Does this not place Kerry in violation of federal law? The Logan Act forbids unauthorized people to engage in negotiations with foreign governments that are involved in disputes with the United States. The Logan Act’s intention is to prevent unauthorized negotiations from undermining the position of the U.S. government. Isn’t that exactly what Kerry is doing? “Kerry Meeting With Iran to Salvage Nuke Deal With Rogue Diplomacy,” by Adam Kredo, Washington Free Beacon, September 12, 2018:

Former Secretary of State John Kerry disclosed that he has been conducting rogue diplomacy with top Iranian officials to salvage the landmark nuclear deal and push the Islamic Republic to negotiate its contested missile program, according to recent remarks.

Kerry, in an interview with radio host Hugh Hewitt to promote his new book, said that he has met with Iranian Former Minister Javad Zarif—the former secretary’s onetime negotiating partner—three or four times in recent months behind the Trump administration’s back.

“I think I’ve seen him three or four times,” Kerry said, adding that he has been conducting sensitive diplomacy without the current administration’s authorization. Kerry said he has criticized the current administration in these discussions, chiding it for not pursuing negotiations from Iran, despite the country’s fevered rhetoric about the U.S. president.

Kerry’s comments are in line with previous reporting on his behind-the-scenes attempts to save the nuclear deal and ensure that Iran continues receiving billions in cash windfalls. These payments were brought to a halt by the Trump administration when it abandoned the nuclear agreement and reimposed harsh sanctions on Iran that have nearly toppled its economy and sparked a popular revolution.

Kerry said he met Zarif in Norway, Munich, and other international forums.

As Iran continues to plot terror attacks across the globe and transport weapons to regional hotspots in Syria and Yemen, Kerry has tried to help Zarif preserve the nuclear agreement with European nations….

        Let me guess….his first 7 years were spent cleaning up after Bush, and he finally got around to his own domestic economic policies in his final year–and now Trump’s riding his wave.

        Some of what I recall from Obama’s 8 years:

        Open borders, Iran deal, businesses fleeing the country, the Benghazi cover-up/lies, and pro-Islam rhetoric: “The Future Must Not Belong To Those Who Slander The Prophet Of Islam”.

        Not to mention the now unravelling Russia Collusion plot, which is pointing directly to the weaponizing of his DOJ. Their anti-Trump bias and Clinton “protection” are being laid bare with the passing of each day.

        That’s why Obama’s back. If the Dems don’t take the House in November, Trump’s gloves will come off.

      Kerry, while in uniform, went to the Paris Peace talks and met with the Vietnam delgation. He informed the delfates that they should hold out for a better deal. He back stabbed President Nixon. Between he and Kissinger the left behind alive POWs never came home.

          The Armed Services Committee has stamped every piece of information concerning the POWs TOP SERECT. This underhanded manuver has prevented the families from knowing anything.
          Kerry and McCain refused to help the families. WHY was it so important to keep these men from coming home?
          From Nixon through Obama every one the presidents has put trade deals, ahead of bringing these men home.

          Years before I understood the POW issue; I read a blog where a contractor was in Siagon. He was at a table next to a group of Vietnamese officials and State Dept. representatives. Vietnam asked what were they to do with the POWs. S of D said ‘do whatever you want’.
          This conversation occured in the early 1980’s.
          I wish I could find this article.

        I’m old enough to remember that, too. It’s one reason why I have no respect or regard for Kerry–and if his face were any narrower, you could use it to chop wood.

        I will, however, question the poster who said that in the early 1980’s the State Department told the Vietnamese Communists they could do what they wanted with the remaining POW. In the early 1980’s, the Hanoi regime was still pretty confident that it was on the winning side of history, and had no inkling that its Soviet patron was starting to hit the skids. At the same time, we still had very little leverage to use on this issue. The US has always wanted a complete accounting of our POW/MIA (and some such cases go all the way back to WWII–when I was in China in 1992-94, they finally recovered a US plane that crashed in Tibet while “flying the hump”). When I was in the US Embassy in Bangkok, I actually worked right across the hall from the office that was handling the POW.MIA issue (we had no formal relations with Vietnam at the time).

      Westman, if someone sticks a gun in your face and is robbing or carjacking you, do you expect the police to warn him? If the law is being violated there should be enforcement. Good luck with this DOJ. It’s not like Kerry doesn’t know about the Logan Act after his Vietnam experience.

      Do I recall that Kerry is related to an Iranian official by the marriage of his daughter? Would that be the “representative” he admits contacting? Please, anyone, correct me.

    Logan Act is in existence indeed but to my knowledge it was NEVER tested in courts. And taking into consideration that there is big mess with the DOJ and FBI, I don’t think it is “enforceable.” Depending on results of midterm election, at least…

        That is the problem. The turkeys running the place no longer fear any repercussions from their idiotic votes and policies. When Gray Davis ok’d the exorbitant registration fee raise and presided over our fake electricity crisis, and squandered away a multibillion dollar surplus, he got recalled.

        Now, we have these dopes doing the same and worse, yet no repercussions. My opinion is that our voting process has been compromised, at least in part. Who the hell is voting these same clowns in year after year that keep taxing and spending, opening the prisons, and refusing to help throw criminals out that do not belong here? I think the Katie Steinle murder and trial tell me all I need to know about whose votes really count.

          California is *not* planning on leaving the US, though. Neither politicians or regular Californians are stumping for this.

People are leaving California in droves, in an exodus fuelled by high taxes, soaring house prices, increasing Agenda 21 restrictions (California is seriously kowtowing to the UN), and uncontrolled illegal immigration. Not even the beautiful weather and myriad historical and scenic attractions can attract new residents from other states. No shortage of Mexicans though.

    General Flynn was tried for violating the Logan Act. John Kerry will be exempt from such prosecution because he’s a Democrat. Democrats NEVER go to trial for usurping power from Republicans. John Kerry should be tried for treason and hanged.

    General Flynn was accused of violating the Logan act just by having a off handed meeting with some Russian businessman .This former Obama minion went to have unauthorized talks with foreign leaders on United States foreign policy plotting directly against a sitting President . This is treason ,I am not a lawyer but who gave Kerry any power to give any promises to change our foreign policy under this President ,he did this secretly ? Iran leaders have been calling for the death of America for the last 40 years, they have backed and bank rolled many terrorist organizations. If it was in their power to wipe America off the map they would they have not been secret or quiet about this .They are under current leadership thorn in Americas side ,would we tolerate a former non-elected members of government or former elected members of government to go to Japan, or Germany in 1938 to have talks to break trade embargos with them in secret? Will Kerry go on CNN next waving a piece of paper stating if he and his masters are put back in power we will bring peace in our time or will he do a chatty interview on “The View” saying it? We had 8 years of appeasement in our government as the world became a much more dangerous ,do we let acts of treason go unpunished or even admitted they have been committed?

He can do a opinion fluff piece in the NYT, he cannot do sensitive diplomatic talks with foreign powers that he is not authorized by the sitting President. Talks that are held in secret (sensitive diplomacy} that undermine the Presidents policy with foreign countries. This I think is an act of treason he admitted publicly.

        WPM, from other discussion it was explained by someone who knows more than I do the Hatch Act was enacted to make clear law on prohibited conduct. Treason charges under the Constitution are intentionally hard to prove. Those who wrote the Constitution saw the charge of treason abused in the UK and wanted to avoid that abuse here. Believe me that I would like to see JFK prosecuted in full for every violation.

          Even if he cannot be charge with treason ,I was answering the poster question how we knew JFK talk to the Iranians {Lorensacho.} of course Kerry admitted he talk to the Iranians. I said “This I think is an act of treason he admitted publicly” I did not say he could go to trail for treason . I think you and I both agree even if he cannot be charge with treason under law ,this act shows how low Obamas minions can go. They are given a free ride by the MSM in actions that are of great determent to America,s interest.

          WPM I believe we agree totally that he should be charged convicted and sentenced to the maximum lawful penalty for actions against the United States of America. The fact that he is not means that those derelict in their duty to enforce the law of the United States should be charged, convicted and sentenced along with him for “aiding, abetting, counseling and acting in furtherance” under 18 United States Code Section 2, for failing to prosecute and stop his criminal interference. It is unknown in my experience for any criminal in high office, government or business, to be acting alone.

    The Logan Act is unenforceable and likely unconstitutional. However it is worth noting that it is the same act that Obma’s hack DOJ, Sally Yates…. tried to use as justification to investigate Gen Flynn. At the time Flynn was the incoming Natl. Sec. Advisor, so having conversations with foreign governments would have been a routine part of his duties….the fact that he was doing it a few weeks before he officially assumed that position was at worst a technicality….but that didn’t stop Yates from trying to twist the law for political purposes. It’s not even comparable to what Kerry is doing because Kerry isn’t part of any incoming government and has no official standing to do what he is doing… but still, it’s likely legal for the same reason that the Logan Act claims against Flynn were bogus even as a technicality…. it’s a dead letter law.

    John Kerry is has no authority and not an official with a position to speak for the US government to rulers of Iran and therefore he is no business pretending to an official spokesman of the United States of America. By the meddling interference with US policies Kerry his can only do harm and not good at all .Since Kerry of out of office he obviously doesn’t know his place. Kerry is acting in insubordination to American constitutional law; he is in violation of the Logan Act. Furthermore, Kerry is a busybody and meddler and must be so pride –filled, arrogant and deluded that he actually thinks and feels that he know best. This interferer, Kerry, seems to not realize that is a not, at all, a spokesperson of office of the USA Kerry should be put behind bars – Lock him up.
