Judge refuses to halt Trump’s new immigration order

Judge James Robart, who issued a temporary restraining order against the initial ban in February, declined to apply it to the new executive order. Perhaps he was stung by the criticism: in his first restraining order, he falsely claimed that no jihad terror attacks had been committed by migrants from the countries covered in the ban, when in reality there had been many. Could this be an indication that the hard-Left, out-of-control judiciary is finally having to demonstrate more responsibility? Unlikely, but it’s still a good sign.

“Judge Refuses To Halt Trump’s New Immigration Order,” by Kerry Picket, Daily Caller, March 10, 2017:

A federal district court denied a request to place an emergency restraining order on President Donald Trump’s modified immigration executive order, an attorney representing states opposing the order told Reuters Friday night.

The initial executive order posted by the Trump administration — which restricted travel from seven countries with majority Muslim populations — last January was challenged by lawyers in states such as Washington and Minnesota.

Seattle U.S. District Court Judge James Robart issued a temporary restraining order against the initial policy last month.

The new order narrowed the travel restriction down to six countries and would give exception to green card holders among other changes. According to Reuters, Robart did not apply his restraining order to the new immigration order….

      ‘Judge’ Robart had no authority from the jump, to impose a TRO on the president’s EO. Now we’re supposed to kiss his feet because he didn’t [wrongly] impose a SECOND TRO on the new-and-improved EO? Seriously?

      The Left continually plays this game, and nothing illustrates it more than the recent insanity vis a vis so-called ‘same sex marriage’. They pound away at marriage which utterly ignores the falsity of their underlying premise, that homosexuality is good, normal and in every way identical to gender-at-birth identification.

      They’re playing the same game here, with the same results. Hey ‘Judge’ R.? Here’s your assignment: Revisit the section on Constitutional Law entitled: Separation of Powers. And this time, comprehend it.

        Dear Kathy, you said it. The left only honors their own agenda, and does what they want to do. What they have failed to mention in the media, is that in 1952, Muslims were banned from the US… The POTUS has the right to limit immigration, that no judge has the right to block our presidents orders, and I can not understand one important think. Since when, do other nations and their people override the laws of the US, at anytime?
        Seems like a one world government slugs have lots of friends in our legal system.

      Judge Robart and his “clients” in the earlier case (e.g. the State of Washington) may have reflected that now, with a new sheriff in town, discretion is the better part of valor.

      An Erdogan official or supporter is supposed to have said that Erdogan is hoping to “have a better relationship’ with the “US under Pres. Trump then it had with Obama”. To me, makes little sense- but then again, perhaps Erdogan is wacked out.

      Does anyone know anything more about this? I saw it on a blurb in a conservative blog.

        He was expecting better relations with Pres.Trump but there is very little communication between them. Erdogan tried to use Mr.Flynn and hired his company for lobbying.

        Erdogan thinks that he can convince Mr.Trump since they are both businessman. I hope this will never happen. I presume Pres. Trump team already found that erdogan is the organisator and the brain of ISIS. Turkey is full of ISIS and Nusra members. (I live in Turkey)

        Tonight’s events in Europe (Netherlands) are just a beginning, erdogan is provoking for war, because he and his followers only love madness and blood (classical muslim behavior).

        I will check for news from here about Pres. Trump and erdogan, but I am sure Pres. Trump will never like such a dictator like erdogan.

          Thank you for the details. All I had seen was that he was hoping for better relations with Pres. Trump.

          That is what I found surprising-well, no. Shocking. Obama is a Muslim or at least, a Muslim lover.

          Why would Trump, a Protestant, with three (3) Jewish children (his 2 married sons also converted to Judaism, as did his eldest daughter) and Jewish grandchildren get along better with a Muslim than another Muslim?

          I did not see anything that they had hired General Flynn’s company for some work. (Not to say it wasn’t there, I just did not see it). However, I doubt that Gen. Flynn would have been swayed by that-to any great extent. But, thanks again

It seems Trump is well aware of this fool in Turkey, and is using his wise, advisors to sum up this beast, and deal with him in good time, and handle that fool, as not to hurt our tough fight against ISIS. I think you will see in the near future some policy changes toward Turkey.. TO OUR benefit, for a change!

        Hello Gravenimage, there is a referendum on the 16 of April which may give endless power to erdogan, but about 60% of Turkish people are saying no according to surveys. Now, I believe erdogan is trying to create imaginary kuffar enemies (in this case Germany and Netherlands) to consolidate his followers.

        Interestingly Holland looks pretty strong against him, and don’t want to involve with erdogan’s politics. The most scary part of this incident would be uprising of erdogan supporters in Holland, meaning 350k people and they are devoted muslims. (total population of Turks in Holland is about 500k)

        I hope the world leaders understand erdogan’s motives …

      Yes Emhotep, – what is going on right now between Turkey and Europe – well, that is, those European countries that have a large population of Turks – absolutely should be given attention here on JW – even though our Western (European) media tells us that everything Erdogan is doing has, of course, “nothing to do with islam” – let alone with Jihad.

Now he is trying to provoke 5 million Turks who live in Germany and Netherlands to get their votes for the referendum. As it is known, Turks have dual citizenship in Europe and they can vote at the consulates for Turkish elections. Erdogan can do anything in order to win this election and somehow Turkish immigrants love him and they enjoy when erdogan says Germany and Netherlands are Nazis..

        He is extremely bad for my country and even for the world. He is one of the keys for the Jihad terror.

          Fully agree with you, Emhotep, unfortunately so many here in Europe don’t have a clue about all of this.

          – If the turkish population do start to act up here in Europe – like we already saw them doing after the #fakecoup, people’s eyes might finally be opened…

          – Also, this whole situation aptly demonstrates why it is such a very bad idea to let immigrants keep two passports. They should be forced to make a choice. – Either your loyalties are with the country you migrated from, or with the country you’re living in. These turks should be able to EITHER vote in the countries they live in OR in Turkey. Never both.

          To let them have two nationalities was the biggest mistake to begin with.
          Now see what you get.

      It is unbelievably stupid for the EU to allow dual citizenship. It is an open invitation for foreign shadow governments to form in the EU states. When a foreign leader comes to your country to drum up votes for elections in his country, your sovereignty is questionable.

      America has seen the equivalent; undocumented illegals demonstrating for the rights of citizenship while waving the flag of Mexico. The message seems to be the same: We hate our host country, now give us what we demand.

          Dual citizenship happens because sojourner from country A, which has jus sanguinis citizenship (citizenship transmitted by a parent) gets married and has a kid in Country B, which has jus solis citizenship (citizenship by birth in the country). This is why Sen. Cruz, the son of a stateless Cuban refugee and an American who were resident in Canada due to employment in a transnational firm had both US and Canadian citizenship at birth. As a matter of fact, there are scads of Americans and Canadians in this situation due to the fact that Americans and Canadians are often resident in each others’ countries due to study, business reasons, and others. There are also lots of people with dual US-Mexican nationality and other dual nationals for other reasons.

          It is also why, when serving as a vice consul in Thailand, I had to tell some graduate students seeking to enter the USA on student visas in order to pursue studies that they had to go across the hall to settle citizenship claims; since they had been born in our country while their fathers (accompanied by wives) were in the USA pursuing graduate degrees. Thai law says that if you’re father is Thai, you are Thai; the Fourteenth Amendment to the US Constitution says that if you are born in the USA and your parents are neither visiting heads of state, in diplomatic status, nor part of an invading army, you are an American.

          This is also why both of my sons are US citizens by birth, despite having been born when I was working overseas (when the elder was born, I was a teacher, not a diplomat).

          Dual nationality will always be with us as long people live and work in other people’s countries for longish periods of time–usually as a result of peaceful conditions that are mutually beneficial to both countries.

          I will also add, that had things turned out a little differently and I had pursued my whole life’s career in Taiwan in teaching and/or business, and had my son decided he could stand a couple years’ military service there, I would not have raised my children to be rebels there. Nor do I suspect that Sen. Cruz ever harbored any idea of turning the USA into so many more provinces of Canada.

        I tend to disagree. Many American ( and I would guess European) Jews hold dual citizenship ( second one being Israel) and two passports (again, second one being Israeli)- in case of the rise of Nazism or similar- rather than the disaster when shit like Papa Joe Kennedy (father of JFK & Robert & Teddy) refused to help Jews get to the US. (He was Ambassador to Britain, and, before Churchill-under Chamberlain-Britain was not friendly to jews from Europe. Then again, neither was FDR).

      While I am sympathetic to Mr. Trump’s EO, and see it as issued from within the parameters of his Constitutionally mandated powers to execute laws passed by Congress, I will note that “running the country” is not the President’s job. We in the USA have something called separation of powers with checks and balances, under which power is divided between Congress, President, and Courts in order to prevent any one person or branch of the government from wielding too much power.

      I don’t believe Iraq is “making progress” at all. Not only is the government predictably corrupt, heavily influenced by Iran, and riddled with Shari’ah, but it is also in something of a stalemate with the appalling Islamic State, which has overtaken large chunks of the country.

      Still, even seeing a moratorium on immigration from the other six countries into the US is still a fine thing.

        All Muslim countries in the ME ( and probably elsewhere) are very corrupt.

        Other governments, I am sure, are also. However, in my opinion, the most corrupt ( and also least advanced economically, educationally, etc) are Muslim and African countries.

        I am NOT saying that there is no corruption in Europe or the US- there is, but, again-my opinion-at a lesser level.

        And, as to Iraq- the news was that they were making headway against ISIS.

        (I would like to see- as would others, I am sure, ISIS & Al Queida go and attack Iran and Hezbollah, and have massive battles– with thousands (if not tens of thousands) of casualties on each side. Would make the world a much better place.

      Appellate courts – even the Ninth Circus – rarely overturn the DENIAL of an injunction. However, Robart has given himself some room for maneuver by insisting that a fresh petition would need to be filed.

      Robart’s wife is said to be a Swedish artist. That factor could work either way.

      Some of the biggest complainers were from Iraq and some, supposedly, had *helped* the U.S. military and had been given visas to get in, but were held up at the airport and were making a big boohoohoo about not being allowed in when they considered all they had done for the country and some of their family members were already here.
      That is what I read on other news sites as the *reason* iraq was removed from the list.

        That (re Iraqis who helped the US military)– the US has a history of screwing locals who helped them.

        In Viet Nam, did it to (ignore, and left to be executed) some but took in others from Laos, Nam and Cambodia. My view, should have taken in more- they are industrious and, generally, pretty law abiding and exceptionally good students.

    Whatever the judge’s motives, this is *excellent* news! I hope Trump is able to expand the list of countries–these are hardly the only ones that present a threat, as many have pointed out–but even if this goes no further, it is bound to make us considerably safer.

    I also hope its success inspires those in other countries–in Europe, Canada, and Australia especially.

    And just so good to see such good news in such mad days. I’m so glad that Trump did not just give up after his first set-back–certainly, this is what George Bush did when his very similar plan met with Leftist criticism after 9/11. How many lives might have been saved if this moratorium had been in place for 16 years?

    It is very, very important to understand the Arab colonialist concept of “migration” jihad. In order to conquer the world, Arabs use deceit to use immigration and refugee opportunities because they know they can easily outnumber the conquered in a generation or two after they settle into western societies. All financed by Arab oil revenues. This explanation should have been included in every news article covering this issue.

      Dov, it would only be included in every article, if the goal was actually to protect countries from the Muslim threat. No point in laying their cards on the table for all to see until your bluff is called. And it will never be called by mainstream media or mainstream (almost all) politicians. It is up to us to do as we’re doing, wake up, help others wake up, support people like Robert Spencer, and hope to the heavens that people like Donald Trump, Marie Le Pen, and others who see what’s going on, help citizens to take their countries back. As you said, ‘migration jihad’ is an important part of their ‘religion.’ Great rewards for those who travel great distances in the name is spreading Islam. No intention of assimilating; rather, the explicit goal of destroying the countries in which they come to live.

    Judge James Robart will now be passed over for promotion, since his judgement was questionable. There is a difference between fantasy and reality or feeling and fact that is lost in heavy pot-smoking states like California and Washington.

    The fact of the injunction is that it is based on political realities in the seven (now six) countries mentioned and which do not obtain in the other 47 (or so) Islamic-majority countries. Therefore, the injunction is not based on religious discrimination.

    Does anyone here really believe that the EO will stand?

    It has no chance. Trump knows this and wants a big showdown. Probably necessary and better to have at the beginning of the eight years.

    I’d suggest, that Donald Trump learns fast.

    If you really don’t know how “the system” works (and why would Trump know that?) then give it a poke and see what happens.

    That was Trump’s first Immigration Ban, Executive Order.

    This Second Executive Order is apparently a lot more cagey.

    Trump covered all the bases he’d missed in the First Executive Order and left the Left with nothing legally to stand on but lots of popular criticism in opposition.

    Trump is a “player”.

    That is what Conservatives have lacked for way too long.

    We’ve had plenty of pontiffs and pundits, but no one who could go one-on-one with Democrat Aliniskyites, who are really nothing but political tacticians with no ideological substance, at all.

    Fact is, historically speaking, winning is all of it in politics, and in its accomplice, war.

    Donald Trump is a Winner who likes to Win.

    Bless the Losers and the Victims, all you want, but Losing doesn’t amount to anything but Submission, until Creatures wiser than human beings are rulers of the Earth.
