This is going to have to be decided: does the constitutional right to practice one’s religion allow one to plot the murder of nonbelievers, if that is what one’s religion teaches?

TAOS, N.M. (Reuters) – A 13-year-old boy who was part of group taken into custody at a squalid New Mexico compound last month has told FBI agents his mother’s boyfriend was training him to conduct “jihad” against non-believers, according to federal court documents.
The boy was among 11 children and five adults living at the compound in Taos County when it was raided on Aug. 3 by local sheriff’s deputies who discovered a cache of firearms and the children living without food or clean water. The dead body of a three-year-old boy was found buried at the site later….
In an affidavit filed in support of a criminal complaint, an FBI special agent wrote that Leveille’s 13-year-old son told investigators that his mother’s boyfriend, Siraj Ibn Wahhaj, 40, wanted to “get an army together” and train them for jihad.
The boy told agents that Ibn Wahhaj trained him and another of Leveille’s teenage sons in firearms and military techniques, including rapid reloads and hand-to-hand combat, and told them jihad meant killing non-believers on behalf of Allah, according to the affidavit filed in U.S. District Court in New Mexico.
The 13-year-old also told the FBI that his mother believed she received messages from God, and that he watched her and Ibn Wahhaj perform supposed “exorcism” rituals over the three-year-old boy, including one during which the boy choked and his heart stopped, according to the special agent’s affidavit….

GI, taking these cases one at a time is intended to overwhelm and bankrupt the entire legal system. For every case that is presented a million dollar check, more or less, must be written by the taxpayers to fund the judges, prosecutors, defense, court reporters and juries. Then budget another 100 dollars per day for every day each one of “them” spends in jail. All the while this is going on, people are pouring money into false charities, getting tax deductions and subsidies for the purpose of continuing the attack and conquest of our society. It can be stopped. Consider the number of muslims we know about being present in the US. If just 10 percent of them had to be prosecuted for just 1 crime each, do the math and see how long it could continue before our teetering economy would be wrecked-THEIR GOAL.

Mac, I more than once was assigned as appointed defense attorney in misdemeanor, (not that serious charges) cases where the defendant was caught in the act and demanded a trial even though a really good plea bargain was offered. PLEASE do not blame the lawyer(s). They are required to make any argument the client demands as long as the argument does not violate the lawyers’ duties. Please read the case of Nix v. Whiteside, a United States Supreme Court case where a defendant wanted his lawyer to aid in perjury, the lawyer refused, the defendant was convicted and appealed for ineffective assistance of counsel. The conviction was upheld.
Without a competent and zealous defense there can be no valid conviction. I had another case where I was hired to represent a corporate client which I considered to be morally reprehensible; and told them that Adolf Eichman received the absolutely best defense Israel could offer in his trial for killing 6,000,000 or so Jews. They understood I did not care if they wanted to hire me in the future as long as they stayed in that same business.
The issue of the criminal teachings of islam will appear again and again until those issues are faced and litigated to a final conclusion. The religious *form* of islam does not shield the*substance* of a criminal conspiracy to kill, enslave and destroy the Constitution..

Mac, I worked from 7 am to 3 pm at 1 job, drove an hour to work 4 to 12 to run a movie projector 5 days a week, and then worked 12 hours each Sat and Sun to save a third of the money I needed to go to law school. During law school I was the last person in line to work at any of 13 different theatres scattered all over a very large city with horrible traffic. Most of the time when I got called the regular projectionist didn’t make it.
I went to law school because, to put it mildly, I did not like most of the lawyers I encountered. I made a terrible vocational mistake. I did not obtain any vocational counseling. More than 40 years later I still cannot stand many of the lawyers I see and know. But there are a few really good ones that I try to duplicate. I was given a generous break by someone who could have made it really hard to obtain my first license. I promised him that I would do all I could to make sure he never regretted giving me that break, and have kept that promise to this day.
I ask you and everybody who gets upset with defense lawyers to remember that they are just as vital to due process and obtaining a conviction that will be upheld on all appeals as admissible evidence. The clearly defined duty of a defense lawyer is to force the state to prove its case. The prosecutor has the duty not to seek false convictions, but to find the truth. It is a good system when it works. Do some searching and reading about Mike Nifong, the prosecutor who didn’t.

Mac I use enough of my real name so that the bar I hold very dearly will never think I am trying to hide anything from them. I have seen and suffered from judicial corruption at the highest levels of federal and state judiciary, but to my gratitude not in the state where I live now and was presented my first license. I am feared for good reason because I stood up to and exposed some of that corruption. I had nothing left to lose by doing it. Needless to say I did a lot for the first time and learned a lot to make the fight easier and better if there is a next.
Judges can be appealed. Judges are immune from private civil suit, but e not immune from criminal prosecution. Se, e.g. Walter Nixon and Alcee Hastings. Law enforcement officers are not immune from suit, see Bivens v Six Unknown Named Agents of the Federal Bureau of Narcotics. Prosecutors are not immune. See all the various cases and reports regarding Mike Nifong. Defense lawyers are subject to every kind of attack you can imagine. If people are willing and able to fight, corruption can be challenged.
I am older than you and retired for good reason. That does not mean I am useless; but it does mean that the most productive contribution I can make is to help those who are younger, fit and less experienced see opportunities.

Mac, the attorneys are almost certainly appointed by the court and paid by the taxpayers, Each one of the defendants must have an attorney to prevent conflicts of interest as the case progresses. I cannot imagine any of the excellent private attorneys I know, who have handled “high profile” criminal cases taking this case for anything less than a million dollars per defendant paid in advance. This case will go on for years if it is tried and will almost certainly reach the US Supreme Court.
The defense lawyers, in my opinion, did all of us a favor by making the claim that this jihadi plan is a Constitutionally protected exercise of religion. If the prosecution will just honestly and directly present the case for “substance” over “form” and “criminal conspiracy” instead of “Constitutionally protected religious practice”, my proposed issue will be established and the first step to stopping the ongoing invasion and conquest will be taken. In my experience the best way to see that something is not done is to leave it to someone else to do.

I live in a small community with what I consider an absolutely excellent police force, and still am armed all day. I have made a lot of people very unhappy with me since I graduated from high school, and they have not gotten happy. The MOST INTERESTING part is at 7:40 to 9:35. Peterson asks Robert about the NEW MEXICO COMPOUND and Judge Sarah Backus who who more or less “let them off” on some technicality. Robert discusses the prominence of the jihadist’s father (per Wikipedia: Siraj Wahhaj is an African-American imam of Al-Taqwa mosque in Brooklyn, New York and the leader of The Muslim Alliance in North America. He was also the former vice-president of the Islamic Society of North America). Robert is of the opinion that the GREAT FEAR is that the MUSLIM BROTHERHOOD WILL BE DECLARED A TERRORIST ORGANIZATION and this will then LEAVE THEM OPEN TO PROSECUTION.

Carol, I have not watched the video. The legal question of “substance” over “form” has been litigated at length and with great success many times in US tax questions concerning fraudulent religious activities a long time before I went to law school more than 40 years ago. Contrary to what many who have tried to stand me down, who obviously have never had a tax course at the Doctoral level (about 20 of the 88 hours of a law degree are tax related), form never controls substance. Criminal enterprises and conduct never generate tax deductions, and consequent tax subsidies for their activities. In fact, just making contributions to criminal enterprises is itself a crime. At times it can be fun to play lawyer. But it becomes dangerous to play lawyer when not a lawyer. What you see on television in lawyer shows leaves much unexplained. To be a lawyer requires, assuming an accredited degree, 88 semester hours at the Doctoral level (a Ph.D requires 77). It requires passing a bar examination that in many states lasts 3 days that is not open book. It also requires an application and determination of character and fitness. To continue being a lawyer required Continuing Legal Education, so that any changes will be better known, and reminders of what may have been lost or forgotten will save embarrassment.
What non-lawyers *think* is the law is usually not because there is quite frequently something they do not know and will never admit they do not know long enough to see what they don’t know. How many times in my posts do you see me write that I will cheerfully appreciate correction is I am in error? Many lawyers are not afraid of learning better.
I have had several prospective clients come to my office for an interview where they proceeded to tell me how to do my work, as though I were only their secretary. That cannot be allowed by a licensed attorney who wishes to keep the license he has spent, in my case about a quarter of a million dollars, 3 years of work in school, 3 years before school working 2 jobs, and all kind of misery to meet the requirements for the license in the first place. They were directed to find another attorney.
I have a number of lawyer friends with whom I have made common cause for about 25 years. One of them happens to be both a lawyer (J.D. with a license) and a retired teaching tax professor (Ph.D and CPA). I asked him to review my comments on this article. I believe he found them to be acceptable. To hold steadfastly without any question that islam is exempt from all legal challenge because it is a religion is a gross error and misstatement of the law. There is a way to attack and win if someone with the will and resources wishes to “Light one candle instead of cursing the darkness”. Endless cursing leaves much to be desired; and with between 1 and 4 people every 3 minutes for 1400 year dying, a huge death toll.

I wrote in error, my friend reviewed my comments on CAIR suing the federal government, not this particular article.
IT IS POSSIBLE *my speculation* that there was coordination between the state and federal prosecutors. Under the legal principle of dual sovereignty, both the state and federal courts can prosecute a defendant for the same acts which violate both jurisdiction’s laws. I had a case where the feds were waiting for the state to act, and the local district attorney was waiting for the statute of limitation to run so he didn’t have to do anything. One call to the state attorney general’s office got things rolling and the defendant was convicted in both courts, once for stealing money, the other for tax evasion.
In this case if the state or local prosecutor did a thorough and correct job it could easily bankrupt their budget. Missing the deadline gives the state side an excuse to get out and the feds time to get the permission they need to proceed on a case which requires approval from “on high”.

Carol, many years ago I was asked to defend a man in a municipal court. He was convicted and sentenced. Because of his health problems the sentence would have bankrupted the municipality. The prosecutor asked me to appeal the conviction in order to save the city. The defendant learned his lesson and the city was not bankrupted. Justice was served.
I believe God expects us to do our part.

GI this is not the time for anyone to tell false tales or blow smoke. I asked a friend of about 25 years, who helped me recover after total loss, to review my comments. He knows more than I, and both of us have dealt with many tax issues, that form (religion) never controls substance (criminal conduct). I am too old and not in sufficient health to handle a case. But I can and will help, free of charge if necessary, to present and win such a case.
An applicant’s grade is not given for a bar examination unless the exam is failed. I am told that I passed mine with comfort. One of the questions on ethics dealt with “ambulance chasing” which is soliciting employment for a fee with a prospective client who is previously unrelated. I correctly answered that question by recognizing where a lawyer feels a case is so important, he may volunteer to assist without violating the rule against solicitation. The potential to stop islam dead in its tracks in the United States is worth my effort. I can and will do what I can within my limitations to help. The lawyers already mentioned as being in contact with JW are more than qualified. I would add one more for his specific experience with islam. I have worked with many lawyers on many cases either handling all of matters where I was “specialized” or with them in other matters where all of us needed the combined expertise. This may be the reason I did not stay dead during my surgery.

GI, abuse of claims of religious status has been fought, and the claims defeated long before I went to law school over 40 years ago on the “substance” over “form” argument. It is just a matter of using those cases in present cases to apply those decisions as precedent. The form of islam may be religion, but the substance is criminal conspiracy, destroying all legal protection it has in the United States, including all tax exemptions and deductions, and making any assistance or contributions criminal acts.

Carol, it is not my card at all. IRS has been destroying fraudulent religious charity claims long before I went to law school and studied the cases. Form (religion) never shields substance (any fraudulent or criminal conduct). It is established law that should be applied today. My only contribution is making the connection.
Please let me tell another story as an example: Six people tried for a year to write a computer program. I was hired and given six months to put up or shut up, either write the program or there is the door. It took 4 weeks to figure out how information flowed through the office and make it connect to the program, and how to write it. The program was written in one really long day, a week to keypunch it on about 1,000 96 column cards and another week to find the period that should have been a comma. The program worked and achieved every goal my boss set. He found other work for me and sent me to law school 4 years later. Sometimes it seems that connections can make a difference. It has taken me about a year to make this one. But I believe it can work.

Carol, when I wrote that computer program I started only with preparing data for a similar program at another utility as a co-op student. Every line, every step, every subprogram that I wrote was original. The language was written by others, as was the operating system, and the office flow designed by others. The six people in the committee each knew a piece of the puzzle but could never get together for the solution.
I had the good fortune of 3 really great tax professors in law school, and 2 outstanding mentor tax professionals when starting my practice. IRS made the law and fought the cases that can produce victory now. I don’t care about getting credit. We NEED results.
