Australia: Muslim refugee rapes 10-year-old boy, says what he did is not a crime because it’s acceptable in his homeland

In Afghanistan and elsewhere in the Islamic world, this kind of behavior is broadly tolerated. Women are so devalued, men look to other men and boys for sexual pleasure. Also, the Qur’an promises not just virgins to the blessed, but boys like “scattered pearls”:

“Those are the ones brought near in the Gardens of Pleasure, a company of the former peoples and a few of the later peoples, on thrones woven, reclining on them, facing each other. There will circulate among them young boys made eternal with vessels, pitchers and a cup from a flowing spring.” — Qur’an 56:11-18

“And they will be given to drink a cup whose mixture is of ginger, a fountain within Paradise named Salsabeel. There will circulate among them young boys made eternal. When you see them, you would think them scattered pearls. And when you look there, you will see pleasure and great dominion.” — Qur’an 76:17-20

A refugee who raped a ten-year-old boy has claimed he did not know sexually assaulting the child was wrong as it was ‘culturally acceptable’ in his homeland.

Mufiz Rahaman told Sydney’s Downing Centre Court raping children was not seen as morally wrong in his native Myanmar when he pleaded guilty to the aggravated sexual assault of a 10-year-old refugee on Wednesday, the Daily Telegraph reported.

The 20-year-old and his young victim are both stateless Rohingya Muslims – a group of people considered illegal immigrants from Bangladesh by the Buddhist-majority in Myanmar – who came to Australia to flee religious persecution.

The court heard Rahaman preyed on the young boy while he was living with a group of refugees, including his father, at a vacant RSL club in Lakemba, a suburb in Sydney’s south west, on January 8, 2015.

According to documents tendered to the court, he crept into the child’s bedroom – which he shared with his father – as he slept and took off the boy’s underpants.

He then raped the boy, who arrived in Australia in 2013, while his father was in another room preparing lunch.

When the boy’s father returned he noticed the door had been shut and overheard Rahaman tell the boy: ‘I’ll give you money for this.’

‘My father will hit me,’ the boy responded.

The boy’s dad stormed into the room and found Rahaman lying on top of his son who was face down on the bed with his pants around his knees.

He asked: ‘What are you doing to this little boy? You’re an adult.’

The paedophile denied doing anything to his son but the young boy told his father he had been raped.

Rahaman, who came to Australia in 2012, was arrested two days later after another family member reported the incident to police.

He submitted to a DNA test which was matched with semen found on the victim.

According to the Daily Telegraph, Rahaman told the court he had been a victim of sexual abuse as a child before he moved to Australia.

Judge Andrew Scotting said Rahaman failed to understand his actions would ‘physically’ and ‘psychologically damage’ his young victim.

He also said Rahaman, who insisted he thought sexual assault was not seen as morally wrong in his homeland, had not accepted responsibility for his actions and demonstrated a ‘lack of morality’, according to the Daily Telegraph.

‘There is a need for specific deterrence … The offence appears to have been (viewed) as being culturally acceptable conduct in the offender’s childhood,’ Judge Scotting said….

    No doubt he will be let off with a slap on the wrist as he comes from a society where this is NORMAL behaviour, and surprise surprise he didn’t know it was illegal here, this is just about as stupid a defence as the moslem here in Melbourne who was convicted, and then let off on a rape charge as ” he didn’t understand our laws ” and the poor man was suffering PTSD. What a disgusting load of crap!!

        Ignorance of the law is no excuse as you will quickly find out if say the Highway Patrol pulls you over for a traffic infringement. But it is known for Muslims to totally ignore our road laws, they even feel they are above the law. Likewise they seem to be above all of our other laws including sexual assault and the right to have child brides.

        This is the first I have heard of this news story, thank you J W. But I also note that he is from Burma, I assume part of the persecuted Muslim ethnic minority in that country. They all appear to be of Bengal nationality, they should be sent to Bangladesh. They don’t belong in Australia but I instinctively knew that the do-gooders would be bring them here sooner or later.

        I feel that the only suitable punishment for this creep should be deportation (including his family) following at least 10 years prison. (But as the Indonesian people smugglers say; Life in our jails is better than life in Indonesia as a free man!)

      People who think that he should get a lower sentence because “it’s acceptable in his culture” should also insist that charges should not be pressed against people from cannibalistic cultures who murder and eat people, because they didn’t know that Australians, Americans, Canadians etc. are incultuated to eat hamburgers instead of people.

        I don’t know the exact law in Myanmar, but I strongly suspect that there is a flourishing sex industry there catering to every depraved taste there is. When I was in Thailand back in the ’90’s, there was trafficking of women and boys from countries around Thailand to serve the Thai sex industry.

    Hmmm. Very disquieting article. That he pleaded guilty indicates a plea bargain, with his pleading guilty to some lesser charges, ie. dropping some more serious charges. But this is just informed speculation. The judge is the one we should be concerned about. He is dangerous.

      I wonder if this can be used as a precedent. Why are only Muslims allowed to be excused because they don’t know the law.
      Many of us don’t know the law in it’s entirety either but we know right from wrong.

      Not all those abused grow up to be abusers–I was abused and raped as a child, and that makes me more determined than ever to protect children from the same. But I also did not grow up in a culture that sacralized such abuse.

    If the father heard the man say he would give the boy money, then he KNEW it was wrong. Paedophiles are always going to be a paedophile. Now this boy gets to live with this rape his whole life. I believe in capital punishment for paedophiles. It’s the only way to cure them because this is unfixable. He WILL assault again, given the chance. Why imprison him even? And this Judge is most likely going to rule a lesser sentence? Australians should be outraged!

        I have read, and heard in many seminars, that there is almost 100% repeat offense among child abusers. There does not appear to be any rehabilitation. This makes a false charge of child abuse absolutely devastating to a wrongly accused. And, False Charges happen because they are easy to make, there is an almost irrebuttable presumption of guilt, intense jury appeal for the prosecution, and massive favorable publicity for the prosecutor bringing the charge and the police giving news interviews and testimony. To provide a fair trial that is due under the Constitution demands first and foremost an incredibly fair judge, which in my experience is rare, not unknown, but rare..Really bad things ought to happen to the guilty; but not to those who are not.

          I WHOLEHEARTEDLY agree in this case there is no reason to believe this guy was falsely accused, starting from the evidence, going to testimony and concluding with the guilty plea.

          Having had to defend a number of false accusations, a word of caution should be added so that future cases are examined with thought rather than passion and outrage. My honored and treasured Uncle, whom I have mentioned before, taught me as long as I knew him that there are at least 3 sides to every story, yours, mine and right. I have seen abuse of the legal system, and have crushed 2 false accusations that I had breached my duty, which is why I seem to know something about those duties. While those of us accused of islamophobia are presumed guilty, there is in the US supposed to be a presumption of not guilty until proven.

          It is my understanding that “common law” countries share this presumption. But I believe, and ask for correction if in error, that in civil law (based on the Code Napoleon) jurisdictions the burden of proof of not guilty is on the defense. Remember that “not guilty” is not the same as “innocent”. “Not guilty” means that all the elements necessary for a conviction are not present. “Innocent” means that NO elements are present.

          The rapist we are discussing in this article has made it clear that he deserves no sympathy and in fact deserves to be isolated from civilized people as long as he lives, however short that may be. Thank you for raising the question and allowing me to discuss my view.

    That Muslim man who committed that crime has in his trying to defend himself against criminal charges, is really coming and admitting that Muslim countries are primitive and savage because of Islam which reflects Islam is “values.” The Muslims in those countries because of their religion have heinously wicked “values.” So the people in those Islamic countries must be totally devoid of the basic knowledge of the obvious difference between right and wrong.       I don’t hate you, ploome–I understand your frustration. But Muslims are *not* just doing this to each other, as I showed in my links.

      In fact, Muslims are involved in an orgy of raping small boys (especially attacks at pools), little girls (look at the rape of a 5-year-old girl in Idaho), women (look at the mass molestation and rapes on New Year’s Eve in Cologne and other European cities), and even on grown men when they get the chance.

      In Australia, Sydney has had an epidemic of Muslim rape gangs.

    ISIS and jihadists aside. “Containment” is the first best policy regarding refugees. I’d be happy to see our tax money set safe zones up in their own region.

    A different family member notified the authorities 2 days later, what? I’m very surprised the boy’s Father did not at least try to detain the perp and call the police himself. I’d be knuckles, elbows, knees and joints locks all over the rapist weirdo. If deemed an assault it’s a crime of passion in self defense of the child.

    Yeah. I’m sure if any of us walked in on the same situation we say, “Oh! I believe you. Sorry, my mistake for barging in here.”

    Hold the phone-y here. Didn’t he claim he didn’t know it’s wrong because is accepted behavior where he came from? Then he shouldn’t be claiming he was sexually abused as a kid. His argument would remain that he did not do any wrong.

    He’s just parroting lawyer advice, (Probably a Muslim lawyer) to play victim.

    You know when it comes right down to it, lawyers don’t have ethics that far different from Islamism. “As long as it promotes your side, go for it.”

    We “lawyer up” when in trouble.

    I wonder if “Taqquiya up” has the same meaning.

      I have some really considerable experience in this subject of lawyers and their duties: If you tell a lawyer about a completed crime or fraud, what you say is safe from disclosure with TWO exceptions, 1) you consent to the disclosure, for example by saying on the advice of my attorney . . ., or 2) you attack your lawyer by accusing him/her/it of inadequate representation or other ethical breaches.

      When you consult a lawyer about planned or ongoing crime or fraud there is never any duty of confidentiality. On the contrary the lawyer is required, if you refuse to stop, to call “the affected person or tribunal” to inform them of your acts, whether planned or in motion. Otherwise the lawyer becomes a party to your crime. Under US Federal law he/she/it is equally guilty with you in whatever you do. 18 U.S.C, 2, see also e.g., 18 U.S.C. 371.

      A lawyer’s duty of zealous advocacy of his client’s interest is limited by an equally solemn duty to uphold the law and the standards of professional conduct. Nix v. Whiteside, 475 U.S. 157 (1986). A lawyer’s office is not a nest of vipers in which to hatch out frauds and perjuries. Gebhardt v. United Railways Co., 220 S.W. 67 (Mo. 1920). A client who consults an attorney in aid of a crime or fraud will have no help from the law; He must let the truth be told. Clark v. U.S. ____ U.S. ____ (____). The presence of crime or fraud waives privilege. In re Grand Jury, 640 F.2d 49 (7th Cir. 1980). Once privilege has been waived it cannot be reclaimed. U.S. v. Krasnov, 143 F.Supp. 184 (E.D.Pa. 1951), aff’d sub nom, U.S. v. Oppenheimer, 355 U.S. 5 (1957). By citing these cases and showing ongoing crime or fraud I have seen 4 lawyers ordered to the witness stand to testify against their clients. I have never seen another lawyer force opposing counsel in similar situations because of “professional courtesy”. These decisions are “good law” in the US but could at least be “persuasive” in Australia if a lawyer could be found to argue them.

      In too many cases lawyers follow the old one “It ain’t illegal until the judge says so!” and feel empowered to say or do anything as long as they continue to collect their fees.

        I know what lawyers are SUPPOSED to do.

        The problem is, nobody believes lawyers have any more integrity than a typical politician.

        Which might be why so many lawyers end up in politics.

        Several years ago, I was in a NASTY business dispute. I’d wanted out of the family biz. Owned 30% free and clear of all debt, but had just finally had enough.

        The only offer I got, was F off. Learn to get along.

        I said, “Look. (No swearing I swear.) This isn’t working. I’ll give you a year to figure something out, but I want out.”

        A year later, I was told to F off again, and I simply walked away. I was fortunate/unfortunate, in that, after almost twenty years work, I’d had NO time to even think about starting a family, so I had nobody to worry about feeding but myself and, and FURIOUS as I was, the only thing that stopped me from suing was, the family patriarch might change his mind down the road but, if I get a lawyer, HALF any money I get’s gone, and more legal fees from the rest of the family, with whom I had no quarrel.

        I figured I might die broke and staving, but ain’t no way no lawyer’s getting a penny.

        A few years later the family offered a pay out.

        I accepted no questions asked.

        And the #$%^&*$#$% lawyers triple billed us just to transfer land an property titles.

        $75,000.00 grand was the whole family bill, me paying my share, when there was no bickering, no complaining, no threats to sue, no court time, no nothing.

        And we’re talking for a business that was only worth a bit under 2 million.

        Lawyers, have earned they’re reputation.

          To my experience more or less 90 percent of lawyers are not people I would consider fitting the model set by THE LAW. That is why I learned how to beat them, in the process equipping other lawyers who will to expose the liars.

          As far as the fee dispute, consult your Bar. IT looks to me like the majority shareholders negotiated an inflated fee in your absence to load you and diminish your distribution, while either paying their outstanding legal bill for other work, getting a rebate under the table, or paying for other future services. Their lawyer was not yours and should have advised you to obtain your own attorney. I think the bar would see a conflict of interest; and as a shareholder you may have a derivative action against your family and their attorney for breach of their fiduciary duty to you. Talking to your own, licensed and currently practicing attorney could be extremely enlightening. But make sure as best you can that he/she/it has substantial experience and success in heavy shareholder and corporation litigation. Just because a license is on the wall and in effect does not mean the lawyer is competent to advise you or handle the case. It is possible that a breach of fiduciary duty claim could return compensatory and punitive damages along with your attorney fees.

          Many years ago I assisted a 49 percent shareholder against his 51 percent brother who lived like a king, while my brother lived like a pauper and did all the hot, hard construction work.           I have no reasonable path to disagree; and every reason to agree. When confronted with an organizational denial cult, I found it necessary to “move on”. There is no sense in supporting people who “don’t get the message” when the message is all around US. One of the many great lessons of Patrick McGoohan’s Prisoner series is that in the final analysis (The Hated cliche’ “at the end of the day”) we are our own Number 1 with the right, duty and authority of dismissing any Number 2 who is harmful to us. As long as we accept the control of all the Number 2’s trying to send us to individual and cultural death, we will do what they want instead of what is best for us. How many Number 2’s do we tolerate in our lives? How many of them are on “our side”?

      For 7 years, ages 15 to 22, I didn’t accept other’s beliefs just to fit. My honored and treasured Uncle, who served as my father-by-choice #2, was the only member of the family that did not go into shock and panic when I challenged them with questions. He said that I was asking the most important question of my life and that the answer I would find would be my own, and the “perfect” answer for me. After 7 year what I have taken ever since to be a miracle happened to show me a presence in my life. Now 40+ years later, I still seek better answers but am quite at peace with my understanding. There is everything right in making up your own mind. This is the basic freedom that offends every totalitarian ideology, including Islam. Keep asking.

The blind passionate hate that is quite understandable and justifiable in the ongoing conflict, is also a danger to the reason and thought that is essential to survival and eventual victory.

          Sorry, but another WWII example. Hitler cancelled Operation Sea Lion because of an irrational ambivalence and delusion regarding GB. The losses he would have suffered by conducting the invasion would be paltry compared to the losses suffered in attacking the Soviet Union, or the losses GB and the US inflicted in their bombing of Germany. I might add that had the Luftwaffe concentrated on radar and other air defenses, air fields and airplane manufacturing plants, they could have obtained the air dominance they wanted. But how do you obtain air dominance by bombing cities? You don’t. How do you obtain victory over an enemy where thought is poison, by thinking every step of the way to victory, without the cataracts of hate.

          Frank–with respect–I don’t believe that there is anything blind about hating the rape of children, and any creed that condones it. Nor do I believe that righteous indignation over evil gives our enemy an edge.

          We are close enough in agreement that I would not want to burden the discussion. There are some responses that I could make that might give a clearer picture of my example. We certainly agree that this evil must be defeated, and are both seeking the ways to bring it about. Please accept that I have had to fight my own almost overwhelming hate in guiding a war against corruption that started in 1982. By learning over all that time to “subdue my passions. . .” I made increasingly better presentations that absolutely humiliated and exposed the corrupt for who they are. It was fun to do and even more fun that I shared it with others to continue. Sincere Best Wishes.

      The court shouldn’t be allowed to accept culturally acceptable defence. What is acceptable in other countries has no bearing on what is acceptable here. Our laws should not bend to accommodate any other laws.

The Liberal dedicated judges who stand to become the unbreakable majority if the next election goes to their favor, will destroy and water down the stand-alone authority of the Constitution and prior decisions that are now considered binding by a doctrine called stare decisis, “stand by the decision”.We have much to fear from the coming election.

I believe there is a movement in history, as demonstrated by Christianity and Judaism, of self-analysis, reform and progress. There is no such movement, nor can there be in Islam.
