Why hasn’t John Kerry been arrested for violating the Logan Act, as it is now well known that he has had many meetings with Iranian officials and others, trying to save the disastrous Iranian nuclear deal? Leftist privilege.

    I can’t believe that the former administration hasn’t been notified that they no longer work for the United States government. I feel and believe that John Kerry is a traitor to this country. Retire old man what is so important to you about the false hope you gave us about this rotten deal. Nothing beneficial to the world in that deal especially when the term ended. Remember the devil gave many power, prosperity, and health for ten years then he owns your soul, and the deal ends. That is what Obama gave the world with that dumb deal.

          Frank, it really doesn’t matter to me what political party a person endorse, so long as they have a CLEAR UNDERSTANDING of 1) TAQIYYA the 2) JIHAD DOCTRINE, the 3) ISLAMIC APARTHEID DOCTRINE and the 4) DISCRIMINATORY NATURE of SHARIA LAW.

          Vichy France. Croatia. Romania.Spain. Hitler had a lot of help from people in the Baltic States. Poles, Ukrainians could run hot and cold in collaboration.
          A lot of Waffen SS units from occupied countries.

          I’m not bad at history. I just wanted to see where other people stood…and I did. Thank you.There’s a big difference between cooperating after you’ve been defeated or before. Also, having volunteers from a conquered country doesn’t necessarily mean the country is complicit. There were collaborators in every country. BTW You left out Ireland.

They chaired the Senate Select Committee on POW/MIAs and after amassing 22 thousand pages of documentations of live sightings, code words, testimony, letters to the USSR, THEY shredded them ALL and stated no live POWs were in Viet Nam and abandoned over 500 US SPOWs in Viet Nam and up to 300 in Laos and Cambodia.

Laws are made for this reason yet they are not enforced. Is it because they are democrats?     John Kerry is not elected by anyone to conduct diplomacy. He is being paid by someone with deep pockets. This is not acceptable to have a traitor undermining national policy.

    The Logan Act will have to be dusted off. Kerry is aware of the Logan Act, but does not fear it. The Deep State’s mouthpiece, Hill-liar-y is involved in some Deep Doo-Doo.

      Logan, Shmogan. The Logan Act would administer no more than a little scolding followed by a slap on the wrist—assuming that a conviction is obtained under this act.

      Meanwhile, the bipartisans will continue to behave as they do because they know that “conservatism” is a hunting dog that fears to hunt no matter what the circumstances. If conservatism were itself worth conserving, this recent news about John Kerry, if confirmed, would precipitate a storm of violence against the Democrats and their financiers. No Logan Act would be required. Everyone knows that no such storm will materialize. Instead, professional conservatives will brew their usual teacup tempests and serve them with self-congratulatory claptrap about their high regard for debate and polite dialogue.

        Interesting suggestion, Rob Crawford, though said section of Article III states that treason “shall consist only in levying War against them (i.e., the United States), or in adhering to their Enemies, giving them Aid and Comfort.

        Arguably, Kerry, whom I have no respect for, is not engaging in war against the US and arguably as well Iran is not technically an enemy in the sense that we are in an active war against Iran. Thus, the importance of the Logan Act which kind of filled in the possible gaps here.

        Understand, your suggestion has merit but I don’t know that it wold wash for the reasons I just stated above.

    John Kerry is an unrealistic deluded fool if he really feels that there was any actual value of that “deal” with that tyrannical “mullah regime” of Iran by that attempting to work out a compromise with those Muslim tyrants in power in Iran.     John Kerry is has no authority and not an official with a position to speak for the US government to rulers of Iran and therefore he is no business pretending to an official spokesman of the United States of America. By the meddling interference with US policies Kerry his can only do harm and not good at all .Since Kerry of out of office he obviously doesn’t know his place. Kerry is acting in insubordination to American constitutional law; he is in violation of the Logan Act. Furthermore, Kerry is a busybody and meddler and must be so pride –filled, arrogant and deluded that he actually thinks and feels that he know best.       There was a murder case several years ago where a body was found and no witnesses or easily identifiable evidence. The woman had a drinking problem and had been in several bars before she was murdered. During the investigation, the forensics team discovered finger prints on her leg and torso and they identified the murderer.

      Forensics has been advancing a lot. One just never knows what he may leave behind (no pun intended) at the crime scene.
      The French should ask for alibis and check his movements before, during and after the stabbings. Many of us might not be surprised.

      N.M.H. I think if you check into Kerry’s background he was selling out the US while he was still in Navy uniform by talking with the North Vietnamese during the Vietnam war. Collaborating with enemies and giving them aid and comfort while they are killing US troops is nothing new to him.

    Since I’m Canadian, I don’t know everything about American politics, but I thought that once a president is elected, no matter what side you were on, you are supposed to get behind the president, (and not just to stab him in the back, either). President Trump has not even been in office for a full term and he has done more for America and for the world, I might add, than Obama did in two whole terms. I hate traitors and I know enough about traitors because we have them in Canada, namely Trudeau and his “Liberal” party. You know I used to tune into Stephen Colbert’s program for some laughs. Night after night, all he’d do was to denigrate President Trump, until I had to hold myself back from writing to him to tell him that he’s nothing but a goddamned traitor. I hate him. I did hold myself back, though, because here in Canada, I’ve learned that you can’t tell a Liberal anything, not even if it’s for his own good and I thought it’s likely the same with Democrats in the U.S.A.

        Wellington, I agree a prosecution under the Act rather than the Constitution is more practical. The big problem I see with the Constitutional requirements for treason is establishing what “time of war” means (whether an Authorization to Use Military Force is sufficient to constitute a “declaration of war”?), and whether it applies where Iran sponsors and provides weapons to kill US soldiers in Iraq, Syria and Afghanistan in particular. At Kerry’s age a 20 year prison sentence should hold him for the rest of his life and keep him from meddling further in the “people’s business”. If it takes multiple charges and convictions to get him off the streets, and off the US pension payroll, we are better off. How much is he being paid today from all US government sources? A whole lot more than I.

          Well, Frank, since the specific phrase, “time of war,” is not in Article III, Section 3, and the Logan Act is much broader (in a good, sensible and patriotic way), I think the route to go is with Logan and not Article III, Section 3.

          As for Kerry, the man is appalling. He is a gigolo (not a crime but certainly being such serves as a comment on his character), an appeaser, a stupid person overall in that “special” way that many well educated people are (God knows, I met enough of such people in my third of a century teaching history, not to mention more than a few lawyers I’ve come across), and, in general, an execrable man, which, I have no doubt, more than a few Vietnam War veterans would readily second were they in a position to do so.

          Ideally, what Kerry has recently been up to will backfire on him. Of course, the MSM, toadies that they are, will cover for this wretch being wretched themselves, but ideals sometimes are realized. I hope so in this case. Time will tell.

          Wellington, I appreciate the correction. With the absence of the phrase “time of war” the problem becomes defining at a trial who is an enemy. I’ve been licensed as an attorney for soon to be 38 years and tried a number of novel cases and issues, on both sides at one time or another. I can see where prosecuting a nebulous (weakly or poorly defined in the law) claim of treason would be a challenge unless a Logan Act claim were included as a “lesser offense” or as an alternative charge. Prosecutorial resources would probably be applied more efficiently focused on the statutory charge. I can imagine some juries would be happy to find Iran qualifies as an enemy. Who has the ????? to bring a charge?

          You may have seen some of my comments that a lot of lawyers do not inspire good feelings to me. I went to law school with a negative impression; and over 40 years later my impression still leaves a lot of room for improvement. Most people go to law school because they think as a result of too much television it is a great way for a free ride in life, and they lack the skills or motivation to do anything else. As long as they do whatever their clients wish, it can be. But the minute one has to say no to a client, all Hell comes to play. Probably, from my experience and observation, 1 in 10 are genuine good people who uphold the law and standards of professional conduct at all times. But far more will say or do anything a client will pay for until the bar says stop. And since they are far more common, guess who the bar protects? Dismal.

          Frank: Thanks for your reply. The wisdom that resides in the Logan Act (1799) is that it even would apply with a friendly ally with whom the US has some temporary dispute. So, as an example, a private American citizen on their own couldn’t even negotiate with the government of Canada. This, I think, makes sense since the only spokesmen for the federal government should be officials of the federal government. Too confusing and messy otherwise, never mind the diminution of sovereignty such private negotiation could result in.

          As for many lawyers being less than savory, my sister, who has her own law firm, would readily agree with you. So many attorneys live on the edge of what is ethical or even cross that edge many times.

      I was recently in Boston. Took a hop on hop off bus tour through the city.. The driver/ tour guide said J.Kerry lives in the million dollar house neighborhood on the other side of the Common Park.He hit the Jack Pot when he married Teresa Heinz. Her millionaire deceased husband was a conservative republican I heard. He must be doing somersaults in his grave. She had a stroke and I wonder how she’s doing. We never hear about her anymore.
