The smart and beautiful in both parties have been prostrate with the vapors ever since Donald Trump called for a temporary timeout on admitting all Muslims into the United States until “we can figure out what the hell is going on.” Such a blanket exclusion, his critics claim, not only would be illegal (questionable), but would alienate “moderate” Muslims whose cooperation is essential to combating jihad terrorism (arguable).

After all, everyone agrees that not every Muslim is a jihadist.

Conversely, though, all jihadists are by definition Muslims.

So how do we sort them out? That is, if we don’t exclude all members of the larger set (Muslims), how do we define and identify the subset (active or potential jihadists)? On that score, Trump is correct on one essential point: we don’t know what the hell is going on.

Here’s an illustration. Most Americans probably assume that when we screen people for admission into the United States, we not only look for terrorist connections but also weed out people promoting the radical ideology and goals that motivate the terrorists. This should at least include advocacy of creating a worldwide Caliphate state and imposition of Sharia law in place of the U.S. Constitution. One should also expect exclusion of members of the Muslim Brotherhood, the international pro-Caliphate political party Hizb ut-Tahrir, and similar organizations.

That assumption is dead wrong. Members of such groups and partisans of jihad ideology are not barred from entering our country unless there is a link to “terrorism” narrowly defined to include only detectable violent activity (“premeditated, politically motivated violence perpetrated against noncombatant targets by subnational groups or clandestine agents,” 22 U.S.C. 2656f(d)). This is because a 1990 statutory revision virtually abolished so-called “ideological” grounds for exclusion as had previously been used against Nazis, communists, and anarchists.

Today, no one can be barred for adhering to the political and moral principles that justify jihadism or for advocating doctrines contrary to the U.S. Constitution and American values, such as Sharia’s blatant discrimination on the basis of religion and sex. Indeed, one can come into the U.S. even while pushing for the legal adoption of such barbarities as stoning adultresses, beheading apostates from Islam, slavery and sex slavery, or pedophilic “child marriage” – or maintaining the legitimacy of such horrors as “honor” killing or female genital mutilation, which are not strictly Islamic but endemic to some Muslim-majority countries – so long as there’s no indication the applicant actually intends or has been linked to “premeditated, politically motivated violence.” (Interestingly, an 1891 inadmissibility of “any immigrant who is coming to the United States to practice polygamy” (8 U.S.C. 1182(a)(10)(A)) – directed at the time against Mormons, not Muslims – remains on the books, though it’s unclear how strictly it’s enforced.)

Indeed, not only are Sharia and Caliphate advocates not barred from entry, under applicable standards such advocacy might actually help qualify them for admission as refugees, or for claiming asylum if already present in the United States. That’s because in many countries the Muslim Brotherhood, Hizb-ut-Tahrir, and similar groups are illegal and subject to government repression. In such countries, repression may under U.S. law constitute “persecution” for purposes of establishing asylum or refugee status. In effect, we’re issuing an invitation: Is your nasty government giving you a hard time because you’re calling for Sharia and the Caliphate? You poor dear! Come take refuge in the U.S. so you can freely call for the same here – if you promise scout’s honor to keep it non-violent.

(Contrast that with the virtual exclusion of Syrian Christians under the same criteria. Christians make up about 10 percent of Syria’s population, but they make up less than three percent of Syrians admitted so far as refugees or asylees. Why? Because under US law, only government persecution counts. Being raped, tortured, enslaved, and beheaded by non-governmental jihad groups such as ISIS doesn’t. Since the Syrian government protects Christians, few of them qualify for admission, but a Muslim Brotherhood member calling for a Sharia-ruled Caliphate might be quite qualified).

Preferably, Congress should fix this egregious omission by legislating appropriate exclusions. However, President Obama – who reminded us he has a pen and phone – certainly could do it himself, at least temporarily until Congress acts, under statutory authority that allows him to bar any class of aliens he deems a danger to the U.S.: “Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.” (18 USC 1182(f), emphasis added)

I’m not holding my breath. But the slim expectation that Mr. Obama might do the right thing isn’t a reason not to try to force the issue. Conveniently, Mr. Obama has provided a mechanism to do so – on his own White House website. (A recent petition asking to list Turkey as a terrorist state reached almost 40,000 signatures, despite an almost total lack of media attention until the final two days.)

So on February 22, I posted a petition on the White House site, as follows:

We want the Obama Administration to:

Exclude from the US advocates of Sharia, Caliphate, sex slavery, killing apostates/adulteresses, “honor killing,” or FGM

Exclude or deport from the US and bar from naturalization any person who, regardless of religious belief, advocates or condones the following principles that are contrary to the American Constitution and values: Sharia law, a Caliphate state, violent jihad, child marriage, slavery or sex slavery, “honor” killing, stoning adulteresses, killing apostates, female genital mutilation, or devaluation of inheritance or of legal testimony based on gender or religion; or who is or has been a member of any organization, or a participant in any of its activities, that advocates or condones any of the above. Such exclusion should not depend on any connection to terrorism or other violent actions, and should apply to visitors, immigrants, and refugees/asylees.

With the White House site only allowing 800 characters, this text is just an outline building upon programs for excluding Islamic radicals on ideological grounds proposed by Srdja Trifkovic, Daniel Pipes, and James Edwards, among others. If any such standard is adopted, it would have to be fleshed out and codified. Regulations would have to be issued to set out the methodology, including a well-crafted battery of questions to identify the targeted individuals and groups. It would not be perfect, any more than other law enforcement measures are perfect. But it would constitute a start towards figuring out “what the hell is going on.”

Under White House rules, there are only 30 days from the time of posting to reach 100,000 signatures to trigger an official response, which anyway would amount to just some fibs drafted by the State, Justice, and Homeland Security departments. More important than any expected response, the petition allows an official government site to be used as a bulletin board for excoriating the Obama Administration’s (and let’s be honest, most Republicans’) malfeasance in “Keeping America Safe”©.

    The exclusions mentioned seem to indicate that the United States should be a sovereign nation unbowed by the unsavory politically motivated whims of the UN and that anyone who wishes to enter the US should consider it a PRIVILIGE and not a RIGHT.

    Great idea. You might want to change the wording and avoid “sharia law.” I’m no expert but I believe that was a sticking point when states have tried to pass legislation banning foreign law in US courts. Who actually knows what “sharia law” actually means — it’s too broad. Best wishes.

      Ask most any of our fellow citizens to define “shari’ah law” and you’ll get blank stares, misconceptions, etc., etc., etc.

      Replace that with Islamic law and the confusion level will drop.

      Constitutionally, these prohibitions are not the same thing.

      Banning Sharia within the U.S. can certainly be done, but it implicates all kinds of constitutional rights (free exercise, federal monopoly on international relations, etc.). Even illegal aliens in the U.S. have significant constitutional rights.

      By contrast, the courts have (amazingly) found that aliens outside the U.S. have essentially NO rights under the U.S. Constitution. In one case, a U.S. citizen was not allowed to have her husband (a terrorist suspect) enter the U.S. The husband had no constitutional right for him to enter, nor did the wife have a right to be united with her spouse on U.S. soil.

    Maybe Trump on really on to something. For it could that Tramp as has not been “taken in” ,as in deceived or fooled by the Islamic disinformation campaign that has given false premises about the very foundation of Islam. As the Bible reads in Proverbs 15: 15 “A simple man believes every word he hears; a clever man understands the need of proof.” [NEB]. Likewise, It’s a good idea not to take at face value the claim that the word Islam means “peace.” For example, the ENCARTA WORLD ENGLISH DICTIONARY copyright 1999 defines Islam as “submission” based on the word “aslama” meaning “he surrendered.” Given the definition it’s an odd phenomenon that after about fourteen hundred years starting on September 12, 2001 the meaning changed from “submission” to “peace.” It’s very well known that if the police are questioning someone and he changes his story something is wrong. Nevertheless, when it comes to Islam no one gets suspicious of the change. The jihadists brag that they will win the war against the West by using the Western ignorance and naive gullible mindset on the subject of Islam against us. It seems that they do have some basis in that claim since so many Westerners are beguiled by the Muslim disinformation campaign.

      9/11 was part of a much broader Saudi Operation to push forward the submission of the West, with partial facilitation by the Bush clan, perhaps hidden from itself behind a polite veil of “social sophistication.”

      Al-Qaeda was merely the thin end of a much wider wedge that continues to rip through the core tissue of U.S. and Western societies.

        Bin Laden. to put it mildly, stopped being a fan of the Saudi royal family since the time of the First Gulf War, when the Saudi family snubbed him and his fresh-out-of-Afghanistan ragtag bunch of “freedom fighting” mujahideen in favour of American troops to guard their territory against a possible Iraqi invasion. And the feeling was mutual – his Saudi citizenship was revoked in 1991 due to his criticism of the Saudi royal family.

          All the facts set out by Angemon seem to be correct (at least judging by published reports), but there is far too much evidence of extensive involvement in 9/11 by senior Saudis. (The very fact that the famous “28 pages” in the 9/11 report are still being kept secret points to ongoing involvement by our Saudi “friends and allies” and their lackeys in D.C.

          Quite possibly, there are different factions within the Saudi ruling class one of which favors active jihad operations in the West, while another prefers to keep things on an even keel and stabilize power on the peninsula.

          The strategic objective behind 9/11 may have been akin to heavy artillery shelling to “soften up” an enemy position before troops move in for individual, close-range combat.

          I don’t doubt that Saudis were involved in 9/11, regardless of their motivation (religious or ethnic comradery to bin Laden, hatred of the West or simple and plain bribery), but I don’t think bin Laden acted on behalf of the house of Saud or the official Saudi government. I see bin Laden/al-qaeda and the house of Saud as two entities competing for the same goal: the spread of islam through the world. The policy of the House of Saud is to do so by funding mosques and terrorist groups abroad (while several of their members indulge in all manners of Western vices) while bin Laden opted for straight military confrontation.

    The problem with asking about an individual’s religious/political beliefs is that the smart ones, and those who’ve been properly coached, will lie.

    And the questioner will record their answers.

    When a Muslim immigrant (whether Naturalized or not) later begins agitating for the implementation of Islamic law, their answers to those questions will mean nothing. When reminded of their previous answers–they will simply say they’ve changed their minds.

    And, no, deportation will not be an option for most of them.

      If there were a will, there would be a way. The starting point is that would-be immigrants have the burden of proof, and essentially NO constitutional rights, and their self-serving assurances need NOT be taken at face value. It is quite possible to design intelligent, 21st century techniques that would weed out 99% of Muslim applicants. There is, of course, zero will to do so among the Left and negligible support within the Republican establishment.

      Example: Communist governments (e.g. China) have for decades required that visa applicants disclose information as to all family members – siblings, parents, children, ex-spouses, etc. All such information is actually checked and cross-referenced with information obtained from the other family members, from the home country’s official records, etc.. An intelligent system could certainly weed out 98% of Muslim applicants.

      Here in the real world, we have a culture where Georgetown dinner guests regale each other with tales of of insults and humiliation meted out to Christian (titter!) “rubes” and “rednecks.” The teller gets extra points if the victims were in positions of dependency to their Georgetown betters through private-sector employment, health care needs, educational tyranny, etc.

      It is certainly true that “the smart ones … will lie.”

      However, there is a trick that is surprisingly effective: despite broad religious license to commit taqiyya (lying for Islam), regular Muslims will refuse to pronounce the simple sentence “I am not a Muslim” because to do so constitutes the capital crime of apostasy.

      Also, of course, names tend to reflect religious belief – few Egyptian Copts will have a brother or father named Muhammad.

      Biometrics can easily match hard-core lying applicants with mellower blood relatives (who may have sought visas to visit or live in OTHER countries). These matches can then be correlated with personal registration data etc. using standard data mining techniques used daily by Google, Apple, retailers, banks, political campaigns, etc. in the U.S.

    Hey, I’d be happy if Obama stopped excluding Christians. Today, the State department looks at applications for asylum from the Syrian refugee camps. But Christians don’t go there because they fear they will be attacked. So by drawing from a pool that is (virtually) 100% Muslim, the State Department excludes other religious minorities like Yazidis and Christians.

    Of course, The Chosen One tells us that excluding Muslims from immigrating to the US is “unamerican”. But I guess it is ok to exclude other groups.

    Well… there is no absolute certainty with anything (except death and taxes, of course). But if you bring down the bar slightly then the answer to your question is Yes. The Muslims belonging to the sect of ex-Muslims are highly likely to be model citizens. It is also possible to tell with high degree of accuracy, whether someone claiming to be ex-Muslim is lying or not.

    As for Muslims who are not ex-Muslim, there is no way that I know of, to know that he is not going to become an Islamist, jihadist, fundamentalist Muslim, or all three in one some day.

    Ali Sina said to think of an Islam-follower as a HIV positive man. You never know when he will actually get AIDS. It may happen tomorrow, may happen 30 years from now, or may not happen at all. All we know is that the risk of him getting active AIDS is present, and this risk is high enough to be worried.

    Hence, ex-Muslims are safe enough. Muslims are not!

      And *genuine* declared ex-Muslims would, I am sure, be more than happy to sign up to what one might call a ‘parole’ system, or even to to be required to attend ‘cult deprogramming classes’ from a reputable provider such as already is used to dealing with escapees from the likes of the Moonies or Scientology. They would know – *none better!* – exactly why their non-Muslim hosts needed to be wary. They would *know* about the danger of Islamic deception.

      I am sure a genuine apostate such as Ali Sina or Ibn Warraq would be more than happy to ‘check in’ each year with a ‘registry of declared Apostates’ and to offer complete transparency as to activities and financial dealings, in order to continue to enjoy the (relative) freedom and personal safety of his residence in a majority-non-Muslim country.

    And why would he do that? I have never heard the current occupant of the White House utter a single critical word about Shari’ah and the Caliphate.

    In fact, here he is, imposing Shari’ah strictures on our own troops when it comes to Islamic dress and observing Ramadan:

    Yes–I’ve seen this myself, and it is *totally insane*. It would be like taking in Nazis who where *persecuted* by the Weimar Republic.

    It also means that when they start waging violent Jihad here that it is almost impossible to deport them, because they will face “persecution” in their country of origin.

    I think we could simplify that petition greatly. Simply ban anyone from entering the country with the name Muhammad, or anyone with a relative with that name. It should be easy to amply demonstrate statistically that persons with that names or persons who have relatives with that name have committed more terrorists acts than anybody else in the world.

    The U.S. Constitution does not say anything that can be said to make the rule that anyone anywhere has absolute right to move to the U.S. The government can decide to disallow anyone from coming. The Constitution does not give anyone in a foreign country the legal right to move to the U.S.

    Only after getting to the States does a person have a U.S. Constitutional right. Before they get in, there are no laws that apply to give them rights. And if they get in, it takes some time and some hoop jumping to get more rights…the right to stay being one that a person might be given.

    The rights to life, liberty and the pursuit of happiness are from our Creator.

    But there is much confusion among the public…in the country and outside it…about what rights foreigners have…or don’t have. Just as Mr. Spencer was denied entry into the U.K., moslims can be denied entry into the U.S.

    Obama is a traitor. That is only TOO plain and very clear. Every time I see this photo. Him in front of those beautiful stained glass windows. With the ” black, muslim prayer rug” draped over the symbol of the Christian faith. (AT HIS OWN INSISTENCE!) Well, it gives me an intense urge TO VOMIT!
    I’m quite certain, that millions of citizens, who were duped into voting for this abomination, have felt the same for a very long time!

    The English, [remember them?] should deport all the mothers and fathers of girls who have suffered Female genital Mutilation/MUSLIMISATION in this country. The ferries and planes would be packed with the scum of the earth, trouble is what do you do with the girls who have been ‘barberised’, do they go with the parents to some Islamic wonderland and get married off at 7 years old or perhaps go to suicide bomber school ? should we care……..???.

    First of all potential immigrants do not have constitutional rights until they become citizens. The government should be able to put together a questionnaire like this if only so that later if they are found to have lied on it they can be stripped of citizenship and deported. Europe should do the same. Many European countries find themselves unable to deport criminal aliens once they get citizenship. Lying on your application should be reason enough since you gained citizenship under false pretenses.

      Not so, Andrew. Even a tourist on US soil is afforded the rights of our Constitution, at least for so long as he is here..

          It would, Andrew. The Constitution is the law of the land, and it applies to everyone. Of course, the tourist would have to apply for and pass a background test as required by the state he is in relative to buying a firearm or carrying it concealed,, but if he follows the law’s requirements, he enjoys the benefits of our Constitution.

    It’s looking more and more to me like Trump might represent an American, 21st-century manifestation of what G K Chesterton once called the great human game of “cheat the prophet”.

    From his novel “The Napoleon of Notting Hill”: ”

    “…The human race, to which so many of my readers belong, has been playing at children’s games from the beginning, and will probably do it till the end, which is a nuisance for the few people who grow up.

    “And one of the games to which it is most attached is called “Keep to-morrow dark,” and which is also named (by the rustics in Shropshire, I have no doubt) “Cheat the Prophet.”

    (Of course, Chesterton, back then, didn’t have He Who Must Not Be Named – or should I say, He Who Must Not Be Drawn/ Cartooned/ Mocked? – in mind specifically when he wrote ‘Prophet’. – DDA)

    At the very least, every Islamoinformed Islamoresistant American, right now, should be getting behind Trump and PUSHING. He has at least said out loud what NOONE else in the entire Infidel WORLD (not just ‘the West’) has been game to say… that it might be good idea to STOP LETTING THE MUSLIMS IN.

    Register to vote if you’re not already registered. Make sure every Islamoresistant person in the USA is registered to vote, well ahead of time. And step up the spreading of information, to produce *more* Islamoresistant persons.

    Refuse to despair. Roll up your sleeves, and geet ready to play “Cheat [or, Trump] the Prophet”.

    Here’s hoping!

    And if you just. do. it, lots of us non-Americans from countries all over the world will be leaping up and down and cheering you on.
