This is an odd and anomalous development, left unexplained, of course, by a clueless, lazy, and agenda-driven establishment media. Ordinarily jihad mass murderers want the death penalty (cf. Fort Hood jihad mass murderer Nidal Malik Hasan and Oklahoma beheader Alton Nolen), because they think it will seal their reception of Allah’s guarantee of Paradise to those who “kill and are killed” for him (Qur’an 9:111). Not wanting execution could be an indication of apostasy, or else of a decision to try to tie up as much of the Infidel’s time and money as possible in useless court proceedings. Note that the defense has said that if the prosecution seeks death, they will need until September 2019 to prepare their defense. Yet everyone knows this jihadi was the perpetrator. If Saipov is telling his defense attorneys to go this route, it’s just a jihad of wasting the kuffar’s resources. If they originated the strategy, they’re just playing the Useful Idiot role quite nicely.

BC, unless the defense is given full discovery of the prosecution’s case and a “reasonable” time to prepare a defense any conviction will be tossed, and he could walk out a free man. It’s part of the “due process” burden under the Constitution for criminal cases.

On the principle that even Adolf Eichman deserved and received the best defense possible at his trial in Israel, this man is receiving a zealous and competent defense, and nothing more. The first duty of a lawyer who takes this case, whether by appointment, employment or volunteer, is to have a license when the case is over. Right behind that, if the lawyer wants to continue practicing, is to get paid for time and talent. A guilty plea ends all appeals (with the possible exception of “ineffective assistance of counsel”) and saves the super-multi-millions in total court, defense and prosecution payments that go with a death penalty case. The only thing left is the expense of lifelong confinement and dealing with the risk of escape. As long as terrorism is treated as “just another crime” instead of an illegal combatant in a war crime, this is probably the pattern that will be followed. It’s mostly a matter of what is more important, Justice or Money?

I like the logical positioning of your reply. I remind you, though, that publicizing Eichmann’s crimes through trial was one of the objectives of the government of Israel. That’s not being critical of them.
It seems to me there’s no good way to be consistent and resolve the dilemma you posed. You can bypass the Constitutional requirements of a trial and defense by declaring jihad and act of war; however, that opens the door to bypassing Constitutional guarantees for citizens for other “crimes” the government designates as acts of war. If you’re in Germany, “hate crimes” against Islam, including criticism, could be termed as acts of war. Bureaucratic diktats do not need to be sensible.
In a more general sense, it makes me wonder if the noted decline of all civilizations in history stemmed from the fact they all tried to become more consistent in the operation, and ran against the proven fact that any complex system is internally inconsistent. This is not simply a result of error; it’s a mathematical principle.
We’ve had famous trials in the past: the assassination of Lincoln, the Haymarket bombers, Sacco and Vanzetti, the Nazi infiltrators: justice was not perfect, but we gave it a shot and came out right most of the time. Now, though, justice has to be perfect, with every “i” dotted, or the perpetrator walks, even though the guilt is obvious. And giving more discretion to the judicial branch will work, except where the judges ignore the law altogether, as in the ninth circuit court area of the west coast. So again, a complex system breaks down when it attempts to become completely consistent.

According to the basic principle of the Constitution, prosecution should never be easy (“it is better to let many guilty walk than to convict one who is not guilty”). Like many efforts to provide/afford/require due process, this can be used to bankrupt our system with a “large” number of expensive prosecutions. In the meantime how many other laws that are just as important to day-to-day order and safety go unenforced?

While NY state may not have the death penalty, the case from the story is being prosecuted in Federal Court, noting that the Federal Defenders’ Office is involved. Under “dual sovereignty” an act which involves crimes under both Federal and state law can be prosecuted in both courts without violation of Constitutional “double jeopardy”. Federal law does have a death penalty, which is rarely in a long time carried out. “But it makes the outraged victims and families feel so much better.” Saipov will die of old age before a Federal death penalty is executed. And expect to spend the better part of 10 million dollars on prosecution, defense, court, experts and eternal appeals attempting to kill him.
This may be affordable for a case every few months; But what happens when it becomes a case every few hours? How will the legal system handle and pay for, say, 2,000 cases a year? (8766 hours in a year). Is there a limit to how much can be spent on “due process”?

Yes, there are rumors that some jihadists living in isolated jungle areas were ignorant enough to worry that if non-Muslims buried jihadist martyrs in pig skin those martyrs would be disqualified from paradise. But even those rumors about jungle jihadists appear to have been nothing more than that: rumors and myths. I suspect that in reality the fatwas would come down — they probably already have, somewhere — exonerating jihadist martyrs buried in pigskin from any wrongdoing in Allah’s eyes.
One of the reasons Islamic totalitarianism has survived so long is its relatively flexibility, at least if that flexibility remains more or less within the overall totalitarian parameters or is necessary because of unfavorable or hostile circumstances. Due process, even for mass-murdering devils, is part of democracy, liberty, and the rule of law. The alternative, I guess, is rule by mob or dictator, neither of which is to be desired, even when we feel frustrated.
If the murderer, as part of a plea bargaining deal, forgoes a trial and confesses to a substantial part of the crime, that can save a great deal of money and time for the court system, which can then move on to the huge load of other cases that need to be tried.
The prosecutors have to decide if it makes sense to go to trial in the hope of getting a death penalty that they may have great difficulty in getting, since the system is understandably cautious and downright reluctant to impose the death penalty. In that light, a plea bargain that accepts life imprisonment without possibility of parole may seem the more practicable approach.
Yes, feeding and housing the murderer for the rest of his life will be hugely costly, but so perhaps would it be hugely costly to the court system to pursue the death penalty in every situation where it might be a reasonable punishment. Even when convicts get the death penalty, I suppose they have to be fed and housed for years, I guess, while the death penalty is appealed, challenged, etc., etc. Prosecutors, for whatever reasons, good and or bad, often just don’t have the time and settle for a confession in exchange for a lesser punishment.

The judge should order the prosecution to provide Saipov”s attorneys what ever information that is legally required by X date. The judge should order Saipov’s attorneys to be ready for trial by Y date. The US Constitution requires speedy trial. Its protections cannot be changed to satisfy the foreign jihadist. It may be in violation of professional ethics for Saipov’s attorneys to hold the sorrow of the victims families hostage to their legal maneuverings.
Bottom line send this jihadist to his virgins!

Mr. Jones, Saipov’s attorneys have the right to waive the “speedy trial” claim (it belongs to the defendant, not the prosecution) if that is the time they need to prepare the defense; but that could set THEM up for an appeal of “ineffective assistance of counsel”. The judge should hear their pitch for time and rule; that is his/her job. I have been appointed counsel for a number of much less consequential but highly distasteful defendants and walked that careful line of zealous and competent representation while upholding the standards of the law and professional conduct. Please take time to read the case of Nix v. Whiteside, 475 U.S. 157 (1986), which is founded on a appeal over the defense attorney’s extremely proper conduct. Without a zealous and competent defense there can be no valid conviction and the defendant will walk. I don’t think either of us would like that outcome.

Standard criminal death penalty cases should be expected (budgeted) to cost taxpayers a total of roughly 10 million dollars each. If there are say 100,000 potential candidates entering the US each year, and another 100,000 plus added from births and conversions. it only takes 1 percent of them actually killing to reach the 2,000 cases a year. That would be 2,000 x 10,000,000 = 20,000,000,000 dollars a year not counting costs of holding them for nothing but terror cases. Whose welfare, free health care, education and other benefits are to be cut. We already have a military where 2/3 rds of the airplanes are unfit to fly. We already have 20 Trillion in national debt and Hundreds of Trillions in unfunded liabilities. What happens when the court system chokes on these cases and cannot handle others? Ed, I believe the cost to keep him in solitary at SuperMax is about $40,000 per year, substantially cheaper than the TOTAL cost from all sources of trying to impose the death penalty under current law and criminal procedure. Sooner or later, the death toll and criminal prosecution costs will force changes in handling. It has to start somewhere; which is my reason for presenting the opening case here and now.

Yes, the bottom line is worth consideration. Holding him while he may or not launch an appeal that will cost even more to the State is another. Leaving him in prison while he converts others to cause even more harm is intangible. As General Schwarzkopf opined, “I believe that forgiving them is God’s function. Our job is to arrange the meeting.”

This seems like the making of a coward. Abdeslam, during the Paris attacks, suddenly decided he wasn’t ready to die either- and went the coward’s way by escaping until he was caught. Abdeslam, naturally, believes in a radical version of Islam to this day- he just wasn’t ready to die for it. Saipov might be the same- an adrenalin-filled killer until the action dies down and he finds himself shitting his poofy pants in a jail cell. We don’t need a guilty plea to sentence Saipov- just send him to the death row as soon as possible. Oh, and make sure the executioner is female, too- watch the terror in his eyes as he realizes it was all for naught.

I.L., as much as it would save and as much as many of us would like, that is not the law that is followed in the US at the moment, AND those who wish to kill us know it. They are identifying and exploiting every weakness in our system to bring it down and enslave or kill us. As long as terrorism is “just another crime” instead of an act of war by an illegal enemy combatant, this is the routine for dealing with those jihadis who survive committing their murders. If the case ever got to an actual execution, I predict a female could be found to conduct it. But the next best thing might be to have a substantial number of female guards in charge for a life (consecutive life sentences?) in solitary.
