UK: Muslim migrant with 18 convictions could be deported; lawyers claim deportation would breach his human rights

Britain, and other Western countries, are in the fix they’re in today because of people such as MS’s lawyers, who consider the safety of their fellow countrymen less important than the safety of foreigners. MS may face the threat of violence in Somalia, but that doesn’t mean that Britain must keep him in the country despite the fact that he poses a threat of violence to British citizens. Must Western countries carry all the world’s problems, at the expense of their own citizens? This man has forfeited the right to stay in Britain by committing so many violent crimes. The UK government could warn the Somalis that they will face various penalties, economic or otherwise, if they harm him, and then send him back. But that would require some sanity in the British government, which hasn’t been sane for years.

“Asylum seeker, 30, with 18 convictions and a history of violent crime is fighting to stay in the UK after claiming his human rights would be breached if he’s sent back to Somalia,” by Emer Scully, Mailonline, August 6, 2019:

A 30-year-old Somali refugee who has racked up 18 convictions including drugs, firearms and theft offences could face deportation – but lawyers argue this is against his human rights.

The refugee, identified only as MS, faces the threat of deportation after two previous judgements allowing him to stay in Britain were overturned by the Court of Appeal.

But his lawyers say he cannot be sent back to Mogadishu, Somalia, because as a member of the minority Ashraf clan he faces the threat of violence there, The Times reported.

Article 3 prevents the UK from deporting or extraditing people to another country where they would face a real risk of being tortured or subjected to inhuman or degrading treatment….

Despite MS presenting a serious threat to public safety he could still be allowed to remain in the UK, according to officials.

His case will now be returned to the immigration tribunal in the latest instalment of a five-year legal battle.

MS has been convicted 18 times for 25 offences committed between January 2006 and September 2015.

These crime include three offences against the person, two against property, one fraud, five thefts, three relating to public order, three offences relating to police, courts and prisons, one drugs and one firearms offence.

There were also another seven miscellaneous offences.

If deported to Somalia he could be the target of attacks which means UK courts have to consider whether his deportation would be in breach of his human right not to be ‘subjected to inhuman or degrading treatment’….

      Absolutely. All migrants should be required to sign a legally binding document if they commit any crimes;
      other than simple things like speeding, parking tickets or simple shoplifting;
      after being given asylum it will be revoked and they will be deported with no appeals. Living in another country is a privilege not a right.

        So now being in Britain has risen to the level of a “human right”? Maybe now is the time for Robert Spencer, Michael Savage, Pam Geller, Martin Sellner, Brittany Pettibone, Lauren Southern and others to assert their human rights to be in Britain. And do those presently there merit protection? The little girls of Rotherham? Returning British soldiers? British citizens? Tommy Robinson? Or just MS?

        Put a fork in Britain. It’s done.

    Wait. He is a member of the minority Ashraf clan? Are members of this clan not also Muslims? I thought Muslims were supposed to treat each other with love. I need more explanation on this one.

      I guess this Muslim is the wrong kind of Muslim. But how can this lawyer smear the entire Muslim population of Somalia with the contention that they would be so “racist” as to kill this man because of his “clan?”

      Ohio Governor Mike DeWine today announced a series of legislative reforms to address gun violence and outlined further action to increase mental health prevention, identification, and treatment to better protect Ohioans.

      “Gun violence doesn’t just take the form of mass shootings, people are victims every day in Ohio and across the country,” said Governor DeWine. “I believe that this is both a public safety issue and an individual wellness issue – we must address both sides to help solve the problem. It’s time to do something, and that is exactly what we are going to do.”

      This series of solid, workable reforms will help get guns out of the hands of people who should not have them under the law while protecting the rights of law-abiding citizens who are entitled to the right to bear arms and will help prevent and treat those struggling with mental illness.

      Governor DeWine’s proposals include:

      Safety Protection Orders. Governor DeWine is asking the legislature to pass a law to allow courts to issue ….

      Safety Protection Orders which would remove firearms from potentially dangerous individuals and get them the mental health treatment they need all while maintaining an individual’s right to due process.

      Increased Access to Inpatient Psychiatric Care. Over the past several years, Ohio’s state psychiatric hospitals have become predominantly used by patients who are court-ordered there for restoration to competency to stand trial. This week 79% of the adults in our state psychiatric hospitals are under court order. The Ohio Department of Mental Health and Addiction Services (OhioMHAS) is working to create a process where courts and community-based providers can work together to restore competency for those to stand trial in an outpatient setting which will free more hospital beds and decrease wait time for admission. The Ohio General Assembly will need to pass legislation to create this community-based misdemeanor competency restoration process.

      Early Intervention. As part of the 2019-2020 biennium operating budget, the state is investing $675 million in wrap-around services for schools to design individualized programs, working with local mental health providers or social service organizations, to address the social and emotional challenges our students face.

      Access to Behavioral Health Services. The Ohio Department of Medicaid is investing $15 million in telehealth mental health services to students, so no matter where a child lives, they have access to high-quality mental health care.

      Risk Factor and Resource Identification. OhioMHAS will be working with communities to increase knowledge of risk factors, help parents identify when their child is showing warning signs of a mental illness. The department will share screening tools with clinicians and help connect community-based services to link parents, families, and schools with proven supports and strategies to manage a child’s wellness over the child’s lifetime.

      Background Checks. Governor DeWine is calling on the Ohio General Assembly to pass a law requiring background checks for all firearms sales in the state of Ohio with certain limited, reasonable exceptions, including gifts between family members.

      Increased Penalties for Felons Who Illegally Possess Firearms. Gun violence occurs in neighborhoods and communities every day across Ohio and the nation. Law enforcement reports that the majority of this violence is perpetrated by a relatively small number of individuals who don’t have the right to possess a gun. Governor DeWine is calling on the General Assembly to increase penalties on felons who illegally possess or use guns.

      Increased Penalties for Violent Felons Who Illegally Possess Firearms. Governor DeWine is calling on the General Assembly to increase penalties for violent felons and other people found with a gun they do not have the legal right to possess. The crime of having a weapon while under a disability is currently a third-degree felony punishable by a maximum of three years in prison. On a first offense, the crime should be a second-degree felony punishable by two-to eight-years in prison, and for subsequent offenses, it should be a first-degree felony punishable by three- to eleven-years incarceration.

      Increased Penalties for People Who Commit Felonies While in Possessing Firearms. This proposal would increase penalties for people who commit felonies with a firearm or who possess a firearm while committing a felony to a mandatory additional one- to three-year sentence.

      Increased Penalties for Brandishing a Gun. The General Assembly should pass a law that increases the penalty for those who commit a felony while brandishing a firearm to a mandatory three- to five-year sentence.

      Increased Penalties for Straw Purchases. So-called “straw” purchases, the act of purchasing guns for or giving guns to another individual are currently illegal under Ohio and federal law. However, this practice is far too common, so Governor DeWine is calling on the General Assembly to increase the penalty for a straw purchase to a second-degree felony punishable by two to eight years in prison.

      Increased Penalties for Illegally Obtained Guns. We should increase the penalty for a person who possesses a firearm that they know was obtained through an illegal or fraudulent purchase in order to avoid a federal background check. A person who possesses the gun should be punished in the same manner as a person who bought the firearm, increasing the penalty to a second-degree felony punishable by two- to- eight years in prison.

      Increased Penalties for Those Who Improperly Provide Firearms to Minors. Too many kids are carrying guns on the streets often with tragic consequences. Adults who furnish firearms to minors must be held accountable. Governor DeWine proposes that the General Assembly increase the penalty for improperly providing a firearm to a minor to a third-degree felony punishable by up to three years in prison.

      School Tip Line. The DeWine administration is expanding the state’s school safety tip line, where kids and adults can call or text anonymously to 844-723-3764 with tips about potential school violence.

      Social Media Monitoring. In a 24-7 world of social media, threats can arise at any time. The Hub at the Ohio Department of Public Safety is expanding their ability to monitor and track potential threats on social media and will share that information with local school and local law enforcement.

      Community Safety. The operating budget provides nearly $9 million to help harden soft targets like non-profits and religious organizations to make their facilities more secure.

      School Safety and Intervention Programs. Working closely with Sandy Hook Promise, Ohio’s schools are implementing their “Know the Signs” safety program across the state. This program equips school staff with knowledge and skills to identify potential threats of violent action and take steps to intervene. There are 23 training dates already scheduled.

      “I believe these proposals fulfill three important requirements. They can pass the legislature, they make meaningful progress toward safer communities, and they are Constitutional. Passing them won’t be easy, but this is the right thing to do and this is the right time to do it,” Governor DeWine added. “We can pull together to do meaningful things to protect lives. It won’t be easy, but I believe in this state, and I believe in our people.”

        I hope that people who genuinely need psychiatric help receive it–but I am also concerned that this will quickly devolve into politicized “thought control”, where those who have unfashionable views–such as Conservatives–will not only have the stigma of “mental illness” forced on them, but who may even face being committed to mental institutions. This happened in the Soviet Union.

      That’s exactly what I thought, gravenimage. The authorities in western countries very often seem to be giving primary consideration to the human rights of these criminal offenders and the victims’ rights often seem to come second. The victims, average, law abiding citizens, don’t seem to count and are supposed to just put up with being victims of crime. This offender, with so many convictions, seems like he is a one man crime wave. He’s certainly been a negative for the UK. This very soft approach, where the criminal’s human rights are seen as being the most important thing, is pathetic. The authorities should put protecting victims’ rights first far more often.

    Meanwhile, for some 1400 years Islam has breached human rights in multitudinal amounts and it’s right (excuse the double entendre) in Islam’s theological blueprint that Islam has done this and with authorization, for instance the “no compulsion in religion” shit, a la Islam, which means that the non-Muslim has three choices—1) conversion to Mo’s creed; 2) significant inferior status to Muslims if one remains a non-Muslim; or 3) death.

    And thus the nonsense continues, to wit, many non-Muslim Westerners, including that nefarious collection, OMG!, lawyers, still arguing the rights of Muslims even though if Islam has its way with the West you can kiss freedom of speech, freedom of religion, women’s rights and equality under the law good-bye. Oh yeah, fine alcohol and wonderful pork products too.

    You know, I don’t mind Islam being allowed in a Western country. What I DO MIND is that Islam continues to be portrayed as some kind of positive here in the West. A further distance from the truth of matters would be deuce difficult to find. Maybe thrice difficult—and time for a beer and a BLT. Screw Mohammed (which he might have actually enjoyed based on what we know about this bastard).

    MS should read Scott Peck on the “Road Less Traveled”
    (about how life is difficult and not a snowflake convention!)

    He slept in his bed, now he must make it, as Alice from the “Brady Bunch” might say. (Such great useful wisdom in that simple show from a generation or two ago…. All you muzzies out there should take some time to understand what is best from the West and assimilate to reasonableness.)

    Let’s see if I’ve got this right:

    We have a 30-year-old Somali refugee with 18 convictions in the UK including drugs, firearms, and theft.

    He obviously remains a continued threat to the citizens of the UK.

    He has waged a five year legal battle to remain in the UK which must’ve started when he was around 25 years old…

    The UK has already wasted way more than enough time, money, and energy on this ungrateful Somali refugee.

    Deport – yesterday.

    This statement betrays a lack of understanding of the role of lawyers in society. Lawyers are advocates. They are not judges. It is not the proper function of lawyers to judge the impact of the conduct of their clients upon society. That is the role of Judges and Legislators.

    What number of convictions would it take for his rights ‘NOT’ to be violated? 100? 300? 501 convictions? A thousand and three convictions?

    An habitual offender has surely lost the right to stay. This doesn’t offend human rights a bit. He offended the generosity of the UK that took him in. It is not a human right to commit unlimited crimes.

      I would take Muslims claiming that craphole Muslim nations are so much safer than is Dar-al-Harb–even a Dar-al-Harb invaded by too many Muslims–with a *huge* grain of salt. If Muslims really believed this, they would leave our civilized nations and go back home.

      Mostly they like top say this so that they can both claim that status of “refugees” and yet send their children back home for FGM and forced marriages.

      Certainly looks that way. It should be interesting to trawl through the UK court reports for, say, the last 20 years, and see how many Somalis have been dragged in front of a judge for violent criminal behaviour, and then compare that with their reported percentage of the UK population. This case reminds me of another case about 5-10 years ago where a gang of 3 drunken Somali young women randomly attacked another young (English) woman who was just sitting quietly by herself in a provincial town centre. They viciously attacked her, shouting racist abuse and tearing some of her hair out. The judge let them off prison because ‘they weren’t culturally used to alcohol’!!! Seems like a similar argument to the way your beloved Ilhan Omar is let off the hook because, no doubt, she’s ‘not culturally used to civilised democracy’?

    That’s his problem. He had a chance to live a honest, peaceful life in Britain. He chose to be a violent criminal. Whaat of the human rights of his victims, past and (hopefully not) future?

    The legal doctrine that Western states are obligated to guarantee the personal comfort and welfare of foreign criminals regardless of the costs to society is, on the face of it, obscene. There is nothing to debate or argue.
    Yet this farce continues decade after decade.
