Minnesota: Police threaten to charge grandmother for filming traffic problems at mosque

The police there know who is in charge and who they must not allow to become offended or enraged. And it isn’t Sally Ness.

“Civil Rights Lawsuit Filed by Grandmother Threatened with Prosecution for Filming Mosque Violations,” American Freedom Law Center, November 12, 2019 (thanks to the Geller Report):

(Minneapolis, Minnesota)—On November 12, 2019, the American Freedom Law Center filed a civil rights lawsuit in the U.S. District Court for the District of Minnesota on behalf of Sally Ness. The lawsuit alleges that the City of Bloomington, two City police officers, and the Hennepin County Attorney violated Ness’s rights protected by the First and Fourteenth Amendments by threatening to enforce local and state laws against her for filming public information exposing various zoning and other violations committed by a local mosque and its associated school, both of which are located in Ness’s neighborhood.

AFLC Co-Founder and Senior Counsel Robert Muise explained:

“The First Amendment fully protects our client’s right to gather information through photographing and videotaping. And this is particularly the case here because she is filming public matters related to a public controversy. As the courts have explained, the right to freedom of speech includes not only the actual expression of one’s views, thoughts, opinions, and other information concerning matters of public interest, but also non-expressive conduct that intrinsically facilitates one’s ability to exercise free speech rights, including efforts to gather evidence and information by photographing and videotaping. Here, the City and County seek to make a crime out of what under the Constitution cannot be a crime. Their threats of prosecution are aimed directly at activity protected by the First Amendment.”

For many years, Ness has been documenting the public controversy surrounding the Dar al-Farooq mosque (DAF) and its associated school, the Success Academy, both of which are located in her neighborhood in the City of Bloomington, Minnesota. Ness would often film zoning and other violations committed by DAF and the Success Academy that are disruptive to the neighborhood. Ness would publicly disseminate this information via a blog and Facebook page. She would also bring these violations to the attention of the City, which would largely ignore her concerns and the similar concerns of her neighbors.

This past August, City police officers confronted Ness and warned her that because people associated with DAF and the Success Academy felt “threatened” by her filming she should “stop” because she could be charged with violating the Minnesota harassment statute. Per the City’s official police report: “Ness was advised that she could be charged with harassment if the parents and principal felt intimidated by her actions.”

On October 28, the City, in an effort to appease DAF and Success Academy patrons who object to Ness’s filming, passed a City ordinance providing that “No person shall intentionally take a photograph or otherwise record a child without the consent of the child’s parent or guardian.” Because Ness seeks to expose, among other violations, DAF’s and the Success Academy’s noncompliant and overuse of a local City park—a park in her neighborhood that she would often attempt to use with her grandchildren—her information gathering efforts include, quite necessarily, photographing and videotaping the use of the public park by children associated with DAF and the Success Academy. Additionally, Ness has taken pictures of students being dropped off to Success Academy and weekend school to document the noncompliant number of students attending the schools and the unsafe and noncompliant drop off conditions. There is no doubt that this newly minted and unusual City ordinance was directed at her.

On October 30, at the request of a City detective, Ness met with the detective and two other City officials. The detective informed Ness that she is under investigation by the County for allegedly violating the Minnesota harassment statute due to her filming and documenting of the activities of DAF and the Success Academy. This latest threat intended to intimidate and silence Ness was the last straw, prompting the filing of this lawsuit.

AFLC Co-Founder and Senior Counsel David Yerushalmi concluded:

“If you publicly criticize Islam, it is called ‘hate speech.’ If you exercise your First Amendment right to collect evidence of a mosque violating zoning and other laws via photographing and videotaping and expose this evidence to the public, you can be prosecuted for ‘harassment.’ This case is another example of the encroachment on our liberties when Islam is involved.”

The lawsuit asks the court to declare the Minnesota harassment statute and the City’s newly enacted ordinance prohibiting filming in a City park unconstitutional and to enjoin their enforcement, particularly as applied to restrict Ness’s First Amendment activity. Ness is also seeking the recovery of her attorneys’ fees and costs.

      M.A.C. If the money goes into the city council pockets, I think the better word is “bribe” not “grant”. Remember a few years ago when tens of thousands of dollars of “grant” money was found in the home of Member of Congress “Dollar Bill” Jefferson, of Louisiana? Makes you think, doesn’t it?

    When America is attacked physically such as 9/11 we know what to do, go to that part of the world that attacked us and disrupt their way of life through wars. Ok, that’s great, we can win in that arena. When the enemy comes to our shores with their hijra we have no plan of stopping that encroachment and with time the ideology of islam will pervade American culture and destroy our democracy. The process has hardly started in America and many are already feed up. Seems American leadership needs to get up to speed and learn how to defend the constitution and our freedoms from and intellectual perspective.

    That is a problem, an immigration policy based on what immigrants can get from America without regard for the costs to America. I live in the Twin Cities, and I do not see much advantage in having a big immigrant Muslim population here. It just seems to mean more problems like this. What do we get in return?

        Praying to a Telegraph pole would be a more useful thing for muslims to do.And actually READING the “perfect” koran ,they might just see all the errors in it…

          is an inspiring message from Ibrahim Hooper, who is the National Communications Director of the Council on American-Islamic Relations (CAIR). It commemorates the Islamic festival of Thanksgiving. In his message, Imam Ibrahim notes various passages in the Quran that refer to sharing the blessings of Thanksgiving. One he quotes is Quran 90:12-17: “What will explain to you the path that is steep? It is the freeing of a (slave) from bondage, or the giving of food in a day of famine to an orphan relative or to a needy (stranger) in distress, and to be of those who believe, enjoin patience (in adversity) and encourage deeds of kindness and compassion.”

          What is noteworthy about this passage is that it makes no reference to giving thanks, but gives hints about what kind of life Allah thinks you lead: you might own a slave or two, you might have a close relative who is an orphan (why didn’t you adopt her or him?), and you should be among “those who believe”. What if you are not among the believers in Islam? The next three verses tell you: Quran 90:18-19 says, “Those are the companions of the right.           This is written in the usual mealy-mouthed style that the Quran’s author is fond of, but with a little exegetic effort, you will get the message: If you are a non-believer (i.e., a companion of the left), you are going to Hell.

    Sally Ness is a hero. Those DAF and Success Academy people claim to have felt “intimidated” by this grandmother wielding a camera? Recording in her photos their violation of zoning laws, and their monopolizing use of a public park by their own students, is harassment? How can the detectives involved, or the city officials, who are doing the only harassing, of indefatigable Sally Ness, stand to look at themselves in the mirror? And when was the last time that they read, with comprehension, the First and Fourteenth Amendments?

    That’s just one of the Muslim supremacists’ tactics.

    The lawsuit filed by he American Freedom Law Center should cause real concern for them.

    And, while this lawsuit would not have been necessary if the City Administrators had forced them to comply with existing zoning laws in the first place–will they now?

      In reading through the complaint, it’s obvious that City Officials have given them preferential treatment.

      Ex:

      The City allowed DAF to delay updating the JUA (Joint Use Agreement–which would govern shared use of sport fields, courts, and parking for organized and general recreation) for three and a half years past the deadline, while imposing no penalties or replacement deadlines.

Yes, they wanted to avoid any fight so it was easier to threaten grandma to make her shut-up and disappear. Looks like they got a fight anyway — from grandma. Now let’s see if they can whip a little old lady into submission. And they will still have to fight the Muslims later anyway when they start demanding more. And they will demand more. You can count on that.

    Just wondering….how many moslims are on the city council? How many are on the police force?

    We know there are moslims in the State government…two at least…and can wonder how many more there are writing these unconstitutional “ordinances and laws.”

    Hope Ms. Ness wins her suit. She has some very competent attorneys working for her…and everyone else affected by the unlawful threats and harassment of a law-abiding citizen.

        Ginny many cases lose at trial. As many as 85 percent do not win on appeal. And 98 percent of cases submitted to the US Supreme Court are never heard. But a few do win sooner or later.

    Awareness of this law can help many people in many different situations. The Omnibus Crime Control and Safe Streets Act of 1968, which under Article 6 Clause 2 of the United States Constitution is the supreme law of the land, says among other things we have the absolute right to record any conversation “to which we are a party”. This provision of the Act is codified as 18 United States Code Sections 2511 (c) and (d).

    Obviously there are at least 2 parties in a conversation, speaker and listener. I think a third must be included, a witness who is lawfully present to overhear and see what transpires.

    Some states have legislation that purports to add requirements of consent of the parties to the federal law. The California Supreme Court ruled a few weeks ago that a state law requiring Presidential candidates to publish tax returns violated federal law and requirements by the addition of something not in the Constitution. The United States Supreme Court has written at least twice that a state court cannot enforce any rule of law, whether common (judge made) or statutory, that interferes with federal law and rights. New York Times v. Sullivan and NAACP v. Claiborne Hardware..

    I hope the lawyers representing this woman will assert her federal right to record what she sees and look at the possibility of civil rights violations for the police misconduct.

      I read subd. 2(2) as saying it is harassment for anyone to monitor another whether in person or through technological means. Also, I read subd. 2(3) as saying it can also be considered harassment to return to property owned by someone else without the permission or consent of the owner.

      Seems to me the plaintiff would need to be a specific person who would have to show either that some form of monitoring of him/her in particular was being done without consent or that the person accused of the doing the monitoring was trespassing on property owned by the person being monitored.

      I don’t see how standing on a public sidewalk or in a public park filming anyone who happens to pass by could be considered harassment according to the state statute. I think the lady was given bad information just to scare her.

        A MN lawyer would be the “ultimate” source. I think, as a matter of general law, that to the extent the MN statute impairs the federal right, the MN statute loses; and threatening or trying to enforce it is a federal civil rights violation. The individual officers are personally liable under Hafer v. Melo, a US Supreme Court case from 1991 which overruled Will v. Michigan of the same year. I would look long and hard before NOT taking legal action against the officers and all in the chain of command for personal claims. In some states, while the state may be immune, municipalities are NOT immune to suits. Also, nobody is immune to criminal prosecution for civil rights violations under color of state law. LOCK EM UP!

    In London a courageous woman, “Based Amy”, protested to police at Speakers’ Corner in Hyde Park that they were failing to uphold Parks law which forbids religious acts in the park, because they were not stopping muslims from openly praying and prostrating there.

    She was subsequently “visited” at her home and promptly arrested in her pyjamas and taken to the police station. She recorded her arrest and treatment by cellphone.

    There is a video of her being manhandled away from her perfectly lawful presence in a public park outside Parliament. See “Based Amy arrested in London” on youtube.

    We have a similar problem at a mosque north of this one, I don’t wanna say exactly where because I gotta problem with getting my throat cut. They fill the park parking lot to the max and also on the street because there’s not enough room in their own mosque lot. The only reason I mention it is, once I happen to go there with my dog in the car on a Friday when they were worshiping their demon. I was sitting there just listening to the radio and my eyes met with one of “theirs” as he walked back to his car. He too sat in his car and kept checking me out sneakily in his rear view mirror while all the other cars left for home. Finally after about 15 minutes a squad car pulled up and stopped near my car. I can’t prove it, but I know damn well he called the cops on me. It’s their “turf” now, how dare I sit in the parking lot legally and listen to some music on a sunny day while they’re there too. It’s a public park for cripes sake, well at least it used to be. If I ride my bike past while they’re sitting outside their “club house” they stare at me like I’m a visiting alien from Mars, it’s creepy. I don’t get a smidgen of warmth or kindness from these people. I feel like a stranger in my own own neighborhood, I don’t feel safe. And I feel edgy riding the bus too, afraid that some faithful muslim is going to blow us all up because he/she loves allah so much. I know if I walked by that mosque wearing a t-shirt that said, “I’m a proud atheist” I’d probably get a visit from a squad for goading the muslims. It’s sad, this used to be a good neighborhood. I’m hoping to win the lottery so I can afford to sell my house and move to Maple Grove MN where it’s safer and freshly built. Minnesota has become a haven for their Nazi-like creed and I’m quite sure we’ll be the first to capitulate to islam.

      Same creepy feeling here in Germany. I have to ride my bike past our local Pakistani mosque on Fridays, and one evening after a “recharge” club meeting, two little boys from the mosque who were on their bikes ahead of me would not let me pass them on the bike path. Such incidents are daily fare here. We are willing subjects.

      I’d like to move back to the States, but it looks like the situation is just as bad there. By the way, i’m glad to hear Maple Grove is still ok. My grandma grew up there. I am an ex-pat Minnesotan and I’m NOT planning to move back to Minnesota! I do still vote there, though, so I’m doing what I can.

        Yes, well it’s bad here in the States too in the sense that their terrorists may strike anywhere, though I suppose one is less at risk if they live in the sticks. It’s also bad because of the inconvenient and costly security measures that are firmly established throughout our nation because of muslim terror. And it’s bad because we know muslims are working hard infiltrating every aspect of our society, like our schools and politics, and that causes more divisiveness. And it’s bad because more of their mosques and “community centers” are getting built, and that means their demonic creed is growing at an alarming rate. And it’s bad because they bring more crime into our neighborhoods and welfare dependence, and so that translates into more cost and hardship for us. And of course we have many burgeoning enclaves now, and that’s bad because it’s like lost territory we’ll probably never get back. And what makes all of this so much worse is that the left is helping muslims do all this. We may still be in the early stages of islam’s takeover of America, but we know how it’s going to go from Europe’s example. So we have the added stress of knowing we too will become dhimmis and lose our freedoms and culture as have Europeans.

        So yes, I’d say you are correct, it’s bad in the States too.

    I was wondering what the students were doing in the public park. Are they holding public prayers where they fill in the whole park and block traffic, the way they do in France? Or have they transformed a public park into a private school playground? I suppose that both could be possible.

      Or do they practice martial arts jihadi style, or put on little theatrical performances like islamist marching units for the Aquatennial Celebration in Minneapolis? Or do they do hijab, burka, niqab fashion shows or demonstrate religious services in public. Or why would it be necessary to film it and why would the city try to prevent filming, if it is harmless?

    It is insidious that she can be cited when Muslims “feel theeatened”, regardless of what she is doing. This opens the gates of criminal justice hell whereby how someone “feels” is determinative, not the behavior allegedly causing the “feelings”. If Muslims feel threatened by her photographing them, the next step is obviously feeling threatened by nothing more than her presence, her vehicle passing by the mosque or her sitting on her porch staring in their direction. There is no tort here, only the imaginings of the paranoia Muslimz. If the city, county amd state care so little about enforcing the ordinances being violated, maybe new leadership is needed. This lawsuit is going to play out in an ugly fashion for the defendants.

      True…and likewise it is insidious that muslims feel “insulted” over anything we say about their fake religion even if it’s true.

      We’re in a crazy new age where how muslims “feel” is more important than the truth. In contrast, no decent person would suggest that a KKK member has a right to encroach upon the rights of black people because they are “offended” by blacks; and no decent person would suggest that a Neo-Nazi has a right to infringe on the rights of some Jews because they are “offended” by Jews. But when it comes to muslims’ “feelings” then things are different, we’re made to feel guilty for speaking the truth and if we are terrorized by muslims for those truths then we “got what we deserved.” It doesn’t matter that islamic terror is rampant or that islam’s god is a bigoted murderer, we are xenophobic-racist-bigots for speaking our truths and concerns on the matter. I’m seeing more and more good people, mainly in Europe, getting into hot water for speaking their intelligent views about islam and muslims or immigration. Even Pamela Geller was sued by Muslim prisoners in Michigan who charged the outspoken pundit… violated their Islamist beliefs by wearing a bikini in their view. [from WND, a free press for the people], which just goes to show how totalitarian and supremacist these muslims can be against our freedoms and individual liberty. Anyone who thinks we can create a multicultural society with muslims is a fool. Their culture and the religion that guides it is an anathema to our core principles of freedom and equality. They will always be “offended” until the day we are full fledged dhimmis, totally under their control.

      S.A. I bought the GWB lie told days after 9/11 about the “religion of peace” for more or less 7 years. Then I started reading and found out for myself. The difference between the US and all other countries is we actually have a Constitution in writing that is hard to change which can be, with much effort, enforced. GWB’s lie, whether intended or not (Deliberate ignorance constitutes knowledge of the truth) was a temporary deception that more people see through every day. Each of us needs to take the personal daily challenge, “What can I do today to help another person see what islam wants for the world?” Islam has been at declared war with the world for 1400 years. It will never stop. If we stop, they win.

His sources were obviously convenient to someone too lazy to inquire, They told him what he wanted to hear, utterly delusional in view of 1400 years of killing and conquest. We are paying the price for that kind of deliberate ignorance. Deliberate ignorance constitutes knowledge of the truth. Wyle v. R.J. Reynolds, 9th Circuit Court of Appeals. I was a sucker for his pronouncements almost 7 years until better information came my way. NO MORE.

          I ordered something from Ebay in 2004 and the seller included a note citing things that just didn’t jibe with the ‘ROP’ meme.

          So, I started doing some research and found Jihadwatch.

        Always appreciate your input from a legal perspective.
        I too believed GWB. Seems the Left got things reversed. It’s not “Bush lied people died” it’s “people died and then Bush lied” (about Islam = peace).
        Ended up reading all of the foundational materials (2 translations of the Koran, Bukhari hadiths and first biography of Muhammad by Ibn Ishaq. The materials speak for themselves.

        On that note, from the biography:

        From the first biography of Muhammad by Ibn Ishaq (A. Guillaume translation) note that the first pledge (page 197) given previously was “of women” and did not involve making war on infidels: Page 208: The second pledge[aka ‘Aqaba] (and NOT of women). “When God gave permission to his apostle to fight, the second ‘Aqaba contained conditions involving war which were not in the first act of fealty. Now they bound themselves to WAR AGAINST ALL AND SUNDRY FOR GOD AND HIS APOSTLE, WHILE HE PROMISED THEM FOR FAITHFUL SERVICE THUS THE REWARD OF PARADISE” (my emphasis, not in the original).

        When I quote the above to the uninformed there is usually shocked silence. I usually end the conversation with “Hey, don’t believe ME, believe THEM”.

          HHB, please consider a suggestion to look at Warner’s Abridged Koran. Meaning no disrespect to any other author or writing, Warner took the Koran, put it in chronological order to make the Simple Koran and then removed repetition and material not important to us (kafir/infidels) to produce the Abridged Koran. He explains his reasoning, process and conclusions in clear language. It might help communicate with others.

    It would be lawful for the police to go to the park and take pictures/video if they thought there were crimes being committed or planned there. It would be lawful for the police to stand on the corner, or sit in their squad car, and film moslims going in and out of their barracks or their indoctrination center, if they believed there was something illegal going on. It would be lawful for officers to video traffic issues to present to the city for improvements in signals, street alterations, etc.

    And there is a statute…actually a Supreme Court decision… that says that law enforcement is allowed to film using equipment…if it is available to the general public. If the general public could buy equipment that allowed them to film through solid concrete, the police could use that equipment too.
    So, if the general public has the ability to film someone on the street or in a park, it is lawful for the police to do so. And if it is lawful for the police to do so, that means it is lawful for the lady to film them.

    They are in a public place…the street, and the park, when she is filming. She’s not getting in their face…the photo with the article is not that close. She has a good case for her suit.

    Her attorneys could also argue that moslims are known for whining and complaining and accusing others of ‘hurting their feelings’ and making them feel “afraid” and “uncomfortable.” The Court might not like those arguments, but they are certainly true.

      S.H. having been in courts with “unpopular” arguments, which were received with open hostility, the reason to present them in detail both in pleadings and oral argument is to preserve the issue for appeal. The only answer for corrupt or incompetent judges is exposure. Judges may be immune from civil suit, but are never immune from criminal prosecution or disciplinary complaints.

      I live in an area where many police officers do not believe they are governed by the same laws as the “people”. For some reason when laws are directed at “persons” or “drivers” they act like they are not included. Nazi Germany would be proud that its traditions and practices continue in US law enforcement.

      I suggest you look at the 1895 US Supreme Court case In re Quarles, which holds that it is not merely the right but the duty of every federal citizen to aid federal law enforcement. That case has been cited, explained and refined approximately 24 times by subsequent SC decisions, but remains good law. Exposing corrupt police violating civil rights is certainly a federal issue.         And I hope today is a day in which you find many things for which to give thanks.

        I was thinking of the case where the police had flown a copter over some land and saw some illegal activities going on and took photos. The people doing the acts said the cops didn’t have the right to fly over and take pics. But, the Court said that if it is possible for a citizen to fly over and take pics, it is lawful for a cop to do so. And to me, that says it is totally legal for this woman…or anyone…to stand on the street or in the park and take pics of whomever is also on the outside of a building. If she owns a copter, she can fly over and take pics. All they need is a camera, no special permit or license.

        And speaking of ‘hostility,’ my son has many stories of that, even being in the DA;s office.

        I’ve noticed that police refer to non-police as “civilians,” as though they are not also subject to that title. Once they put on the uniform and badge, carry a gun and the authority to stop people and arrest them, many officers take it to the limit and beyond. But that is the nature of people. There are some very nice officers too. And I speak as one who has had many interactions with them. (Not as a criminal. Only as an innocent “civilian.”)

          SH. we agree over much, including most police officers. Without the honest ones, we would live in a deadly zoo. Many of my very best friends at one time or another served as police officers. I of course have my own participation in law enforcement.

          There was a recent case (last few years) where a hostage was being held in a bunker. Law enforcement used highly specialized equipment (millimeter band sensors?) to see inside the bunker. I do not think any case arose from the event.

          I predict there will be a number of cases where “exalted” police officers learn the hard way that law applies to them as it does to everyone else. Be patient. I suggest remembering that until conviction, a criminally accused is not guilty of anything except making a cop angry until proven guilty beyond the shadow of a reasonable doubt to a moral certainty by admissible evidence etc. We are being conditioned by the MSM to believe that to be accused is to be guilty, unless you are a Democrat family member.

      I know many more who would like to help. The first step in any suit is total commitment and financing to victory. This is not something to try, but to fight until there is no place left to fight; or stay home. With any case, the lack of determination of the plaintiff can defeat the best legal talent and destroy the strongest case. How many people are willing to pay money to support a suit, with expenses for depositions, experts, court costs attorney fees and anything else a vigorous defense can charge during the litigation with no hope of being repaid?

      The reason I think people should support such suits is that if it can happen to her, it can happen to any of us. It is a mistake to have too many parties shown as plaintiffs. That enables the defense to bankrupt the plaintiffs and their lawyers with discovery and depositions. A clearly focused claim by a specific plaintiff has the best chance of winning and teaching corrupt officials the kind of painful lesson that will deter them in the future. Obviously in nearly 40 years of being a licensed attorney I have seen many cases with such problems fall apart and waste years of work.

      GI I am familiar with a case where police arrested and jailed a person for obeying the law. As the case is presently in litigation, I should not provide the details until the litigation is complete. The clear law was disobeyed in every detail by the arresting officers, who were caught on recordings in their violations. But that did not even slow them down. When police believe the law does not apply to them, they also teach others that the law applies to nobody. That is when society breaks down as it did nationwide in Nazi Germany and every Communist country, plus the muslim world, which regards “human made” law as a nullity.

      How can the SPLC join with others to decide who is and is not allowed to speak? Because they are allowed to without effective challenge.

          I can tell about my case starting in 1982 where the Miss Bar prosecuted me into total destruction of family and professional opportunities when I refused to help corporate management steal 200 million dollars in present value from the member/owner/consumers of a federally financed entity that was MY client. I WON and showed the US Supreme Court the corruption in a 102 page Petition for Writ of Certiorari, which like 98 percent of such petitions they refused. What you see on television has little or nothing to do with what really happens. That war took 14 years and every resource I could muster. But it had to be fought to teach them never to try it again with me. Any wonder why I have so many cases ready to cite concerning related issues?

    All Muslims make me feel afraid due to their belief in a religion based on the rantings of a psychopath. Does this mean I can take legal action against them because they make me feel uncomfortable? Would that not be equality under the law? How about women who wear face and head covers, you know black colored coverings not unlike the KKK? They make me afraid. Can these women be prosecuted also?

      John, equality under law is a human law concept which is meaningless to those who submit, because they are superior to everyone who does not. We are kafirs, We are worthless, un-entitled to anything except to either be killed or enslaved in the service of believers. When muslims make the rules, they win and we lose, like Democrats. The Constitution is only a target for destruction to muslims. This is what they teach and have practiced for 1400 years and between 250 and 1000 million murders. “If islam is such a great deal, why were 4 million Egyptians killed bringing it to Egypt?” Mark Gabriel, PhD, The Unfinished Battle Page 52, paraphrased.
