The wife of an Al Qaeda chief had her human rights breached by UK airport police, European judges have ruled.
Sylvie Beghal, 49, was stopped at East Midlands Airport while returning to Leicester after a visit to her husband Djamel Beghal in a French jail.
The mother of three said she was detained without reasonable suspicion – violating her right to private and family life.
Her claims were rejected by the High Court and Supreme Court but the European Court of Human Rights eventually ruled in her favour.
The Home Office said it was disappointed by the ruling, which it has three months to challenge.
The airport incident in 2011 had led to Mrs Beghal being charged with failing to help officers – an offence under Schedule 7 of the Terrorism Act 2000.
Lord Carlile of Berriew, who was the independent reviewer of terrorism legislation from 2001 to 2011, said: ‘Schedule 7 is absolutely key to the protection of the public in the UK and to national security.
‘It has to be used carefully and proportionately, as recognised when the law was amended in 2014. But I’m very surprised that this case has resulted in such a ruling, particularly given the factual background.
‘I fear we have to put this down to a questionable decision by the ECHR. In my view the British courts were right and correctly took their decisions in this case.’
Tory MP Andrew Bridgen, whose constituency covers the airport, said: ‘It’s sickening. These people are big on human rights but not so much on their responsibilities.
‘We all have a duty to cooperate with the police with regards to terrorism and anyone who doesn’t want to is breaking the bond of loyalty to our country.
‘It’s great she can use the law to protect her own right to family life, but she has strong links with a convicted terrorist and Al Qaeda have not shown any regard to human rights in the past with their victims.’
According to court documents lodged at the ECHR, Mrs Beghal was stopped at the airport after visiting her husband with their children.
Officers said they wanted to talk to her to establish whether she might be ‘a person concerned in the commission, preparation or instigation of acts of terrorism’.
She refused to answer questions until a lawyer was present and after 30 minutes was told she was free to go. But she was later charged under Schedule 7 and pleaded guilty at Leicester Magistrates’ Court in December 2011.
She then launched a legal action, claiming the powers given to police under Schedule 7 did not have adequate safeguards to be ‘in accordance with’ the European Convention on Human Rights.
Her case reached the ECHR in January 2016, which last week ruled in her favour. Judges told the Government to foot her £21,531 legal bill….

Concerning the topic of American Airport Security before September 11, 2001 during the 1990’s which seemed be sadly nothing but a hoax of show for the public. For a year of that decade I had a job as a security screener. As a type of airport security guard all of us, the security personal, had to follow the rules which allowed and non- serrated knifes and box cutter on the airplane as long as the sharp objects where under two inches long .So during a visited from one of the top person of the security company I told her “Those non-serrated knifes and box cutters can still be very dangerous and harmful in the hands of the wrong person.” Her response to me for saying that was only silence and an angry look that gave the message “Don’t you dare ever say such a thing as that again.” As for the security supervisors said to be “In my opinion this is just a set of as a [empty] show for the traveling public to make them feel safe.” One time a man walked through the metal detector and the alarm, buzzer, didn’t go off when he was wearing a rather large metal belt buckle. So he informed me about it. So I replied “Standing over there next to each other is the security manager and security supervisor its best if you inform them about that.” After he informed them they thanked him and said that they would look in that, they didn’t. Other time a supervisor said to me that “This security set up is bull S….” He even berated me for ,a number of times, when I called for bag check saying “Does that look like a test item ?” He really didn’t want to bother to get off his seat for make a bag check. I said to him “ I can’t see through the item maybe something dangerous is hidden being it .” On hearing that and he threw his head back and went through his eye rolling routine as to say “Don’t start getting ridiculous on me, nothing awful will ever happen.”
All this is ,somewhat ,related to a news report in the year 2005 about another airport ,the Chicago airport, which the news crew had a hidden counting devise and a hidden camera. They had counted one thousand bags went through the airport security and not even once was a call for a bag check. Went that confronted the security supervisor about that he said “There was nothing suspicious to call a check about” The news crew said “Still after a thousand bags, and not one need for a bag check call” That supervisor just restated “There was not a need for a bag check call.” Of course he wouldn’t change his story. If that airport was like the one of works at the call was not made because the security supervisor would “tell off” that security screener for making a call for a bag check.

This is the European Court of Human Rights and is NOTHING TO DO WITH the EU but belongs instead to the Council of Europe. Leaving the EU will NOT, therefore, take us out of the ECHR (regrettably). Stupidly the UK signed up to this particular Court and its associated Treaties some time ago and many of us in the UK have been trying for years to get us out of it. The stupidity, illogicality and dubious legality of its rulings has been obvious for many a long year but successive UK governments have failed to act despite promising to. The elites of Europe love this so-called Court because it enables them to violate the human rights of anyone who protests against them.

I agree with the ECHR on this one. A simple beheading would have been much more dignified way of proceeding. Subjecting this poor women to a few questions just to protect innocent British citizens was going way beyond the pale. Hopefully, this will help the British people to rethink Brexit.

The European Court is a laughing stock for almost everyone but it seems like they have already picked their master and most every court goes the same way. The latest of these is a recent ruling by Germany’s highest court of civil and criminal jurisdiction, declaring that a new law banning child marriage may be unconstitutional. The reason, apparently, is that the court found that all marriages, including Sharia-based child marriages, are protected by Germany’s Basic Law. If this is also taken to the EuGH the child marriage will probably be ruled unconstitutional in all of Europe. They simply make me sick and I hope that the British People go on with the Brexit.
