The showdown over President Trump’s executive order on immigration continues. District Senior Judge James Robart of Seattle has issued “a nationwide restraining order” to block Trump’s order, which restricts immigration from seven Muslim countries – countries selected by the Obama administration — suspends refugee admission for 120 days, and ban Syrian refugees indefinitely.
Lee Gelernt, the lawyer who successfully argued for a restraining order against Trump’s so-called “ban” in federal court in Brooklyn, New York, stated:
The courts have and will continue to recognize that this executive order favors Christians and disfavors Muslims and that is antithetical to American values and flatly inconsistent with the United States Constitution.
This erroneous comparison between Christians and Muslims aims to stir up division and once again reveals the myopia of leftists and the the anti-Trump camp. The reason for the Trump immigration policy is solely national security. How many Christians have been infiltrating the refugee stream for the purpose of murdering Westerners? How many Christians have been raping and sexually assaulting non-Christian Western women and girls all across Europe? How many Christian migrants have been committing crimes and wreaking havoc to the tune of the 46 billion dollars that German and European taxpayers now have to fork over to fix?
There is no discriminatory intent about the Trump order. At worst, it can be described as a drastic measure in a crisis. This obvious point was addressed by White House press secretary Sean Spicer, who said in a statement:

Washington state Gov. Jay Inslee, a Democrat, hailed Ferguson and applauded the decision.
“We should feel heartened by today’s victory and more resolute than ever that we are fighting on the right side of history,” the governor said in a statement. “Thank you to (Attorney General Bob Ferguson) and his team for making the case that no person – not even the president – is above the law.”
Amnesty International also applauded the development.
“This decision is a short-term relief for thousands of people whose lives have been upended, but Congress must step in and block this unlawful ban for good,” organization spokesman Eric Ferrero said in a statement. “Trump’s Muslim ban is in humane, unlawful, and discriminatory, which is why the courts and the public want it to be stopped.”
Ferguson said his team has been working around-the-clock for the last week on reversing the executive order.
“It’s obviously an historic decision and an important one for the rule of law and for the people of the state of Washington and the people of our country. I have said from the beginning: it is not the loudest voice that prevails in the courtroom, it is the Constitution, and that’s what we heard from Judge Robart today.”
The decision is effective immediately nationwide, Ferguson said.
A lawyer with the national office of the American Civil Liberties Union said the decision was significant.
“The decision in Washington reaffirms that the courts will stand up to the president,” said Lee Gelernt, the lawyer who successfully argued for a restraining order against Trump’s ban in federal court in Brooklyn, N.Y.
“The courts have and will continue to recognize that this executive order favors Christians and disfavors Muslims and that is antithetical to American values and flatly inconsistent with the United States Constitution.”….

How many people from the countries banned will enter the USA while this issue is being debated? And if the Administration wins a stay, or wins the case in the end, will those who entered while this case is being debated be deported? I think Trump, if he is able, should clearly state that any who take advantage of this temporary confusion can expect to be deported once clarified in the favour of the Administration so that those contemplating taking advantage of the confusion will reconsider.

The U.S. Constitution and its Bill of Rights simply does NOT APPLY to foreigners outside the U.S. seeking admission, whether as refugees or otherwise.
Within the U.S., the Constitution prohibits religious discrimination as a test for public office – Congress cannot require presidential candidates, e.g. to be Mormons or non-Mormons. Religious discrimination outside this narrow area would probably run counter to general equality principles in the Bill of Rights.
None of these principles apply to non-citizens outside the U.S.
Constitutionally, the Executive Branch would be entirely within its rights were it to insist that henceforth, only African San women of exactly 23 years of age who are practicing Mahayana Buddhists may be admitted as refugees or immigrants. No men, no Bantus, no Hinayana Buddhists, no 24 year olds.
This point – that the U.S. Constitution gives NO rights to foreigners outside the U.S. – needs to be reiterated time and time again, particularly to the vast number of U.S. citizens who know nothing about such matters and do not connect such legal abstractions with what happens in their daily lives.
This is the big whole in the “arguments” of the anti-American totalitarians, and is the reason why Jeff Bezos’ WaPo, Carlos “Slim” Salim’s NYT and their minions on the TV network have been pumping out sob stories unerringly hitting the talking point about “unconstitutional religious discrimination.”

But the stated intent was to protect “religious minorities” in these Muslims countries, the most vulnerable and in need. Protection of the most vulnerable is obviously the whole point. It just happens that in these countries affected by the ban, Christians are the major constituent of the religious minorities.
That statement can be turned on its head by saying that if minorities are not given precedence, the executive order favours Muslims since Muslims are the overwhelming majority. In the end, that statement is just a word game.

These judges are not following the Constitution and are misbehaving. They are disobeying federal law as well. This is what Judge Gorsuch was talking about, judges following their own whims. I believe President Trump must contact the Senate and Congress and ask them to send warnings to these judges that failing to follow the federal and Constitutional laws can bring about their impeachment and then quote to them the Constitution about judicial misconduct. No more of this judicial activism can be tolerated.
The Constitution grants to Congress unilateral and unquestioned authority to set whatever immigration restrictions it wishes, according to Article I, Section 9. According to that section of the Constitution, Congress is free to limit “migration” to persons that “it shall think proper to admit.”
There is, you will note, not even a prohibition against the use of a “religious” test, which is nothing more than an ideological test. First Amendment guarantees apply only to legal American residents, not to people who have never set foot in the United States.
If Congress thinks it is not “proper to admit” individuals whose religion orders them to “slay the idolaters wherever you find them” (Surah 9:5), it is perfectly free to do so. Congress restricted immigration to the Chinese for 10 years in the late 19th century in order to preserve demographic balance. In the 1920s, Congress established quotas based on national origin to preserve the diverse but harmonious unity we enjoyed.
Federal immigration law also includes Section 1182(f) which states: “Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate” (emphasis added).
This is the very section of the law that Trump cited in his directive. He applied it specifically to seven countries of particular jihadi unrest and danger: Iran, Iraq, Libya, Somalia, Syria, Sudan and Yemen. These are countries which have already been designated by the Obama administration as “countries of concern.”
It’s worthy of note that this is NOT exactly a “Muslim ban,” since the directive does not apply to 87% of the Muslim world. Even some countries which ought to be on the list (Saudi Arabia, Afghanistan, and Pakistan) aren’t.
It should not be forgotten for a moment that President Obama himself banned immigration from Iraq for six months in 2011 for national security reasons. Where were the howls of outrage about religious liberty and Islamophobia back then? And let’s remember that Democrat president Jimmy Carter completely banned immigration from Iran in 1980 during the hostage crisis. Where was the screeching then about the Constitution? The silence of the left was deafening on both occasions.

The only problem that I see with it is that the Senate and House are made up of a bunch of milquetoast eunuchs and wouldn’t have the cojones to impeach a federal judge who is usurping their power and the power of the executive branch. Hell, the courts have been writing legislation for decades with nary a peep of objection from Congress.

The critical conundrum and conflict as to where and with whom ultimate authority resides on this issue needs to be addressed at the level of the US Supreme Court. And that’s not their only necessary task at hand.
Any significant ambiguity or lack of clarity in law, conflict in the separation of powers, as well as evident, critical conflict between other laws, including, of course, those of the Constitution, must be resolved by the highest court in the land. The imbroglio of how to deal with islam is moving inexorably in this direction. At least it is now, thanks to US citizens having elected Trump as their President.

Re Donald: I was, after initial caution, quite enthusiastic about him. Now? Let’s see: His presidential decree on ISIS and fighting it…. Wasn’t! Instead, it was a request for a study if ISIS can be fought under those aspects and the legal questions thereto. Well, he may still do, given the Breitbart fellow in his cabinet and that Trump (at least) read JW is reason for hope. In that respect.
I had hope that he would help the ordinary Americans (“rust-belt” etc.), and thus set an example for Europe. So what has he done in that respect? He has appointed four very rich **Goldman Sachs** managers into his cabinet, one of which is an **ex-Soros** man – ex-Soros? Well, everything is possible, it’s just that ‘possible’ and ‘likely’ are two different things. I am sure of course (who says I’m sarcastic?) that those men, as well as some other millionaires and billionaires appointed to his cabinet, will definitely look after the less fortunate Americans, rust-belt or otherwise. Who could think differently? Am I sarcastic or not?
However, he did decree an immigration ban – turned out it was an old one from Obama, oh brother. But he is manly and takes the flak for it.
He will however go ahead with the wall, and he has my wholehearted support; after all, I don’t want the percentage of Euro-Americans to shrink even further. Slight problem, he requires Congress’ OK to finance it. Didn’t he know that? I didn’t, but I am not American, and neither I am an American politician.
At least, he made some changes in staff in a number of institutions, but anything that could be considered to be a drastic change, never mind the purges which are necessary if he wants to succeed, nothing. Likelihood for drastic changes? Take a look at his cabinet…
So, as far as the US, or rather Trump is concerned, I am back to sceptical, and hope that I am wrong.

Hmhhh… Trump’s team has also eased off Trump’s pledge to move the US embassy to Jerusalem. As stated by Sean Spicer. ‘Wonder how Netanyahu is going to take that. Isn’t he supposed to be Donald Trump’s personal friend? It’s OK then, isn’t it?
Back to Europe. He had a chat with Donald Tusk, former Polish Prime Minister and now EU President, and described him as a very pleasant chap. Now he confused him with Jean-Claude Juncker with whom he did not speak, the former Prime Minister of Luxembourg and now the current chairman of the EU-Commission…
But for that, he is firm on Iran, he puts Iran on notice – WOW! Yes, he re-introduced sanctions, no, not against Iran! Don’t be silly. But on a few companies and individuals. If nothing so far has shaken the Mullahs, that will! The question is just this: Shaking with what?

Oh dear. Germany was the worlds leading exporter BEFORE the bloody Euro was introduced, which is a drag on the German economy. And now, thanks to that damn Euro it sank to second or third place. If he really wants to break the Euro, every German will cheer him on, except the left wing/Bolshies and Frankfurters. The Germans want their Deutsch-Mark back, preferably the day before yesterday! There are certainly weaknesses. But your studied political position is one of hatred and opposition to Trump.
It is best examplified in what you say about Israel. Your position is that you expect Trump to come in and being all powerful solve the issue on behalf of Israel. You leave out the independent and revolutionary action of Israel itself which now urgently must come to the fore.
You are totally wrong on this. The arrival of Trump has opened the door to Israel solving the issue itself.
The fact is that Israel does not have the LEADERSHIP in government to do this.
With Trump in charge Israel can right this moment begin to educate the world and all Israelis about the history of the Palestinian False Narrative and in particular tell the true facts about the role of Hajj Amin el Husseini.
Israel is now OPEN to solve the issue and destroy the Palestinian Fascists once and for all.
But it is not going to do so because it is not able.
