“US-born Alabama woman who joined ISIS is not an American citizen, judge rules,” by Louis Casiano, Fox News, November 15, 2019:
Hoda Muthana burned her U.S. passport in 2014 when she declared herself part of the caliphate.
A federal judge ruled Thursday that an American-born woman who traveled to Syria to join the Islamic State (ISIS) group and now wants to return to her family in Alabama is not a U.S. citizen.
U.S. District Court Judge Reggie Walton dismissed a lawsuit brought by the family of Hoda Muthana to force the federal government to let her in the country.
Muthana, 25, currently lives with her 2-year-old son in a refugee camp in Syria and has since repudiated the terrorist group. A court motion said she and child, identified only as John Doe, were moved from the Roj refugee camp after receiving death threats from ISIS supporters and that their lives are in danger, The New York Times reported.
“The citizenship status of minor John Doe depends upon the status of Ms. Muthana; accordingly, regardless of the choices made by his mother, the health and survival of a young U.S. citizen depends upon the expeditious resolution of Ms. Muthana’s civil case,” the claim said.
In addition to dismissing a lawsuit, Walton also ruled that Muthana’s father, Ahmed Ali Muthana, could not provide financial support to his daughter or grandson without being subject to charges of providing material support of terrorism….

I’m a Limey, who LIKES the USA.
If I was an American, I’d vote Republican, and for the most part like Donald Trump, immeasurably. He’s a patriot.
However, during his announcement regarding the neutralising of Al-Baghdadi, he made comments about Britain and other countries NOT taking back captured ISIS men and women. He criticised this.
Frankly, if you don’t want to a take this woman back – in the article – (and you ARE correct NOT to), why should WE?
I’ll still go on agreeing mostly with Trump, but on this – you’re right not to, so he shouldn’t criticise us, elsewhere, if we don’t want to.
Wellington says
As an American, with you. Respecting Trump specifically, yeah, he sometimes says the wrong thing (per your example), but if the worst the West would do is Trump, the West would be immensely better off.
And don’t forget that Trump, when still a Presidential candidate, said in March of 2016, and I quote, “I think Islam hates us.” Would that the PM of the UK, or the President of France, or the current Pope, or the Chancellor of Germany, or the PM of Canada, etc., have said as much.
Trump is indeed not enough (when combating Islam in its entirety only a Lincoln or Churchill will do) but right now he is the best that Western Civilization has going for it when taking into account the power and influence of a single individual.

Hi W.
Wasn’t saying I disagree with DJT on the largest scheme of things. Indeed, I have longed for a patriot to lead my country. Was merely saying he did expect us to take back ISIS fighters, when this article – VERY correctly – states she hasn’t been allowed back into your fine country. NO sarc. I admire USA patriots, genuinely and sincerely.
Just saying – he can be very clumsy. You don’t want them. Neither do we.
Peace up ?

Agreed, Save Europe and Wellington.
James says
What he meant is that the US is not going to take in all the captured ISIS fighters. If they came from GB, for example, GB should decide what to do about them. So, GB can also decide not to take them back. Or find some Muslim country that wants them. He was not wishing something on GB that he would not wish on the US. Some countries think all the migrants from the Muslim world are automatically citizens of the US or perhaps of Germany, Sweden and France. But he is not going to let us be conned by this attitude. That is how I understand him.

Respectfully – I like your country VERY much, and for over 99 percent of the time I LOVE your President. I say that genuinely. However, you’re wrong. He said he wants Britain to take back ‘enemy combatants.’
You can see all his speeches via a mere watching of TV or searching it.
Again – respect to you in the USA. A great country. Just don’t expect us to allow them back to mine either.

mortimer says
To SE: I missed Trump saying UK should take back jihadists. However, there are two international conventions on Stateless Persons that the UK must honor as a party to both. The US is not a party to either, ironically, in this case.
There were 61 states party to the 1961 Convention in November 2014 when teams at UNHCR launched the Campaign to End Statelessness in 10 Years.
61 countries have agreed not to make people stateless intentionally. Thus, they can remove ONE passport legally if the traitor has TWO passports (dual citizenship)

I agree with you, Save Europe. I think Trump is focused too much on the cost of housing/securing these ISIS devotees and worried the US will end up footing the bill, but anyone who’s spent time in Europe knows they should NOT be going back. Europe has too many Sharia lovers now!

Wellington says
Every Western nation should strip a Muslim of their citizenship (damn shame they have it in the first place) if they join ANY Islamic terrorist group.
But wait, ALL of Islam represents a massive terrorist group collection—the whole nine yards—only the degree and ignorance functioning as variables.
Put another way, Islam is a mortal enemy of freedom (dare anyone to refute me here) and thus free societies have no obligation to welcome Muslims into their societies. Might as well welcome Nazis or Marxists, yet two other mortal enemies of liberty.
If I come across as too harsh here, prove me wrong, show me where Islam has championed freedom. I say no one can’t. NO ONE.

Now that ISIS has got their a** kicked so Ms. Muthana is finding it unbearable to live in her dream caliphate. Let’s hope the judge doesn’t change his mind. Let her rot in that hell.
somehistory says
I feel pity for the little boy. He has no say in his life or what is done to him.
There was a book written, “Man Without a Country.” Evidently, the main guy in the story said that he never wanted to hear the name of his birth country ever again, that being the U.S. So it was ruled by the judge in his case, that he never would hear it or see it written for the rest of his life. The lesson to learn from the story: Be careful what you say, and think before saying it.
This stupid moslim thought she could go her own way, probably imagining a life of grandeur, married to a top terrorist, top of the heap, riches and importance connected with her name and face. She probably imagined that isis would come to rule a large portion of the earth, that the ‘caliphate’ would conquer and be regarded as the ultimate moslim rulership, and she would play a big part…have her name in the news, etc. and get to have many slaves and make a lot of important decisions regarding other people’s lives.
So, she denounced the country in which she lived, even having been born on the land, without her father being a citizen, but an embassy worker for Yemen. Most likely, if she thought about it at all, she would imagine that her birthplace would always be her home if she wanted it to be.
Her family could leave the U.S. and go to Yemen…perhaps they could get her moved there and then wouldn’t be charged with aiding terror by helping with her son. The poor little boy doesn’t have much chance at life either way. She is not likely to get her own car any time soon.
CogitoErgoSum says
Yes, if her father was a Yemeni diplomat wouldn’t she be a citizen of Yemen? Why does she not want to go there? Or don’t they let women own a car in Yemen?
somehistory says
We all know why she doesn’t want to go, and it’s for the same reason her father chose to stay in the U.S. when he was done with his job. Yemen is not a very nice place…because it is run by moslims who believe that islam and its evil book are the roadmap to their fake paradise, and they’ll meet up with their fake prophet, the mass-murdering, raper of children, liar throughout.
How many cars are there in Yemen? Isn’t that one of the places they have old beat-up, Isuzu pickup trucks and not many cars? That’s not what she wants. And what about the malls here? Do they have malls in Yemen? She is materialistic and not really concerned with the welfare of her little boy. He’s just a tool she was using to try to gain sympathy from a judge.
Carol says
She was never a citizen of the U,S. Her Father was Yemeni. So even if she was born here she would not be an American Citizen. Her son is not a citizen either. His Father was a terrorist. Let her go live in Yemen or stay in Syria. They like terrorists and fund a lot of terrorist’s groups. We all make life choices. She made hers.
somehistory says
No, she was/is not a citizen. It’s the same for anyone born inside an embassy, and for those who are only here because they work in an embassy, they are not citizens and are not treated as such by the Law. They can commit crimes and not be charged, the embassy is off limits to Americans, etc. The embassy is a treated as a small piece of their country.
If she had stayed put and not joined a terror org, she could have become a citizen if she had applied and met the other requirements. But, she made some very stupid choices due to her religion and now, she and her son, will pay a heavy price. They are, in fact, already paying one.
I have no idea what the laws of Yemen are on being a citizen of that country. Perhaps she needed to have been born there, not just have parents who were.
Jeffrey Sams says
The Man Without a Country is one of my favorite stories from my youth. The fictional protagonist, Phillip Nolan, was still raised on our values. That’s the difference with Muthana. Islam will remain a sticking point with her. It is a virus that will also germinate in her young son. We don’t need that coming back into this country. Her citizenship was always on a shaky foundation, then she renounced this country. The judge made a remarkably wise and constitutionally sound decision for the times we’re living in.
somehistory says
I agree with you about the fictional man in the book. I was just using it as an ‘example’ of why a person should think before they act or speak as it may come back to wishing and wanting something different.
Her son has zero chance of making good choices. He may have a kind heart, but in a bad atmosphere, it has no chance of being encouragement to grow.
The judge made the right legal decision, and that is what he was put on the bench to do.

She burned her U.S. passport. What the hell was she even doing with a U.S. passport if she was the U.S.-born dependent of a foreign diplomat??? A friend of mine’s daughter was born in the U.S., and, because he had diplomatic status, she was ineligible to be an American citizen. Who issued the Jihadist that passport?
Lotus says
Muslims should not be given citizenship, period. Here’s the definition of a citizen from Wiktionary:
“A legally-recognized member of a state, with associated rights and obligations.”
The Muslims cling to the first part of that definition (their rights), but are not interested in the second part, their obligations to the state. That is because their true loyalty is to the universal ummah (the Muslim community).
When Muslims are granted citizenship, the state is effectively seeding itself with disloyal elements and thus undermining its own future.
It’s not rocket science. Anyone who cares to inform themelves about Islam, like the people on this site, can verify this for themselves. It’s an open secret.

I am very pleased that Judge Walton ruled against this Muslima coming back to the US. In my opinion, any ISIS fighters/enablers who are currently in Syria or Iraq should not be allowed to exit those 2 countries. I feel no sympathy for any of them.
OLD GUY says
Judge Walton’s rule against Hoda is correct and gives me confidence in our judicial system outside the 9th district of California. However if she was from a family of influence as was Jane Fonda when she went over to Hanoi a different outcome might have happened. Funny how the system works. But I applaud Judge Walton for his ruling.
