Ireland: Muslim suspected of terror links won’t be deported, could be tortured back home

“Algerian man with suspected terror links wins injunction preventing deportation,” by Aodhan O’Faolain, Independent.ie, June 9 2017:

An Algerian man who was recently arrested by Gardai on suspicion of being involved in terrorism has secured a temporary High Court preventing his deportation from the state.

The man who has been living in Ireland since 2012 has challenged the deportation made against him over fears he may be tortured and subjected to inhuman and degrading treatment contrary to Article 3 of the European Convention of Human Rights if returned to Algeria due to his “imputed political opinion.”

The man was tried and acquitted of a terrorist offence in Algeria in 2009. In recent weeks he was arrested and detained by the Gardai in Dublin, before being released.

The man, who cannot be identified for legal reasons, denies he has any “connection or interest in terrorist activities” and says he is a “peace loving person.” He is currently in custody on foot of the deportation order.

At the High Court on Friday lawyers acting for the man sought permission to challenge a decision made by the Minister for Justice on April 28th last to issue a deportation order in respect of the man.

The man wants the deportation order quashed on several grounds including the decision is irrational, and that irrelevant considerations were taken into account by the Minister.

It was also argued that the Minister did not properly examine the risks that might be faced by the man upon his return to Algeria.

He also sought an injunction preventing his deportation on the basis he fears he will be tortured if returned to Algeria….

Seeking the orders the man’s barrister Paul O’Shea Bl, instructed by Travers and Company Solicitors, said the man arrived in Ireland in 2012, having left Algeria a year previously, and applied for asylum.

In his application the man claimed he worked for an Algerian charity, whose head supported Al Qaeda in the Islamic Maghreb in Algeria.

Arising out of the his former bosses activities the man says he was arrested, detained and tortured by the Algerian authorities.

Following his release he claims he was approached by terrorists wanting him to join. He also claims that the Algerian secret service also approached him and asked him to work for it as a spy.

When he refused to do so he claimed the secret service harassed him.

The man’s application for asylum was refused in 2013….

Counsel said it was accepted that the man had “not behaved well” while in Ireland. The man had been involved in a marriage to an EU citizen which was found to be a sham.

Arising out of the marriage he had obtained certain residency rights, which were subsequently revoked by the state.

Quoting several reports from various bodies, including Amnesty International, counsel said there was sufficient information about Algeria to show it was arguable his client is at risk of being detained and ill treated on his arrival back to Algeria.

The man in a sworn statement to the court said that fact he was tried for terrorism offences in Algeria coupled with the fact he was arrested in Ireland would draw the Algerian authorities attention to him….

He said that he believes that if deported he would most likely on arrival “be taken into custody and mistreated” in one of “the notorious places of detention” where the Algerian authorities “are known to carry out with immunity acts contrary to the ECHR.”

    The Irish have become SUICIDAL. The Irish have succumbed to the STOCKHOLM SYNDROME.

    Algerian terrorists belong in Algeria, and NOT in Ireland. Let Algeria deal with its own terrorists.

    Ireland has a SURPLUS of terrorists already.

      India might be able to conquer Nepal, but Nepal presents no threat to her, and this would be unprincipled aggression.

      And good luck taking over Pakistan and Afghanistan–that would do nothing but increase Jihad in India, which is something no sane person wants.

      But pnr has never been particularly sane–for one thing, he wants to being back Suttee–burning women to death.

      He also appears to be confused about the differences between medicine and law.

    This piece of shyte and all the other so called ” asylum seekers” have been well primed by the ” hug a refugee” brigade in giving the correct answers to immigration authorities

    They are all fleeing for their lives and will be raped, tortured, imprisoned and executed if they are returned to whatever shithole they ran away from.

    Every one of them knows that howling ” human rights” is their ticket to a life of FREE.

    FREE housing, FREE healthcare, FREE money and the FREEDOM to carry on biting the hands that feed them at every opportunity.

      As a proud Irish woman, having visited Dublin recently, I could not reconcile the sight of hijabis on the street. Yet again, there is not an ounce of gratitude and zero knowledge of the land and history, just another place to parasite off. Identity Ireland, a small but utterly necessary political party. Maybe the great Robert Spencer could interview Peter Mc Loughlin and get the low down.

    He admitted to breaking (at least one) law(s) ( sham marriage). His attorney said that he has “not behaved well” while in Ireland.

    And his application for citizenship was turned down in 2013. What has happened from 2013 until now that has changed?

    But, then again, some years back (I forgot which Bush was President) the Vatican didn’t want to send back an AMERICAN PRIEST WHO HAD BEEN FOUND GUILTY OF NUMEROUS CHARGES OF SEXUAL ABUSE UPON CHILDREN (in Arizona); with his lawyer using the reasoning, “Arizona prisoners don’t like pedophiles, and he might be beaten or killed”.

    The Vatican judges bought it.

    So, this Algerian using (basically) the same line.

    If he cannot be sent to Algeria (or Pakistan, Syria, Iraq, Iran, Chechna, or other great Muslim locales,)-in my view, better in Ireland than the US

    The bleeding hearts of Irish justice have just turned an Algerian Scorpion loose in the Emerald Isle.
    The Algerian needs to be informed that he won’t discover a large haul of the precious emerald stones in Ireland. The rich green of Ireland has to do with its beautiful topography, at least for now. A few more Algerians could change that!
    But, Russia has lots of emeralds, except Russia would more than likely refuse the Algerian. In Russia’s case, it was wise enough to brush-off the EU, consequently the EU can only dictate to its members to overload on Muslim law breakers and free-loaders.

    My beautiful country has already seen its share of bloodshed in many past wars, we do not need a foreign and uncivilized representation in Ireland. For those in Ireland who believe – out of the goodness of their hearts, that assisting these demonic presences in any way is a positive step, I would suggest that you consult your news stories, past and present, of the slaughtered our Islamic losers have left in their wake – most recently in the Philippines against a loving and Christian people. There is NO country on the planet where these crazies have occupied,that is at peace – they are like African bees, they attack and kill all who are unlike themselves. Presently, the body count of Christians killed in the Middle East is roughly one hundred thousand. Ireland is enemy number one presently – why? It is a Catholic country. Catholics elsewhere, and Christians everywhere, have attempted to encompass these wretched bearers of death – to their cost, they now lie dead. Do not let Ireland follow this path.

      I’m Irish and I can tell you that yes, a lot of public life is dominated by Left wing extremists, but that’s the same across a lot of the West. The majority of Irish people don’t support those types, that’s why there has never been a left wing Govt in this country. The same cant be said for the French, who have willifully voted in far leftist who then set about ethnically cleansing them…

    On their own head be the consequences of their misguided empathy. This person and many others like him would not hesitate to torture and kill, or facilitate the torture and killing, of as many Irish people, including children, as possible.

    I find it incredible and so stupid what goes on regarding people with known terrorist ties or affiliations and how authorities bend over backwards to not do anything about them, rather facilitating their radicalization by failing to act.

      ” Human Rights” is a billion pound, tax payer funded, business in Britain. British “Human Rights” lawyers are the equivalent of ambulance chasers in America.

      That revolting piece of shyte, Sheri Blair ( Tony Blair´s wife) made tens of millions of pounds, fighting tooth and nail, to keep some of the worst criminal and terrorist scum in Britain.

      Oh yes, it was Tony Blair that signed Britain up to the European Court of Human Rights, paving the way for his wife to rake in countless millions of taxpayer money.

      How those two freaks can sleep at night is beyond me.

    I think people need to relax, this is a reprieve for one week, if you read the judgement, you would read that the Judge ruled that the deportation order was valid and appropriate but gave the jihadi an opportunity to appeal that ruling. The same process occurred in the case of the Jordanian who was successfully removed a few months ago. If it is decided that we must keep the piece of dog dirt who hates us and would happily kill our children, because he is at risk in his home country, as a result of his own toxic murderous belief, then we have a problem… I would imagine, give the link between Ireland and one of the London bridge attackers, that the Courts will allow this dog’s removal

    BTW, I read these websites and all I read is impotent anger and rage. Everyone just talks and does nothing. Like the Nazi’s, Islamists are not going to just go away, they have to be defeated. Our Govts are unwilling to do what is necessary, due to the poison that is the Left. We are learning the same lessons as those that went out to fight in WW2, WW1 and the Easter Rising, freedom requires sacrifice, pain and death. To obtain and protect it, you must be willing to fight AND die for it… That is a simple truth, that the West needs to relearn….
