Victory: Texas judge dismisses Clock Boy’s defamation lawsuit against critics of his “hate crime” hoax

“During the lengthy hearing, Judge Moore pressed Mohamed’s lawyer, Fort Worth attorney Susan Hutchison, to provide any facts that would suggest that Hanson and the other defendants had said anything false or defamatory about Mohamed or his son during the television broadcasts. After spending a painfully embarrassing 15 minutes flipping through reams of paper, Mohamed’s lawyer was unable to provide any such evidence.”

Islamic supremacists traffic in intimidation in attempting to silence their foes and all critics of jihad terror. Far from being “defamed,” Ahmed Mohamed was showered with adulation from “Facebook founder Mark Zuckerberg, Democratic presidential candidate Hillary Rodham Clinton and Google co-founder Sergey Brin,” while “Tweets, think pieces and daytime TV segments were dedicated to dissecting how Ahmed’s situation typified racism and Islamaphobia [sic] in America,” and he “visited the Google Science Fair, met with Sudan’s President Omar al Bashir, posed with the queen of Jordan at a United Nations Summit, appeared on the ‘Doctor Oz’ show and last night, made it to the White House.”

Ahmed Mohamed became the darling of the political and media elites and met Obama. He was celebrated everywhere as an innocent victim of “Islamophobia.” He became an international hero. This defamation lawsuit was a naked attempt to continue the intimidation efforts that his clock represented. His clock, which looked like a suitcase bomb, was a strike against the dictum “If you see something, say something”: after Ahmed’s clock, school officials and others will think twice before committing career suicide by questioning suspicious behavior by Muslims. After that, Ahmed and his family moved in for the kill, trying to intimidate people into not even daring to criticize Muslims who engage in these intimidation tactics, for fear of being slapped with a lawsuit.

“Victory!,” American Freedom Law Center, January 10, 2017:

Following a nearly three-hour hearing held yesterday in Dallas, Texas, newly appointed District Court Judge Maricela Moore dismissed a defamation lawsuit filed by Mohamed Mohamed on his own behalf and on behalf of his 15-year old son, Ahmed Mohamed.

Ahmed is better known as “Clock Boy” for bringing a hoax clock bomb to his Irvine, Texas middle school in September 2015 and causing a bomb scare that led to his arrest and suspension from school.

The American Freedom Law Center (AFLC) filed the motion to dismiss, along with local counsel Pete Rowe, on behalf of the Center for Security Policy (“CSP”) and Jim Hanson, two of the defendants in the defamation case, which also named as defendants the local Fox affiliate, Glenn Beck, and Beck’s production company.

Mohamed had sued Hanson and CSP for statements Hanson had made on Beck’s program about the connection between the Clock Boy hoax bomb affair, the attendant media frenzy created in large part by his father Mohamed, civilization jihad, and the Counsel on American-Islamic Relations (“CAIR”), the Muslim Brotherhood-Hamas front group in the United States that promotes civilization jihad.

During the hearing, AFLC co-founder and senior counsel David Yerushalmi explained to Judge Moore that the purpose of the lawfare-driven lawsuit was to intimidate into silence those who might comment publicly on the connection between jihad, terrorism, sharia, and Islam.  As such, Yerushalmi argued,

“This case is a classic Strategic Lawsuit Against Public Participation or ‘SLAPP’ case and should be dismissed.”

During the lengthy hearing, Judge Moore pressed Mohamed’s lawyer, Fort Worth attorney Susan Hutchison, to provide any facts that would suggest that Hanson and the other defendants had said anything false or defamatory about Mohamed or his son during the television broadcasts.

After spending a painfully embarrassing 15 minutes flipping through reams of paper, Mohamed’s lawyer was unable to provide any such evidence.

At the conclusion of the hearing, Judge Moore took the matter under advisement but informed the parties that she would rule by the end of the day.  Today, the Court published Judge Moore’s ruling dismissing the lawsuit against Hanson and CSP with prejudice.

Upon leaving the courtroom, Yerushalmi explained:

“This lawsuit filed by Clock Boy’s father is yet another example of Islamist lawfare, which is a component of the Muslim Brotherhood’s civilization jihad.”

Yerushalmi further explained that the purpose of such lawsuits, formally labelled Strategic Lawsuits Against Public Participation (“SLAPP”), is to intimidate into silence those who might comment publicly on the connection between jihad, terrorism, sharia, and Islam.

Yerushalmi added:

“The Islamists employ the progressive mainstream media to label any public criticism of a sharia-centric, jihad-driven Islam as ‘Islamophobic,’ and they add fear and financial ruin to the equation by utilizing the legal system to file SLAPP actions,”

Now that the lawsuit has been dismissed, AFLC will petition the court for its legal fees and will seek sanctions against both the plaintiff and his attorney.

Robert Muise, AFLC’s other co-founder and senior counsel, made clear:

“AFLC was formed in large measure to take on Islamists like CAIR who use and abuse the legal system with their cynical form of lawfare to undermine our constitutional liberties—notably free speech.  We have confronted these lawsuits across the country in federal and state courts and have defeated CAIR and its minions at every turn.  When appropriate, we have won sanctions.  This lawsuit will be no different.”

      His defence lawyer should be disbarred.

        The lawyer was doing his (or her) job- regardless if he or she believed in the case.

        The Plaintiffs, HOWEVER- SHOULD PAY COURT COSTS; OPPOSING COUNSEL FEES AND A PENALTY. And, a very stiff one. And, then the plaintiffs should go back to Qatar of maybe Pakistan.

          I’d say the lawyer should be suspended for plainly being no good at her job.

          How can you go to court alleging that your client has been wronged in word or speech by a third party, and not have a single example ready to show that anything untruthful has been printed or said ?

          I imagine that she thought that her clients were on such a roll after all the publicity and celebrity endorsements, that all they had to do was turn up, and the court would bow down before them.

          There’s been lots of comments about action being taken against The Caliphate Kid’s family for costs, but I am expecting the next legal action to be that family suing their lawyer for loss of income due to her negligence.

          Not forgetting the press conference where they claim that their lawyer and the court system is guilty of discriminating against them.

          They could always try for a photo-op with Trump ? Him waving them off on that flight back to Arabia would be a storming start to his Presidency……

          Phil–I agree that the lawyer SHOULD have prepared her case better. \Perhaps (I once, a few decades ago, did some work for two attorneys,) and occasionally the client(s) will tell the attorney not to use something that would be in their 9 the client’s) favor- for whatever reason.

          In this case, where the court gave the attorney time to find the evidence- he or she screwed up. But, perhaps they ( the client/s) felt that this was NYC or Washington DC or LA or SF- and jsut being a ‘minority’ and against the big, bad government is enough to guarantee a windfall.

          Hope they go to Pakistan or The Sudan (or Qatar, if that is their only other choice)–but just get out of the US

      Unfortunately, there’s still a problem.

      Assume the AFLC is completely successful, and CAIR has to pay not only the defense’s attorneys fees and expenses, but a punitive damage as well.

      It will not materially damage CAIR at all, because CAIR has vast resources available. Losing is embarrassing, but not in the least damaging.

      On the other hand, any victim of CAIRs warfare lawsuit is not assured of AFLC support, and is not assured of having the case dismissed and is not assured of victory. CAIR typically files for ruinously large damages. So, the victim stands to lose substantially, if not ruinously, and CAIR, under the worst circumstance possible for it, just has an embarrassment. And, you can’t really embarrass Muslims engaged in jihad: they have no shame and no conscience.

      What it comes down to is that AFLC is fighting a retail rear-guard action against wholesale intimidation of non-Muslim critics. The legal system, like the political system, simply does not cope well with identity politics and kamikaze tactics.

        The muslim ‘mind’ can’t take dishonor. That’s what they think of every single court ruling which goes against them, so when you win one high-profile case-as here-TONS of muslim heads simply…explode.

        I see your point, but think you have overlooked the most obvious thing that CAIR does not want, aside from humiliation, and the most VALUABLE to Counter Jihad; publicity. Americans are finally hearing about CAIR, ISNA, MSA etc and their Muslim Brotherhood affiliations, and that is the LAST thing CAIR wants Americans to know about! The more CAIR is on the news, the more people will ask questions. And here is Pamela Geller and Robert Spencer to give answers and truthful answers.

    And this should be the follow up in any such case:

    “Suing for Damages: Malicious Prosecution in a Criminal Case
    Prosecutors who bring criminal cases without adequate justification may be sued for doing so, and may not be protected by prosecutorial immunity if the prosecutors’ actions were egregious enough.”

    A means of draining THEIR resources as an excellent post by an Sikh-JW reader sugested.

    People we should and need to support AFLC financially, I admit I haven’t heard of them until I read this article thanks to Mr. Spencer, I’m not sure if they are accepting donations but if they are we really should give something even if it’s only a dollar, I’m sure there are millions of Americans who feel like me so just a dollar from each one of us will certainly help, remember there are many well Funded alphabet Muslim organizations who are working to, as the head of the White Mosque put it [AKA White House]; “Fundamentally Change America” so we cant let the AFLC die from lack of money, money is not a problem with these anti-Constitution enemies from Hell.

      And his sister, who reportedly had threatened to blow up the school the year before, said she loved Qatar because everyone there was just like her family. Great family, that.

      The government’s slogan, “If you see something, say something,” cam get you in trouble if you say something about a Muslim, no matter what you’ve seen. The teacher in this case who called the police about what looked suspiciously like a bomb, has been persecuted for doing exactly that. Even the Justice Department got into the act, but after all, someone speaking out against Islam is Lynch’s “Worst nightmare.”

      Will it be possible for our country to regain its sanity with a new government? Will the playing field be leveled so that anyone, Muslim or anyone else, who breaks the law will be brought to account? It will take clearing out the Department of Justice of Islamic sympathizers as well as downright Muslims. I think Sen. Sessions is up to the job.

      It’s better than that – not only no cha-ching, but a negative cha-ching (would that be a “cha-chang”?). Under SLAPP, clock-boy and/or his attorney have to pay the defendants’ reasonable attorney’s fees. The only issue is how much.

    This incident was clearly designed to alarm the school teachers and administrators. He should be charged with intimidation but instead was feted and acclaimed. Still not good enough, they file suit for “defamation”.

    Glad to hear this was dismissed but I wonder what percentage of Americans still buy the “boy genius inventor” hoax? Just like the claims of “Islamophobic attacks” are frequently shown to be lies, the corrections and retractions get much less attention than the original accusations. Muslims know this so they keep at it. There should be enhanced charges for fraudulent provocations and false reports designed to foster the image of Muslims (or any other group) as “victims”.

      Slightly off-topic, but it is only in the report of the defamation trial that I have heard that the kid is 15. D

      Does it not show how far the expectations of children’s/teenagers abilities have fallen that anyone should think that there is anything remarkable about being able to assemble an electric clock n the first place ?

      At age 15 years ago, he’d have treated as a young adult, and would have already left school a couple of years ago, and been expected to be capable of working in any number of adult roles with agricultural or industrial machinery, tending livestock, a soldier, deck-hand on a ship etc and supporting the family.

      Now, a teen-age Muslim wants sympathy and public apologies for being (deliberately) unable to catch a bus….

        Bombings in hotels in India, massacres in a Paris night-club, scores killed by lorries driven into crowds,into queues at bus-stops, bombs on the London Underground, the French Metro, journalists beheaded, mass rape in Sweden, 3000 killed in the Twin Towers, shootings at airports…….is none of this getting through to you ? or will you wait to be beheaded before the idea slowly works it’s way through that: “Duh…I fink sumfings going on here….”

    The incident took place in Irving, TX not Irvine. The teachers and other personnel were well within their rights to send the boy home. He was an odd acting kid who was always an outsider. I know this because my daughter goes to the same school where the incident occurred and knew him.

    I believe the only reason the lawsuits and publicity went as far as they did was because there is a huge Muslim community in Irving including a massive Mosque. Tensions had begun to die down when the news of the lawsuits stirred things up again. I am hoping that things will calm down again soon.

      A dismissal with prejudice is dismissal of a case on merits after adjudication.The plaintiff is barred from bringing an action on the same claim. Dismissal with prejudice is a final judgment and the case becomes res judicata on the claims that were or could have been brought in it.
