Canada: restauranteur Mohamad Fakih awarded 2,500,000 in defamation suit

“A self-styled online media personality whose websites frequently air anti-Muslim content has been ordered to pay the owner of a prominent Middle Eastern restaurant chain millions of dollars after publicly accusing him of funding terrorism. Ontario Superior Court Justice Jane Ferguson ordered Kevin J. Johnston to pay a total of $2.5 million in damages for defamation to Mohamad Fakih, the owner and founder of Paramount Fine Foods.”

Canada does not have the First Amendment. In Canada, free speech….

can be limited to protect other rights or important national values. For example, freedom of expression may be limited by laws against hate propaganda or child pornography. Section 1 of the Charter says that Charter rights can be limited by law so long as those limits can be shown to be reasonable in a free and democratic society.

In August 2017, Global News published an edition the John Oakley Show: OCLA [Ontario Civil Liberties Association] wants “hate speech” removed from the criminal code.

The OCLA in fact started “a petition to defend the free speech rights of Kevin Johnston”.  Denis Rancourt, who is a researcher at Ontario Civil Liberties Association, discussed “the OCLA petition to Attorney General Yasir Naqvi to retract consent to lay hate crime charge on Kevin Johnston”, and you can listen to at this link HERE.

A self-styled online media personality whose websites frequently air anti-Muslim content has been ordered to pay the owner of a prominent Middle Eastern restaurant chain millions of dollars after publicly accusing him of funding terrorism.

Ontario Superior Court Justice Jane Ferguson ordered Kevin J. Johnston to pay a total of $2.5 million in damages for defamation to Mohamad Fakih, the owner and founder of Paramount Fine Foods.

Johnston, who operated websites including FreedomReport.ca and recently came in second place in Mississauga’s mayoral race, posted multiple videos attacking Fakih.

In the videos, shot in 2017, Johnston made a series of incendiary statements including a claim Fakih was an “economic terrorist” with backing from the Pakistani spy agency.

He also alleged restaurant policy barred staff from admitting anyone who wasn’t a “jihadist.”

Ferguson says Johnston’s words amounted to hate speech that called for particularly strong condemnation from the court.

“In this fractious 21st century — where social media and the internet now allow some of the darkest forces in our society to achieve attention — (issues raised by the case) are numerous and profound, and their impact extends well beyond the borders of this country,” she wrote in her decision released Monday.

“Motivated by ignorance and a reckless regard for acceptable norms, the Johnston defendants’ behaviour reflects a contempt for Canada’s judicial process, an abuse of the very freedoms this country affords them and a loathsome example of hate speech at its worst.”

Johnston did not respond to a request for reaction to Ferguson’s ruling, and the paralegal who represented him during the defamation suit could not be reached for comment.

According to Ferguson’s decision, Johnston and another man shot the video footage on July 20, 2017, while a fundraiser for Prime Minister Justin Trudeau was taking place at Paramount’s flagship location in Mississauga…..

      Well apparently not. Why he would accuse someone of terrorism if he couldn’t prove it is bizarre, as is his hiring a paralegal to defend him. Johnston has been a strong advocate against Islamization of public schools in the Regional Municipality of Peel, but his zeal appears to have gotten the best of him, assuming the Court’s Judgment is reasonable.

        Even if Johnston was mistaken–and that central point is unclear in this ruling, since truth is often no defense in Canada now–demanding that he pay 2.5 million is clearly grotesque.

          As the Court demonstrated in its reasons, Fakih by law would have been entitled to much more than $2.5 million in damages. There was strong evidence that the damages Fakih’s businesses suffered much more than $2.5 million in damages from Johnston’s libels. However, Fakih only asked for $2.5 million.

The most recent claim of Rachid Talib (a muslim) claiming that the Palistinian people reached out to Jews after the Halocaust massacre. The MSM claimed her statement was taken out of context. Wrong.

          Our Canadian Legal system is tainted and corrupt. Look at the SNC-Lavalin scandal and the Mark Norman case. Justin Trudeau re-writes his own rules, hand picks Liberal only judges.

          I am aware Trudeau & Google & Micrsoft & Facebook had met for several meetings. Google has been scrubbing (removing) terrorist groups and names, including news stories that were all previously in the news pre-Trudeau being elected in 2015.

    Kevin J. Johnston is a Canadian patriot who speaks for many Canadians who see Islam as political ideology of supremacism … but don’t know what to do about it. The current atmosphere in Canada is still that of official multiculturalism, which means that anyone who wishes to preserve traditional Canadian values is branded a ‘racist’, regardless of whether they are black, yellow, red or brown. There are many Canadian aboriginal Indians who want to preserve their Canadian values too but they are never called ‘racist’. The native Canadian Indians are equally concerned about the rise of Islamic supremacism in Canada. Islamic supremacism is a destroyer of indigenous cultures, because they are forcibly assimilated into Arab-Mohammedan culture by the Islamic supremacists wherever they seize political power. The process of Islamization has begun in Canada, aided and abetted by the Canadian Leftists who are using Islamic allies to destroy Canada’s traditions and cohesiveness. The restaurateur in question is well-known for his charitable donations and support of Liberal candidates who support Islamization of Canada. He has a right to do so. Apparently, Liberal sympathizers don’t want us to criticize the process of Islamization that they are implementing against the will of most Canadians.

        I agree Terry. It is not “patriotic” to make unsubstantiated defamatory allegations. In fact it is very counterproductive to do so since it detracts from one’s cause and puts it in a poor light casting doubts on accusations that are similar but truthful. He unintentionally gave his “enemies” ammo.

        Agreed Terry. Defamation is defamation. The truth would have nullified the suit but he didn’t provide that evidence. Free speech and even the American First Amendment do not allow for defamation; you can’t ruin another person’s reputation.

        I’ve followed Johnston on and off for some time and he does have a record of “going off half-cocked.” He should have chosen his words better. I suspect he didn’t even apologize, which is what any decent lawyer would have advised in such a case.

        And as you well know, Terry, in Canadian tort law, a loss of income/revenue is always assumed in defamation. It appears the wronged Mohammadan has a pretty robust business and that probably explains the huge penalty.

        I don’t know how he’s going to deal with $2.5 million in damages. I’m not sure in Canadian law if he can sidestep it with a claim to personal bankruptcy. I suspect not. Does he appeal and start up a fundraising campaign? Who knows.

    A fund raiser for trudeau in his establishment in July 2017? That in itself would grate those who by that time had many valid issues regarding trudeau. The truth behind all of this, on both sides most likely will never be known. One thing for sure, something like this should never have happen in Canada, and the recipe for it should be removed from Canadian soil, to prevent it being repeated.

    One eighth part of zakat is required by Sharia law to be devoted to jihad.
    Every muslim who pays zakat subsidises jihad.

      I’d love to find the source of this. Is this true? Where would I find it in the Koran or the Sunnah? I’ve never heard of it. I’ve heard that charity to non-believers is not considered valid for zakat but not this. This would be devastating to Mohammadans!

    Harassment of Muslims is just fine with jihadwatch. This Muslim deserved it for being a Muslim. He has no choice but to take it because he’s Muslim. Of course if he was Jewish and Johnston a Muslim, this place would have rioted. The real problem is that the restaurateur is a Muslim. That is enough to be guilty and to deserve all the hate possible. It does not matter that he is a success story and has made a thriving business.

    And a judge said he must pay $2.5 million? Why not his right arm? The statement is almost nothing. The punishment is a crime. The judge is a type of terrorist against reason and the right to defend against the terrorism that is inflaming the globe, Islamic terrorism. This judge should be disbarred.

    Experience tells me this “Muhammad” guy is deep in the Islamist network, but good at pretending he isn’t.

          News coverage of court proceedings are necessarily brief summaries of the evidence and reasons for judgement wrapped by the reporter’s biases. They cannot be taken as a comprehensive and fully accurate assessment of either the evidence or reasons for judgement.

And that has nothing to do with the judge’s ridiculously excessive fine that no amount of mere words could warrant, much less the milktoast example given in the article.

      Yasir Naqvi is a Pakistani Muslim.

      A few years ago he endorsed a book, “Islam: Balancing Life and Beyond” that condones men physically punishing their wives. In a reply in the National Post, he “…acknowledged that he wrote a letter of support for the book two years ago, but says he didn’t read it…”

    The judge’s predictable but unreasonable fine was designed to put a stop to speaking unfavourably of the Islamic Ideology in Canada.
    Very technically what Kevin Johnston said was true. Paramount Fine Foods advertises and carries Halal foods – that are “HAND SLAUGHTERED”. Besides promoting a cruel practice into Canada, this makes Paramount Fine Foods Sharia compliant so that means part of their income goes to support jihadist activities – and you can bet that a percentage of this settlement, unless appealed, will go to supporting terrorism as well. Technically, any Orthodoxer who goes through its doors is a jihadist because allah calls all believers to be jihadists. If they refuse the call, then they are technically apostates, designated to be assassinated. They can’t be believers and be moderate because there is no moderate Islam because Islam was dictated by Allah through Gabriel and of course it has come perfected.
    The sad parts to this case is that
    1) Mr Johnston understands fully what the danger is but his tremendous energy and anxiety that no one is getting it is being misdirected and therefore open to criticism.
    2) Mr. Johnston should have gotten himself a lawyer that is thoroughly knowledgeable and clever in the 3 parts of the Ideology, as Michigan has with Robert Muise of the Freedom Law Center.
    3). Mr. Johnston should have insisted that the entire case was to be open to the media and publicized.
    4) Mr. Johnston should have been able to bring into evidence that the quran, the life of Mohammad who is the divine prototype imitated by all believers, and the hadiths, teach genocide, hatred, dhimmitude, and Islamic supremacy of the believers.above all creatures including the majority of Canadians.
    5) Mr. Johnston should have had the opportunity to point out the Explanatory Memorandum and its intentions for North America.
    6) Mr. Johnston should have pointed out that he was treating an Islamist as a dhimmi in Canada just as a dhimmi Christian is ordered to be treated in any Islamic majority country…..
    and many more points that may have educated the judge to be more moderated in his extravagant award that was intended to silence islamic criticism. I wonder if he had backdoor instructions and not just ignorant.
    For the future, we need a team of educated pro bono lawyers because this is just the beginning of the persecution of those who stand on the wall sounding the alarm and will be called islamophobic blasphemers.
    Time to saturate some willing lawyers with a thorough grounding in defending those falsely rounded up and to insist that this judgement be promptly appealed.

        We never use the moniker “muslim”. Dr. Bill Warner instructs to use only words that refer to the Islamic Ideology because the only “2 Muslims” anyone needs to know about are allah and mohammad. “Believers’ is a more accurate term that brings with it all that allah, mohammad, and the hadiths order. Dr. Bill Warner pointed out that there are 1.2 billion and more followers practicing various levels of the Ideology but only 2 that we have to be thoroughly educated in if we want to protect the many good facets of our Western civilization which is under threat of going the way of the Dodo.
        It can’t be helped …. The 5 + 2 requirements of being a believer includes Sharia finance ….
        zakat which is distributed to finance the globalization of the islamic ideology. He can’t help himself.
        Allah has ordered, ***Quran (8:12) – “I will cast terror into the hearts of those who disbelieve. Therefore strike off their heads and strike off every fingertip of them”
        It is also an obligation to immigrate and proselytize but not to integrate.Q. 5:52 – “O you who believe, take not the Christians and the Jews for friends ….”
        Paramount Fine Foods advertises it carries Halal meats slaughtered according to the dictates of the system. it also carries no pork products which is another way of being Sharia compliant. That opens it to questions of where their first loyalty lies.
        Mohammad said in a pinch they could have pork. They just can’t enjoy it nor go up for seconds.

          Islamists need to be confronted with the truth of their Ideology and how it is not welcome to destroy our Civilization.
          5 times per day their prayers lead with, “GUIDE US TO THE STRAIGHT WAY OF THOSE WHOM YOU HAVE GRACED(the believers), NOT THE ONES WHO YOUR WRATH IS AGAINST(the Jews), NOR THE LOST ONES(the Christians).
          Every believer at every age is raised with this preamble. Do you know of any other sect, religion, culture in North America that works at imprinting denigration on its members towards EVERY other that isn’t of them and is so widespread and entrenched?
          Sure it is against our nature to turn the tables but it will be political correctness and being polite that will be the undoing. Across the oceans they don’t want to live side by side – they kill us. If no one has pointed it out, this is war for our survival. It must be won by words now before weapons later, don’t you think?
          What is your strategy that we can use? Remember that from a young age they all witness the live, cruel slaughter of animals. This certainly desensitizes them to killing especially when they are taught that we are the worst of all creatures.
          What was it that Mr. Johnston said that was not truthful and be specific please?

    I think Johnston’s using a paralegal just means that he is not all that savvy about the law–not that he is necessarily guilty.

    Kevin Johnston is not stupid and there is no way he would not know the difference between the kind of representation he would get from a paralegal as opposed to a lawyer. I think the decision speaks to his financial resources, or perhaps his belief as to whether he might be successful.

      I think that using a paralegal as representation is unwise–I don’t believe it means that he deserved to be found guilty and forced to declare bankruptcy, though.

    I haven’t followed this particular case closely but I used to watch Kev on Youtube. I unsubscribed after I realized he was doing more harm than good to the counter jihad with some of his appalling and exaggerated statements which are crafted for maximum shock value.

    Also, on more than one occasion, he has conflated race with issues concerning Islam (saying ‘white people’ instead of non-muslims, kafirs, etc). This only gives more ammo to the alt-left in painting us all as racists. There’s a small but noisy contingent of similar types in Canada that appeal to the lowest common denominator in the counter jihad movement. We need to be rational and stay on message. Bill Warner has it right. Focus on Islam – not muslims or muslimology.

The one that bring up doing fund raiseing for the liberal party is proof of being a terrorist have no bavsis in law. Raiseing money for Islamist Relief is raiseing money for terrerist is base on hear say evidences.
