“I step on your cross”: Muslim leader in Australia says his group “not required to comply with Australian laws”

Mustapha Kara-Ali is basing his claim to be above Australian law on Australian law: “The Australian Charities and Not-for-profits Commission (ACNC) Act 2012 stipulates that when it is carrying out religious activities that are related to the practice, study, teaching or propagation of its religious beliefs, or other activities ancillary to them … Diwan Al Dawla, as a basic religious charity is not required to comply with Australian laws.”

The Australian Charities and Not-for-profits Commission (ACNC) refutes his claim, but in any case it isn’t surprising that Kara-Ali would make the attempt. The Qur’an tells Muslims: “You are the best nation produced for mankind. You enjoin what is right and forbid what is wrong” (3:110), and says that unbelievers are “the most vile of created beings” (98:6). So why should one of the best of people have to submit to the laws of the most vile of created beings?

A religious leader accused of illegal land clearing on a rural property used for religious prayer has claimed a Western Sydney council is infringing on his group’s religious freedoms by pursuing him over the allegations.

Hawkesbury City Council has launched civil action against Dr Mustapha Kara-Ali and Diaa Kara-Ali in the Land and Environment Court, alleging they carried out illegal land clearing, earthworks and built gates, fences and driveways without seeking any of the relevant development approvals at a property in Colo, in Sydney’s north west.

Mustapha Kara-Ali, a former member of then Prime Minister John Howard’s Muslim Community Reference Group and past postdoctoral fellow at Harvard University, is the Imam of religious guild Diwan Al Dawla….

The Colo property was owned by the members of Diwan Al Dawla and used “for the carrying out of religious activities of devotion, self-discipline, ritual baptism, inter-community prayers, contemplation and religious study,” the letter said.

A council compliance officer visited the property in October last year following an anonymous complaint to find land clearing, including a number of large native trees and the removal of metal waste, according to court documents.

Over the following months, more complaints were made and council staff returned several times to find people clearing vegetation, knocking down trees and that a main gate, driveways and a boat ramp on the river bank had been built, the documents state.

The Council also issued a $8,000 fine for pollution or potential pollution caused by failed sediment erosion fencing….

The conflict between council and the Kara-Alis came to a head last month when three council officers visited the property to provide them with court papers.

A dashcam video tendered to the court shows a man, standing beside Mustapha Kara-Ali, spitting on council staff and attempting to throw a large rock, which hits the fence and then falls to the ground.

“Both men were repeatedly yelling obscenities from the other side of the gate, calling out ‘you dogs, I step on your cross’,” one of the council staff alleged in an affidavit.

“The unknown male person said ‘I spit on you’. He then lunged his head forward towards me and spat at me.”
Religious charity ‘not required to comply’ with law

When the council wrote to Mustapha Kara-Ali directing him to remove a boat ramp and retaining walls at the property, he responded by claiming his organisation was exempt from Australian law because it was classed as a basic religious charity.

“The Australian Charities and Not-for-profits Commission (ACNC) Act 2012 stipulates that when it is carrying out religious activities that are related to the practice, study, teaching or propagation of its religious beliefs, or other activities ancillary to them … Diwan Al Dawla, as a basic religious charity is not required to comply with Australian laws,” he wrote.

“As the Imam of Diwan Al Dawla and its spiritual leader, I, therefore, ask the Hawkesbury City Council to revoke its letter … on the basis that its demands infringe upon our religious freedom and tamper with our mode of worship in contravention of our ACNC status as a Basic Religious Charity.”

An ACNC spokesperson said basic religious charities did not have to comply with the ACNC Governance Standards.

“However, the exemption of basic religious charities from complying with the Governance Standards does not mean that they do not have to comply with Australian laws,” the spokesperson said.

“A registered charity cannot have a purpose of engaging in or promoting unlawful activity — this can be grounds for revocation of charity status.”

        With the ex-Muslima in mind:

        While brave Iranian women were casting their hijabs off–and being arrested for doing so–Muslimas (and their useful idiots) in Regina were celebrating World Hijab Day.

        I contacted the CBC ombudsman about the reporter’s apparent ignorance of the Iranian situation (and other aspects of the article). He understood my concerns and added a link (about those Iranian women) in the article.

        PRCS referred specifically to the laws which are being used against us – eg those relating to freedom of religion – not to our laws in general, which of course Muslims are obliged to obey, whether they like it or not.

          In addition to using the 1st Amendment’s religion clause against us, the automatic citizenship provision of the 14th Amendment–for the children born here to foreign nationals who are:

          **just working here
          **here illegally

          Needs a serious review.

          Yes, we need to enforce our laws rigorously. But that is not the issue here. What is being suggested is that we tighten up those laws which are being used against us – for example, defining more precisely what is meant by the right to freedom of worship.

      British barrister Gavin Bobby has long maintained that many things mosques and their patrons are doing to annoy the local people can be stopped by using the laws already in place.

      Eventually, Islamic doctrines must be shown to supremacist and political in nature. A study by content of all the PRIMARY SOURCE DOCUMENTS of Islam show that the Bukhari hadiths, Sira and Koran are collectively over 50% about politics, then about Mohammed and lastly 14% only is about Allah.

      The religious content in Islam is much less important by content.

      Islam should be seen by governments to be mostly a political party lobbying to take over control of society.

      That is how the Diwan Al Dawla is acting … as if it is already above Australian law as a political body appointed directly by Allah, thus nullifying and overruling all decisions of Australian political bodies and courts.

      Moreover, what is this they say about ‘baptisms’ in the river? Does a mosque conduct BAPTISMS in rivers? First I heard of that!

      To the contrary, the word ‘baptism’ and Islam do not go together. To say a Muslim was baptized is to say that he became an APOSTATE who left Islam and thus he should be executed as a renegade according to Mohammed.

      This story is as fishy as the river.

        That may be the basis of the story because Muslims tend to be very careful about using water – Islam is a desert religion.

        Thanks for the link. As I was going over the information, I liked this idea: Western nations will lose predominance if they fail to recognize the irreconcilable nature of cultural tensions. Huntington argued that … the West (would have) to strengthen itself culturally, by abandoning the imposition of its ideal of democratic universalism and its incessant military interventionism. … Huntington wrote in the 1996 expansion, “In the emerging world of ethnic conflict and civilizational clash, Western belief in the universality of Western culture suffers three problems: it is false; it is immoral; and it is dangerous.”

        Western people seem to believe that anyone in the world will just naturally like Western culture better than their own, but apparently, that is not the case, as we are finding with a lot of Muslims. Just because we think Western culture is better, that doesn’t necessarily mean that everyone else does, too.

    Then Australia is not obligated to house them. Muslims can be so deluded by their own arrogance they forget that everything they use and need was invented and manufactured by someone who wasn’t doing it for Allah or Islam. They did it because they were free to do so. This is where the arrogance of Muslims can really come out; 1) they refuse to SEE that Islamic culture is NOT on par with Western countries and 2) they believe that EVERY important invention or modern development had it’s roots, somehow, in Islam and Allah and 3) they MUST believe they are superior to everyone else whom 4) they must view as filthy and immoral because the Quran says so.

    The imam’s statement is both true and nothing new. He is not an extremist and his words can be supported with Islamic scripture.

    This is why free speech is so important. We know where he, and likely his congregation, stand.

    There is (or was) the common law crime of ‘Incitement’. in criminal law, incitement is the encouragement of another person to commit a crime.

    Incitement, conspiracy or being an accessory may still be against Australian criminal law – possibly under a new name. It can also apply when suing someone for damages to persons and property.

      Well said, kuriakose, about Senator Fraser Anning’s having told the truth about Muslim immigration into Australia. This report is just another example of the never ending trouble from Islam. It is incompatible with our western values and Muslims are always fighting against our values, trying to change them and aiming to treat our western values with contempt. When it comes to Islam, it truly is them or us. Incompatible views of the world. Anning was right to call for an end to Muslim migration. Despite the carry on from the politicians, I think Anning’s comments would have a lot of support amongst the average citizens of Australia. I think a lot of people have seen enough by now and have made up their minds.

    Mask off, and no mistake.

    Neither the University of NSW nor Harvard have made a dent in his Islamic megalomania.
    That threat tells me he’s going – or will be going – Jihad just as thoroughly as any illiterate thug in the badlands of Afghanistan or Yemen.
