Agree. A lawsuit against the FBI seems the right thing, but WHY should we have to beg the government to defend our freedom of expression when they have ALREADY taken an oath to do so.
What happened in Garland was an intentional dereliction of duty and it should be punished.

Mr. Warren, from the certainty of your statement you may be a mature lawyer who just has not read Bivens v. Six Unknown Named Agents of the Federal Bureau of Narcotics, 403 U.S. 388 (1971), which I believe has not been overruled or modified. While the government may be immune or subject to limited claims, the agents and employees are not and can be sued. The same holds true for state employees under Hafer v. Melo, 502 U.S. 21 (1991), also to the best of my information still good law.
If you are not or have not been a licensed attorney, what you see on television is not a substitute for law school, a law degree, at least 1 bar exam passed, and license fees paid and CLE in accordance with your state bar rules. That is why consulting a lawyer can really help “foot in mouth” disease for those who can listen to sound advice.
In another post I explained why suing the government is an expensive approach. Any experienced lawyer in claims against federal agents who would take the case against either the government, the individuals or both would probably need MAJOR money up front to cover fees and expenses. Very few people have that kind of money that they are willing or able to put up; so very few cases actually get filed. Mr. Spencer would probably need to “pass the hat” to raise enough money to fund a lawsuit that could easily take 10 years and cost ????? amounts of money. I would certainly do what I can to help; but that would be nowhere near all that is needed.
I don’t think a million dollar deposit up front would be unreasonable. That’s about what Sheriff Joe Arpiao wanted to raise in the suit where the DOJ argued without any legal support enforcement of federal law is the EXCLUSIVE province of federal agents. I think DOJ lost when the court was made aware of In re Quarles, 158 U.S. 532 (1895) and about 24 other Supreme Court cases citing Quarles, to the contrary. Whether any or all of that deposit would be recovered from the defendants is uncertain, much less any money over that. That’s where the “bad guys” know they have us “over the barrel”.
Plus there is still the Court of Appeals case (DC Circuit?) that says law enforcement officers have no enforceable duty to protect an individual from crime. Every cop and agent in the jurisdiction can stand and watch our being murdered, do nothing and be free of civil claims (suits). The NRA probably has a great deal of information on this case involving the holding, beating and raping of a number of women by a gang in DC while police essentially stood by and watched. Be very glad when police officers actually protect you: They do it because they want to; not because the law requires them.
In spite of that last case, a suit filed to overrule or extend the present law is permissible under applicable rules. A currently licensed and practicing attorney can provide the best advice on what to do next. There is a statute of limitation to file claims.

ADDITIONAL THOUGHT: An attorney when considering Spencer’s case might consider whether it can be distinguished from the DC case because of the law enforcement participation and encouragement of the attempted crimes instead of simple failure to perform. A review of the Tarasof v. Board of Regents, 17 Cal. 3d 425, 551 P.2d 334 (Cal. 1976) might provide some meaningful arguments to make a case survive a motion to dismiss for failure to state a claim for which relief can be granted.

Strongly agree. If nothing else, it will help to publicize it. As far as Steve’s question of “Who do you go to with this?” it would seem, sadly, the only option is the American people – whose job it is then to pressure their elected representatives for proper recourse. It is an uphill battle fighting corruption in our or any government, but as with the passage of JASTA we have seen justice is not impossible.

I just wrote a rather lengthy post abut the death of Dorothy Kilgallen, a journalist who said she had the proof that Oswald did not kill JFK. She was found in bed, dead in a bedroom she never used in her townhouse. She was the only journalist There was much more, but mysteriously my post just disappeared. It also mentioned the deaths of Vincent Foster, Ron Brown and Breitbart.
Coincidence? I don’t know but I do know our government stops at nothing. My computer was blocked for five minutes

Carolyne, this happens all the time to me. I have a Nexus tablet, made by Google, and darnit! I KNOW they have the algorhythm to screw with my posts! I will try to share and all of a sudden Imget a message that says, “Chrome has times out” or some other notification and then my share won’t happen, no matter what I try.
And I know this sounds very paranoid, but a while ago, I dialed a number of a friend to talk, and before it started ringing at her phone, I heard clicks and a buzz then a guy answered saying “control room”, then he said, “oh shit” and then my phone went blank. I really think we are being monitored more than we assume.

This is evidence of a crime committed by the fbi agent. If this is a bank robbery gone bad and the prosecutor had such video, cell phone and other evidence of the accomplice taking part and fleeing the crime scene before being stopped and detained by local law enforcement near the crime scene, the criminal would be charged and faced a trial in the court room. Yet, nothing was done to the fbi agent in this case. Sickening.

As level headed as Robert Spencer is his accusation against the FBI must be taken seriously. Under cover cops were on the scene while Malcolm X was being assas inated and did nothing to stop it. The fact that an under cover FBi agent was on the scene during the attack is proof that the FBI knew that something was being planned. The muslims should have been arrested on grounds of conspiracy before the Garland attack.
This is another indication that agencies that are supposed to protect “we the people” are lax if not traitorous. Look at the security lapses around Donald Trump. When will his survival instincts kick in and realize that he must move against rouge elements now? No time for multidiemnsional chess, traps or tricks. Trump is the victim but the American people are the target.

This also may be due to diversity hiring….maybe the driver was actually a muslim and Comey was deceived that the agent would put his job above his faith. This is why it is so important to understand sharia law since the event was about drawing the prophet considered slander, it may have tipped this agent to his higher allegiance. This shows the problem about diversity. It does seem crazy he sent a text to the jihadist.

I agree that Comey is a “Dirty cop.” He excused Hillary Clinton because she didn’t intend to violate the law. Lack of intent is not a defense. Of course he did this on the orders of Loretta Lynch who met Bill Clinton in a clandestine meeting on her airplane on the tarmac in Arizona. The fix was in. The fix worked. Both John’s, please check out the Federal Tort Claims Act and other possible avenues as far as suing the government agency, which will be defended by the unlimited resources and retaliatory possibilities of the government. Compare that to claims and suits against the individuals under Bivens and 42 U.S.C. Section 1983. A currently licensed and practicing lawyer with experience in plaintiff’s cases against federal agents and agencies might be able to inform potential clients of the risks, costs and potential benefits of making claims that stir genuine outrage. Suing is expensive. Winning is HARD. Recovering is a problem. Just because there is a claim that can support a suit does not mean money in excess of the expenses and fees will be received for the plaintiff’s effort..

Why were Obama and Clinton not impeached or charged with all or some of the many offences they committed, or investigated for some very nasty criminal acts that were mysteriously linked to them.
Yet Trump is being abused, challenged, and prosecuted for everything the left can set their imagination to, to the point of being serious harassment and even treason.
