for prayers, and, well, every other major Christian leader in the world, demanding, publicly, and loudly, and incessantly, for the clearing of her name and for her release and her safe passage, with her family, out of Pakistan, to a country of refuge.

    We need *more* noise, not less.

    We need loud and embarrassing rallies – or prayer vigils and sit-ins – outside Pakistani high commissions and embassies right across the West, and beyond it in places like the Philippines.

    We need western governments to be prepared to haul the Pakistani high commissioner, or the ambassador, or the consul, onto the carpet, to be told that Asia Bibi’s case is being watched very closely, that she is *not* forgotten, and that there *will* be consequences – like the cessation or severe curtailment of all ‘aid’ currently received – if she is executed or permitted to die of neglect, or under suspicious circumstances, in prison.

    As for ordinary Christians: whatever your denomination, fast and pray, pray and fast, and make sure that your priest, vicar or minister, knows all about Asia Bibi and what is happening to her. And write letters to your *political* leaders, reminding them of her case and urging that they use all leverage that they possess. If you are not a Christian, then a basic concern for human rights, freedom of speech and freedom of conscience should be driving you to speak on her behalf to those in power.

    And, of course, if you’re on social media, spread her story far and wide – and make sure you also explain that the hideous ‘blasphemy law’ in Pakistan is directly based on the sharia of Islam. It’s not some weird local aberration. It’s not just about common or garden tyranny. It is *specifically* Islamic. The tormenting of Asia Bibi and, if she *is* executed – ritually murdered to the accompaniment of triumphalist howls of allah akhbar – *are* ISLAM, Islam, Islam, Islam. *That* is Islam. What Islam commands and what many, many, many Muslims *do*.

    Typical, bully cowards cowering under peer pressure, surely they are not that evil that they truely agree that she should be murdered for disagreeing.
    It is obviously wrong to murder someone for blasphemy.
    There is nothing conceptual that is holy.
    Life is holy.
    Nature does not agree with them.
    Allah is quiet.
    Islam is gang warfare, and saying that is an insult to many gangs. Islam is blasphemy manifest.

    This is the biggest issue in the world right now – the persecution of Asia Bibi. Forget any other issue- this is it. She should be a worldwide name as Malala Yousafzai is, but instead the media all across “the free world” ignore this story. Women are the biggest victims of Islam, and this is a perfect microcosm of this hatred Islam has for women and for people who sit outside what this evil “religion” feels is acceptable. Until Islam is outlawed around the world we will be faced with more cases like this. Every day Asia Bibi deals with pain while left-wing media types in free countries ignore her plight. The hypocricy is sickening.

      Chantell, Pakistan’s president *could* save her, but why would he want to? He’s a pious Muslim, and as such is fine with Shari’ah and oppression for blasphemy, false charges or not:

    How little or no faith at all in Allah do Muslims display, when they seek to “defend” their Allah from “blasphemy”.

    Is their Allah powerless to defend itself?

    Surely a true God has the power to defend itself, and even to change the views and mindset of those who do not believe in it.
