An Australian accused of recruiting foreign fighters for the Islamic State terror group is at the centre of a US constitutional battle in a Texas court.
US prosecutors have charged Mohamed Zuhbi with terrorism offences despite the 25-year-old former Sydney resident not stepping foot in the US.
An arrest warrant has been issued by US authorities for Zuhbi, who is believed to be living “somewhere along the border of Turkey and Syria”, prosecutors told the US District Court in Houston on Friday.
He is accused of helping 21-year-old US citizen and former Australian resident Asher Khan attempt to join IS.
Khan flew from Sydney to Turkey on February 24, 2014, after allegedly communicating with Zuhbi on Facebook.
Judge Lynn Hughes raised the constitutional question late last month when he issued the one-line order: “The United States of America must explain how the constitution gives the court jurisdiction over Mohamed Zuhbi.”
Prosecutors hit back on Friday, telling the judge Zuhbi’s actions in providing IS fighters was “criminal activity that harmed the interests of the United States and threatened its security”.
“The fact that Zuhbi was located outside the United States throughout the conspiracy is immaterial because the statutory requirement is satisfied so long as one conspirator was within United States jurisdiction,” prosecutors wrote in Friday’s court filing.
Judge Hughes is yet to rule on the issue….

That is very simplistic.
As much as I hate these idiots, what’s the difference between them pushing for a worldwide caliphate, and America operating like one? Go and act on Asher Khan. He is now a US citizen. If the US are serious about Zuhbi, the US can’t stop with just him. The US, just to show how powerful they are, should lay claims to all ‘Australians’ with the same mindset as Zuhbi. According to our last census, Australia has a population of 2.2% followers of Islam. They are all interlinked through Imams, mosques and doctrine. I believe our next census will show an increase to approximately 6%. In a country of 25,000,000, that’s a lot. By all means US, come and collect the lot of them. You will find that they scream “Death to America”, as much as they hate us here.
Realistically though, America needs to stop poking it’s nose into the affairs of other countries. If this is an issue that has occurred outside of the US, what gives the US the right to act? Your constitution is not all encompassing. It does not cover other countries. It is your constitution. We have our own. I don’t believe the Free Trade Agreement between Australia and the US covers terrorism.

This is nitpicking. The guy is a danger to both countries. In my opinion, both Ameriica and Australia and other counrries like France and the UK should establish Guatnanamo style internment camps for jihadis in remote Pacific islands which they own. No need for torture, simple work producing food for themselves and enough income so that the operation would be self sufficient. Jihadis could be made work ther to produce food for themselves and it might provide a deterrent for some of them, if they realize that they could end up in one of them for the rest of their lives. How much does it cost a country in surveillance, court cases, lawyers, judges and the rest, plus jail for many years? Too much. Let them work and pay for their internment. Muslims have no work ethic in any case.

Sorry I missed,in the introductory part,,”a dual Australian Syrian citizen” so that was back a few years ago in Aug 2014. and the interview was when he was in Turkey

How long ago did he arrive in Australia, and when did he become an Australian citizen?
So how come he is now safely back in Australia?
I guess he will use the wife and child issue to remain in Australia, presuming of course is wife and child are now in Australia.

He is not an “Australian” in any meaningful sense of the word.
He is an “Aussie-passport-holding Mohammedan”. His loyalty is given to the Ummah, and if my government in Australia had any sense, such as he – who are *known* from their widely-publicised activities and statements to be up to their necks in bloody Jihad and the energetic incitement of same – would be loudly and publicly declared to be *no longer ‘Australian’ citizens*, their citizenship being declared NULL AND VOID.
He is not an ‘australian’, but an Enemy Combatant, the declared and open enemy of infidel Australia and of all other non-Muslim sovereign states *everywhere in the world*.
