UK: May government rejects petition for Free Speech Act and end to “hate speech” laws

“Hate speech” laws are a tool of the powerful to silence dissenters. The person or group empowered with determining what is and is not “hate speech” has total power over the public discourse, and can criminalize any perspectives that the government does not favor. “Hate speech” laws are, in short, a tool for tyranny, and the freedom of speech is a society’s foremost protection against tyranny. The May government is the betrayer and destroyer of Britain, which is, of course, finished.

“Tory Government REJECTS Petition for a Free Speech Act,” by Jack Montgomery, Breitbart, January 28, 2018:

The British government has rejected a petition calling for a Free Speech Act and an end to laws against so-called ‘hate speech’.

“For several years now the government has been infringing people’s most basic rights to speak freely on matters, by deeming their speech ‘offensive’ or ‘hateful. and declaring that such speech, even online, warrants being fined or jailed,” the petition suggests.

“We demand the legal right to Free Speech, in an Act which will bring an end to the ludicrous notion that ‘hate speech’ and ‘offensive speech’ deserves people be imprisoned or charged … Ideas must be fought with other ideas, not with force.”

The petition system in the United Kingdom allows citizens to have petitions published on a parliament.uk website, subject to certain conditions. The Government is supposed to respond to petitions which pass 10,000 signatures, and the Backbench Business Committee is supposed to “consider” petitions which pass 100,000 signatures for a parliamentary debate.

The Home Office, led by Amber Rudd MP, responded on behalf of Prime Minister Theresa May’s administration as the Free Speech petition reached around 16,000 signatures — rejecting it out of hand.

“The Government is committed to upholding free speech, and legislation is already in place to protect these fundamental rights,” the statement begins — then immediately contradicts itself, adding: “However, this freedom cannot be an excuse to cause harm or spread hatred.”

The statement explains that British citizens have “a right to freedom of expression under Article 10 of the European Convention on Human Rights (ECHR)”, but that “This is a qualified right … This means that free speech is not absolute.”

The right to freedom of expression as described by Article 10 of the European Convention on Human Rights is certainly qualified, with the document spelling out in no uncertain terms that free speech rights are “subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary.”

Critics have pointed out that, far from providing citizens with the right to freedom of expression, the European Convention in fact provides governments with the right to restrict freedom of expression on the flimsiest of pretexts, with the caveats concerning the protections of “morals” and “the reputation or rights of others” appearing particularly open to abuse.

The authorities under have if anything appeared more enthusiastic in cracking down on free speech since the nominally conservative Tory Party returned to office in 2010, with the police dedicated significant resources towards arresting people for making “offensive” online comments despite swingeing budget cuts.

Figures obtained under the Freedom of Information Act revealed that police forces increased arrests under section 127 of the Communications Act 2003, which makes it illegal to intentionally “cause annoyance, inconvenience or needless anxiety to another”,  by up to 877 per cent between 2014 and 2016….

    Do not stop fighting for your rights England. Freedom of speech is something worth fighting for. The Americans didn’t get their rights after quitting the first time

      And what about the tens of thousands of ex-Muslims living in England? Where will they go to survive when Islam becomes dominate and Sharia norms/Quranic dictates are regularly enforced in the British Isles? The May government clearly has little respect for freedom and the freedom of speech, therefore much pain will be experienced by England as the Welfare State continues to be sucked dry by Muslims and a significant percentage of Muslim males prepare for jihad against the kafir.

      We ex-Muslims living with Islam’s formal and informal death penalty for apostasy know that Mohammedanism is a terribly dangerous and harmful fraud.

      Islam’s canonical texts record that the prophet of Islam instructed his followers to kill those Muslims attempting to leave the fold of Islam.

      Therefore each and every one of Muhammad’s followers are required to murder any friend or family member that attempts to leave the religion of Islam.

      Some Islamic apologists claim that Islam does not call for the death of Muslim apostates, while other Muslims acknowledge that the Islamic scriptures do indeed call for the death of ex-Muslims.

      As always, for the answer to whether or not Islamic theology prescribes death to the apostates of Islam we must turn to Islam’s foundational texts, the Qur’an, the Hadith and Sira.

      Regardless of whether or not Islam prescribes death for Muslim apostates, it is no doubt a very dangerous proposition to leave the religion. The sad fact is that Islamic theology and law both prescribe death to Muslim apostates.

      The sayings and doings of Muhammad, considered to be authentic by the majority of Muslims, are found in the Bukhari hadith collections among others.

      Hadith: Sahih Bukhari, Vol. 9, Book 84, No. 57:

      Narrated Ikrima:Some Zanadiqa (atheists) were brought to Ali and he burnt them. The news of this event, reached Ibn Abbas who said, “If I had been in his place, I would not have burnt them, as Allah’s Apostle forbade it, saying, ‘Do not punish anybody with Allah’s punishment (fire)’. I would have killed them according to the statement of Allah’s Apostle, ‘Whoever changes his Islamic religion, then kill him.’”

      The Quran itself prescribes death to those who attempt to leave the the fold of Islam:

      Quran: 004:089:

      ‘They wish you would disbelieve as they disbelieved so you would be alike. So do not take from among them allies until they emigrate for the cause of Allah . But if they turn away, then seize them and kill them wherever you find them and take not from among them any ally or helper.’Muhammad personally ordered the death of hundreds of innocent people. But then again, the word innocent means something entirely different in ‘Islam Speak’. And keep in mind that Muslims are taught to believe that Muhammad is the model man for human conduct (Quran 033:021).

      Qur’an 033:021:

      ‘There is a good example in God’s apostle for those of you who look to God and the Last Day and remember God always.’

      Here is a recent statement from a group of Bangladeshi apostates living in the UK explaining the reasons why they have abandoned Islam:

      “One who claims to be a messenger of God is expected to live a saintly life. He must not be given to lust, he must not be a sexual pervert, and he must not be a rapist, a highway robber, a war criminal, a mass murderer or an assassin. One who claims to be a messenger of God must have a superior character. He must stand above the vices of the people of his time. Yet Muhammad’s life is that of a gangster godfather. He raided merchant caravans, looted innocent people, massacred entire male populations and enslaved the women and children. He raped the women captured in war after killing their husbands and told his followers that it is okay to have sex with their captives (Qur’an 33:50). He assassinated those who criticized him and executed them when he came to power and became de facto despot of Arabia. Muhammad was bereft of human compassion. He was an obsessed man with his dreams of grandiosity and could not forgive those who stood in his way…

      The statement continues,

      Muhammad was a narcissist, like Hitler, Saddam or Stalin. He was astute and knew how to manipulate people, but his emotional intelligence was less evolved than that of a 6-year-old child. He simply could not feel the pain of others. He brutally massacred thousands of innocent people and pillaged their wealth. His ambitions were big and as a narcissist he honestly believed he is entitled to do as he pleased and commit all sorts of crimes and his evil deeds are justified.”

        Excellent post, Saleem. Apostates from Islam show great courage, and deserve far more acknowledgement and support than they often receive. As you would well know, there are many fearful apostates concealed among the faithful, going thru the motions in order to stay alive. Theresa May’s failure to defend freedom of speech in Britain protects only the enemies of Britain’s freedom. That ‘a significant number of Muslim males are preparing for jihad against the kafir’, is no surprise; they smell victory. How prepared are Britain’s kafir males, I wonder?

      I think if you have to tell the English that they have the right not to submit to Islam then the situation is probably hopeless. I am praying that Sweden falls sooner than later so that the rest of Europe might wake up before it is too late.

          I think what he meant was that if a Western state is to fall, it would be better if only one fell, in order to startle all the other nations of the region.

          I would hope that this is what will happen but now, I’m not so sure. It seems, more and more, that it is a case of the proverbial ‘boiling of a frog.’

          To me, the UK is already a tyranny – most Brits (with the exception of 15,000 signatories of this petition) haven’t even noticed. They are sleepwalking, believing that they are free. But if it looks like a duck, swims like a duck, and quacks like a duck, then it is definitely …. a tyranny.

    Wait until that utterly corrupted May’s government will re-institute their “tradition” of a Bill of Attainder and starts summarily to execute their people for what they call as “hate crimes.” Under their system of law, what was once THE law it could very easily be applied again. It is THERE! And one would think that times of Henry VIII are gone forever? Think again! Nothing less than a new English REVOLUTION is needed to bring them to senses and back to reality.

          And I see that Henry VIII and his men passed the Bill of Attainder on Jan. 29, 1542. As the apostle Paul encourages Christians to pray for the welfare of their country, so we must do so and our pastors and priests ought to pray for our country and our leaders every Sunday during the worship services. If they don’t, remind them to do so.

      Yes Cromwell tried to subdue the Scots, contrary to the Union of the Crowns, and the Union of the Parliaments under the English Revolution.
      Well since he had no interest in upholding the laws which meant the 2 countries have to be equal, he lost out.

        Henry VIII was NEVER king of the United Kingdom. He died 50+ years before the Union of the Crowns and 150+ years before the Union of the Parliaments..
        His laws could NEVER become part of Scots law. The Scots Law to this day is independent of English Law.

    Hurting somebody’s feelings is now a kind of blasphemy. And which religion has members who most likely to use blasphemy laws to destroy other people and gain power over them? Depends on where you live. In Egypt it would be Islam. In Europe it would be “Multiculturalism”, with a boost from Islam.

    I’m extremely impressed with the person (D. Freeman) who started this petition project; instead of cursing the darkness, he is doing something. If British voices become loud enough, the government will listen. If the voices become really loud, the government will quake in fear, and that’s a great thing. Mr. Freeman, this may be the start of something big for Britain.

    This is a danger of globalization and the E.U. England needs a Bill of Rights like we have.

    Speech that incites people to hatred , murder or yelling fire in a theater are already disallowed by laws against incitement. Hate speech laws are not necessary.

    May and her party show themselves to be fools, cowards, traitors, or a mix thereof. They at least could have pushed the envelope a little and made some progress toward freer speech. But they totally rejected it. And when they say free speech is “not absolute,” that is a dishonest, deceptive straw man. No one is demanding that free speech rights should be absolute. Even the First Amendment does not permit speech that directly incites to illegal violence. What is demanded in the UK, you liars in May’s party, is not absolute freedom of speech, but simply freedom to criticize any ideology or religion.

      Darren Conway was imprisoned for a year for displaying SOMETHING in his window that was claimed to be “offensive” to muslims. A Freedom of Information request was made later to ascertain what this SOMETHING/ It was turned down as “not in the public interest”.
      We may never know, but be warned, we can be imprisoned for it.

        I did not mean only fascist ideology. An indispensable ingredient of civilized life today, I believe, is the right to free speech about any ideology, idea, religion, or belief system. Without freedom of speech and freedom to criticize any and every idea, human thinking is gradually corrupted and blinded, and human souls are weakened and damaged, an injury that may be worsened in populations the longer a people lives with its public discourse chained by censorship or terror. (And “criticism,” of course, does not always mean rejection. Criticism can also mean an evaluation that arrives at some kind of mix of conclusions both positive and negative.)

        Also, I don’t mean that anyone should have the right to force anyone to listen to criticisms. I mean only that people must have the right to state or write criticisms for any audience or readership that might be interested.

    Goodness, the twisting of words has become mindbending.

    It seems as though it is now considered that speech which causes the hearer to cause harm to anybody, for any reason, is now included in the restricted speech category. Spreading hate doesn’t mean any longer that the speaker is trying to incite others to commit violence, but only that some disagreeing with your speech might hate you and become violent in return.

    It is the proscription of offending muslims, obviously, since they (and some of their lefty snowflakes) are the only ones who get violent when they don’t like what you said.

    What people fail to grasp is that in 1973, All Common-Market countries agreed in return for oil of the crisis of that year, for Europe to adopt Islam. Bat Ye’or spells it out in her fine work “Eurabia”. The years 2023 to 2030 will see Islam declared the official culture and religion of Europe. This was agreed. Moslems tell me that they have been promised control by 2023. Look up Anna Lindh Foundation. This is not conspiracy theory but fact. Schools are also to encourage Islamic dress and scarves for all under age girls.

      In Ch3 of EURABIA, Bat Y’eor outlines the agreement reached between the Arabs and the EEC whereby the EEC gained access to oil in exchange for foreign policy co-operation in relation to Israel. Unable to defeat Israel militarily, the Arabs used the threat of an oil embargo to coerce the West to support their war.       I can find no mention in EURABIA of any declaration to the effect that ‘Islam will become the official culture and religion of Europe’, and would appreciate a page reference if you have one. I suspect that what your Muslim connections have told you is Muslim Brotherhood propaganda.

    The best way to fix this is for massive disobedience on a scale that the thought police cannot cope wth. A million participants simultaneously violating hate speech acts should overewhelm the British police and judiciary. Do as the first Americans did against the British, spread millions of pamphlets speaking the truth of their causes. The British tried the same thing against those who protested the unjustness of King George’s rule. Posting and handing out information was a tactic then and is valid today.

          Dumbledore’s Army is herself of Scottish heritage, and is proud of it.

          That you are incensed over posters not always making a distiction between England and the other nations of the UK–a mild annoyance at most–but have given no indication that you are concerned with either losing your freedom of speech or outright falling to Islam, is just bizarre.

          You seem to be straining at gnats, but fine with swallowing that camel.

      England is only one of the countries in the United Kingdom.
      Cromwell tried to ignore the law of his day, to subdue the Scots to English rule, making them part of England.
      Some Scots rallied to Him and caused civil war in Scotland.
      There was no need for a puritan path in Scotland, Since the Reformation, ALL parishes in Scotland had a school attached to them and the minister taught the children to read, write and count. (the three ‘Rs’) Their only Book was the Bible.

    I no longer tolerate people using this term “hate” within a political context. If it’s used then I demand that they define this slippery euphemism. Usually, that ends the discussion right there – they turn on their heels and walk away. If, however, they are the more resilient variety of snowflake then I will get the usual “well, you know,” or an ‘ad hominem’ attack like, “are you a hater?” I will respond with, “no, I don’t know what you mean – that’s why I asked for a definition.”

    I go on by stating that it is idiocy to attempt to legislate against hate; hate is a natural, and some would argue, essential human emotion. One cannot ‘love’ or ‘like’ without there being an emotion called ‘hate.’ I happen to ‘hate’ inclement weather when I have planned a pleasant day outside. Can I expect to be prosecuted for expressing this?

    Next I say that legal experts bemoan the attempts to codify ‘hate’ into the criminal code. These legal experts say that it is already difficult enough for the police/prosecutors to prove criminal intent – never mind codified certain types of ‘hate.’ They will tell you that many crimes already have hate insinuated in them. And what’s worse, codifying ‘hate’ into the law adds an extra burden of proof. And this would make some laws completely unenforceable.

    I also inform this resilient snowflake that the laws on the books are not “hate laws” but are “hate speech laws,” and that their original and intended purpose was to protect identifiable groups from the *publication* (private conversations are protected) of incitement to violence and/or genocide. I note that this incitement must be direct and imminent. Any circuitous or convoluted chain of cause-and-effects like: “he said something negative but true about such-and-such and therefore it will result in certain violent people acting on it,” is not valid.

    As with defamation in torte law, there must always be a defense of the truth present in defamation and “hate speech” laws. The absence of a defense of the truth, transforms a “hate speech” law into a muzzle law, as we see with many of the European forms of these laws. (We have the Communist, Socialist and Labour parties to thank for this.)

    If the snowflake is still around by this point then we will have come to a point where their broad, euphemistic term of “hate” has been whittled down to an innocuous little nothing and they can no longer use it to silence me, or others, who think differently than they.

    Free speech is the freedom is engage in *truthful* speech and/or inquiry that some may find unpleasant and/or unpopular. Pleasant and popular speech is nothing more than making lovely parrot noises.

      Helpful post. From what you wrote, I believe you’ll agree that freedom of speech laws like the First Amendment are there precisely to protect offensive speech. After all, no one will try to censor speech that no one finds offensive.

    British governments all over the political spectrum have been trying to remove civil rights for DECADES now. It started with Thatcher, continued under Major – the same story with Labour under Blair and Brown and the “new” conservatives under Cameron ditto.

    The only thing that “improved” is the 24/7-surveillance (which doesn’t catch more criminals). Oh, and that every peace of legislature to “combat terrorism” can be abused to spy on and harass people for differing opinions – even at home.

        A recent video followed a fairly typical American woman for a week, and discovered that her phone, in that week alone, had broadcast her GPS coordinates over 5000 times to third parties, who thus collected data on exactly where she was virtually every moment of the day. Some apps on smartphones apparently almost constantly broadcast our locations. Presumably businesses in this way gather useful marketing data.

        Even the societies that are most free, sometimes make an exception in to laws about free speech, for example in dire emergencies (such as major wars), the curtailment of speech is sometimes considered temporarily unavoidable. I think part of what is happening in Europe is a sort half-conscious evaluation of the situation as akin to a warlike emergency that supposedly requires speech restrictions. Such restrictions are instinctively intended to prevent massive violence, riots, civil war, etc. True, a lot of the censorship in Europe is done in the name of protecting the rights of a minority (the Muslims), but I think the deeper underlying reason is rather a sense that violent chaos between Muslims and non-Muslims is a potential that is not that far below the surface. So the attempt is made to forcibly repress and censor some types of speech. Of course I do not agree with censorship, but I suspect European fears of civil war or even genocide are involved.

      Van Jones was a self-described communist (I don’t know if he still is) and a 9/11 truther. (I don’t know if he still is.) I don’t know if he’s evil, but at a minimum he’s clueless if a communist or truther. His persona on television seems undogmatic, gentle, sweet. (I don’t know if he really is.)

      It happens all the time but is unlikely to be reported in the Media. The media is controlled and the PC, BBC is still the main source of ‘fake’ news in the UK.
      I read this in the British Christian Pakistani News at the time.
      Just wait till it becomes illegal to hold carol services. It is beginning to happen.
      In Luton 2017, a Christian group had Council permission to hold a Christmas Christian event outside a Mall. It was going well and crowds were gathering. A group of Muslims turned up with a PA system and NO Council permission to be there. They used their PA system to drown out the Christian group and to pray. Their chanting of Allahu Akbar alarmed the public so much they called the police. The police refused to move the Muslims on but told them they couldn’t use the PA. Needless to say the crowds melted away and the Muslims won.
      I cannot find this online anymore.
      Thus freedom of religion is on its way out and we will be having a society a bit like the USSR and China when underground churches will be the norm.

    Okay.

    The petition that has just been rejected, had 16,000 signatures.

    Those who set up the petition must simply go right back and start over; and this time they must do their level best to gather 100,000 – preferably, 110,000 – signatures. And every person who *signs* has to be encouraged to write a letter to their MP and a letter to the PM, on the subject of freedom of speech, as well.

    Present the petition by the usual means; but… perhaps it would also be good to find out how many of those signing it would be prepared to *go in person* and stand outside Parliament, and then march to no 10 Downing Street.

      It isn’t easy to get the Media in the UK to give this any coverage. Many like me do not belong to social media which I believe is going to cut back on free speech too.
      There is too much apathy for a march to Downing Street. The masses are ‘drugged’ into believing the Globalist agenda. It has been taught in schools for years.

        Don’t give up before you’ve started.

        As a start: have you bought Tommy Robinson’s book? Do you donate to Gavin Boby’s Law and Freedom Foundation? Do you support Ann Marie Waters’ political party?

        Do you follow the website of the British Pakistani Christian Association? *They* hold regular protests and rallies and get up petitions. YOu could make a point of attending *their* rallies, and signing their petitions- and writing letters, as well as adding signatures. They want the UK to STOP paying ‘aid’ (which *we here* all know is seen as jizya, by the recipients) to Islamic Pakistan, because of Pakistan’s human rights abuses. Join your voice to theirs.

        And.. if you go along to their rallies, you *should* meet like-minded people, people who are aware that Islam is dangerous. Take other people with you. Let awareness spread, by word of mouth and face-to-face contact.

        There is also PEGIDA-UK.

        And… there is that old-fashioned patriotic body, “The Royal Society of St George”. If ALL Islamoaware UK jihadwatchers joined it, they might be able to do something with it. For one thing, being a member would give you the perfect cast-iron reason for publicly flying the Cross of St George.

    It has been obvious to me for some time now that the UK would, at some time, become a totalitarian state, but I had not expected it to occur quite so soon. We all know that the Government’s present policy is designed to favour one specific section of society only, so it looks as if the ‘takeover’ (‘handover’ would be nearer the mark) is even further advanced than I imagined.
