Mohamed Noor was on the force because he was a Somali Muslim. He was in way over his head. The story he has concocted to explain his killing of Justine Damond is already unraveling.

Minneapolis police officer Mohamed Noor who fatally shot Ms Damond, 40, will be compelled to give a statement to his department as part of an internal investigation.
Officer Noor hasn’t spoken with state investigators and doesn’t have to.
Howevever, the police department’s internal affairs unit can compel him to give a statement as part of its own investigation, and fire him if he refuses, said Minneapolis defense lawyer Joe Friedberg, who isn’t involved in the case.
That statement cannot be used against him in any criminal investigation.
Mr Noor hasn’t provided his explanation for what happened on Saturday when he fired a shot from the passenger seat of a squad car, past his partner in the driver’s seat and killed Ms Damond who was standing outside the vehicle.
According to the state Bureau of Criminal Apprehension, his partner, Officer Matthew Harrity, told investigators he was driving in the alley with all of the vehicle’s lights off when he was startled by a loud noise….
A lawyer for cop Matthew Harrity says ‘it’s certainly reasonable’ that his client and his partner thought they were being ambushed when Justine Damond was shot.
Fred Bruno, Mr Harrity’s lawyer, told the Minneapolis Star Tribune that his client and Mohamed Noor, who shot Damond, may have been spooked by a “loud noise” before the Australian woman approached the police car.
“It’s certainly reasonable to assume that any police officer would be concerned about a possible ambush under these circumstances,” Mr Bruno said. “It was only a few weeks ago when a female NYPD cop and mother of twins was executed in her car in a very similar scenario.”
Mr Bruno was referring to New York City police officer Miosotis Familia, 48, who was killed earlier this month by a mentally ill man as she sat in her police car.
Noor’s lawyer, Thomas Plunkett, did not immediately respond to a request for comment….
The declaration came as a preliminary investigation by Minnesota’s Bureau of Criminal Apprehension revealed Noor and his fellow officer had been startled by a loud noise in the seconds before she approached their car and was shot.
Mr Harrity, 26, who was driving the Minneapolis police car responding to Damond’s 911 call for help late Saturday night, described the last moments of Damond’s life to investigators.
He said the loud noise — which was possibly fireworks, according to police radio — came just as Damond walked to the squad car he was driving, around the corner from her home.
Officer Noor, 31, fired through the door of the car, and killed Ms Damond, 40, with a single gunshot to the abdomen.
Harrity was reportedly stunned when his partner opened fire.
Friends of Noor’s told the Daily Mail that he was “startled” by Damond when he opened fire.
His version of events, told by friends on the basis of anonymity, lined up with what Harrity told investigators.
However he has been criticised for not providing a statement to investigators.
News Corp spoke to half a dozen residents who were in their houses around the crime scene on Saturday night and none had heard the gunshot or any other loud noises that sounded like fireworks. One resident a block from the scene, waiter Tom McConnell, said however it was common during the current summer holidays for fireworks left over from the recent July 4 celebrations to be set off on weekend nights….

carpediadem – I don’t remember where you are, but in the USA, the 5th amendment of our Constitution gives us the right to remain silent, the right NOT to incriminate ourselves. Hence the Miranda warnings required (as of rather recent, sometime in the 60s?) to be given immediately upon arrest. Nothing the prisoner says before being given the Miranda warning can be used against him in a court of law. The arresting officer has, in fact, to go further, and to ask the prisoner whether or not he or she has understand the right described in the Miranda warning and get him to answer in the affirmative..

He does have to answer his police department’s Internal Affairs questions or be fired for refusing if they decide to pursue that route. But his statement can’t be used against him in a criminal prosecution. So, they may already have his statement, but aren’t admitting it to the public.
The US Supreme Court in Garrity v. New Jersey, 385 U.S. 493 (1967) held in a 5-4 decision that “the option to lose their means of livelihood or pay the penalty of self-incrimination is the antithesis of free choice to speak out or to remain silent”. Further, the court stated that “policemen are not relegated to a watered- down version of Constitutional rights”. What the Court determined was that such statements made by public employees where the threat of termination exists, were compelled statements and unconstitutional. Therefore, such statements could not be used in criminal prosecutions and were in violation of their Fifth Amendment rights to self-incrimination.

True, he may not be compelled to give testimony in a criminal case. But in a civil case, if he refuses to provide relevant evidence, it could mean a civil judgment entered against him. Not that he would have the resources to cover any judgment, but the city police department might.

If P.O. Noor does not give a statement or answers questions to the police IG he should be fired ,he does not have the right to not answer questions from a superior officer in the police department. All police departments are semi military organization , a condition of employment is you have to follow all reasonable orders given by superior officers. A not reasonable order is for a superior officer to tell you to jump off a 5 story building ,giving answers to questions is reasonable. . The IG in police departments can ask and expect answers in cases involving officers who could have broken laws or rules of their employment. If you do not or will not answer questions from the IG in the course of an investigation {including if you are only a witness} you are not following a direct order you could be fired. Up the chain of the commanded in the police department the mayor is at the top .If you choose to not answer questions by the IG that is your right as a U.S. citizen you will not go to jail or face a fine you will be fired. Condition of employment is not a right in America. Your employee has the right to fire you if you break the rules of your employment ,for a cop not explaining why you shot a 40 year old unarmed woman in her PJs in the dark is breaking the rules.

The only way he could have been “startled” into shooting is if his gun was already drawn and aimed, with his finger on the trigger. They weren’t coming up on a scene that required he be ready to shoot immediately, so he had no reason to have his gun drawn. Further, to hit a target on the driver’s side from the passenger seat, his gun had to be pointed at his partner.

Police are taught to go through a mental “what if” series of scenarios in their mind when responding to a call. That mentally prepares them for a number of situations that that type of call may bring on arrival.
He apparently had his service weapon on his lap on approach to the scene. Which I have never heard of being taught in any department training for reasons of safety and liability.
He was obviously in a heightened state of awareness, whether through nervousness or fear we may never know, and had his weapon immediately able to be deployed. This alone should have been a red flag to his partner who should have calmed him down.
Both of these officers were only fairly new to policing. It is usual to have a rookie with a senior officer because this type of reaction may occur but can be controlled by the more experienced officer.
This appears to be a case of two inexperienced officers being sent on a call that neither may have been equipped mentally to handle and one more afraid than the other.

1. If The lady heard somebody being raped in the alley behind them, why not run outside with a flashlight and phone and baseball bat/golf club/etc and attack the potential rapist yourself and rescue the rape victim? It should not matter if you are Australian or not or a woman or not. By the time the cops come, the rapist could be gone.the rapist is preoccupied holding down the victim and wing be able run away quickly with their pants down around their ankles.

The reason no one is asking is because those questions mean nothing to the issue at hand. No sane reason to think it was her duty to take down a rapist. Also, no sane reason to think absence of a rape or assault victim means anything so far as this woman’s shooting by a police officer.
FYI, the Australian woman was the victim in this story and there is no reason to think she filed a false report, did somethimg else wrong or whatever you are trying to imply.
FWIW, filing a false report or not rescuing someone does not carry the death penalty in America. No justification whatsoever for the officer to have shot and killed this woman.

When a woman in pyjamas is shot dead after reporting a suspected rape then it’s the type of unreal and highly disturbing case that should be investigated by an independent force. The Minneapolis Police Force investigating themselves just wont wash, particularly with the millions of Australians watching developments. This is a job for a Federal Investigative Body or at least an investigation to led by a seconded team of professionals from another U.S. member State. All the details need to come out and the sooner an independent team takes over the less time there will be for all the fudging and weaving to settle in.

I really don’t think that the shooting had anything to do with the police officers muslim beliefs. I believe he was frightened, as he said startled, by something and felt in fear for his life, very mistakenly. Any way, he ended up taking a life of an innocent woman and for that poor judgement he will have to answer for it. He has had problems in the past from what I have read and did not seem suited for the job of a police officer but because he was a minority, he was hired as so often is the story. So whoever hired him should be held accountable as well. My thoughts and prayers go out to the poor family enduring this tragic turn of events, and i hope they get to the bottom of it real soon….

There are only two answers for this shooting. He either did it deliberately or accidentally. Why did he have his gun OUT? Why did he shoot past his partner( which is anathema! per police policy’s.) What cop would even AIM his gun in the direction of his partner? Cops are TRAINED to not react to extraneous noises with knee jerk reactions.
