Boris Johnson faces a legal fight to keep terrorists locked up after Labour’s Shami Chakrabarti and civil rights groups today hinted they could challenge an emergency law to stop terrorists being automatically released.
The Prime Minister wants to pass legislation over the next 10 days to stop terrorists being automatically freed half way through their sentence without going before a parole board, under rules introduced by the Labour government in 2003.
The government could also bypass European human rights laws to make the legislation law by ‘derogating’ – effectively suspending – the European Convention on Human Rights (ECHR) in order to apply the strict new measures.
Although Britain left the EU on January 31, the ECHR is a separate treaty between 47 European countries, with the option to derogate ‘in time of war or other public emergency threatening the life of the nation’.
Human rights and civil liberties activists are already lining up to challenge Boris Johnson’s emergency law, and could use the ECHR to ultimately contest it because it contains rulings on restrospective legislation.
If the suspension of the ECHR was successfully challenged, the government could leave the ECHR – something previous prime ministers including David Cameron and Theresa May both considered before the Brexit referendum.
Johnson could use his 80-strong majority to easily pass legislation withdrawing from the ECHR – but critics argue that the Convention is signed by Russia and Turkey and leaving would give those countries a moral boost.
In the meantime, Labour shadow attorney general Shami Chakrabarti today indicated she was against retrospectively changing terrorists’ sentences and civil rights group Liberty called the plan ‘dangerous’.
It comes after terrorist Sudesh Amman stabbed two people in London on Sunday before being shot dead by police. Amman had been automatically freed from prison half way through his sentence, despite boasting of his plans for a terror attack….

Labour’s policy and practice is to outlaw criticism of ‘Muslims and Muslimness’ (their words), pay homage to terrorist dead and to let jihadis and their brides back into Britain after killing people. If only they had even an inkling of that indulgence in regards real victims like the Jews.

If automatic early release for terrorists existed when the sentences were passed then it is reasonable to expect that it, automatic early release, was taken into account by the Court at that time. It could be argued that suspending automatic early release would actually be doubling the sentence imposed.
However, if the ECHR limits the length of sentences in the first place that would, of course, be an entirely different matter. The article gives us no insight into that.
I don’t want my comments to be interpreted as my wanting to ever release terrorists from prison. I view terrorism as a “throwing away the key” offence.

Sentences are applied by the courts according to the laws at the time. early release is required by the rules of the ECHR. Upon release, which is on probation, the criminal can be recalled to jail at any time if he/she breaks the parole conditions. This of course places a burden on the police where terrorists are concerned as they have the responsibility of keeping them under observation. This is a very difficult not to say impossible task as there are too few police officers and a multitude of terrorism inclined people, usually Muslims of course. The courts also place often such people on probation without custodial sentences as the jails are overcrowded or the offence is not serious enough, thus placing additional burdens of supervision on the police and probation services

The current laws are not fit for purpose. It’s the oldest rule in the book: Adapt or die. European laws must fit the new reality that thousands of your imported neighbours want to kill you in the name of their imported religion. If the new religion in town was Mormonism there would be no need for laws to change because Mormons don’t kill in the name of Jesus as Muslims kill in the name of Mohammed.
Not letting avowed terrorists out of prison early should be an absolute no-brainer. Whoever fights against this needed change, in a prison-policy that never should have existed, needs to be promptly removed from power as soon as possible.

Actually I hope this does happen and that Johnson has a huge fight on his hands with a. the bleeding hearts Liberals b. the left wing/corrupt judiciary c. the ECHR and d. the Labour party BECAUSE this will fuel anti EU/ anti Labour party / anti ECHR feeling amongst ordinary people. No citizen in their right minds, after so many terrorist re-offenders could fail to see the idiocy of what these left wingers are doing.
Johnson may or may not win the fight but watching the struggle would be a step on the road towards sanity amongst the British people I think.

Actually I have a problem with rerospective punishment. I believe it is wrong under any circumstances I can think of, even for major terrorists. In that case a released early terrorist in public must never be allowed more than three yards from an armed escort of at least two.
Expensive? Yes, but it’s the only way one can practically guarantee they cannot kill again. I’m pretty sure most of them after a few months of living like that, would want to leave Britain altogether and their wish should be granted.

So a democratically-elected UK government can agree to a previously non-existing treaty but the moment it does the same kind of government cannot withdraw from the same treaty? It seems that time spent in the EU has warped the minds of Brits who would otherwise not have been so stupid to put up with a stipulation that says once you have entered this agreement you can never leave.
