Convicted war criminals can possibly still receive asylum in the Netherlands. That is the ruling of the Council of State. As long as these convicted war criminals pose no acute danger, they can qualify for asylum. This ruling from the Council of State can bring about many changes…
Currently, asylum-seekers who have a serious crime on their record are automatically denied, but the ruling by the Council of State may bring a change. In the future, they may still attempt to obtain asylum in the Netherlands if they can demonstrate that they have changed their lives for the better. In such cases, the State Secretary must look into the matter.
The Council of State says that Dutch people do not have to worry now. It is not that any criminal can claim asylum; there are “high demands” in place. The door has been opened a bit, but the criteria to enter the Netherlands remain high.
Nevertheless, the ruling by the Council of State is cause for concern. I can imagine that members of Parliament will want to have more clarity over this ruling. Because how do we guarantee that the criteria remain high enough so that no mistakes are made?

The Dutch Council of State consists of some 70 law academics and no more than 10 other people. Their main purpose is deciding about administrative law, where a conflict stays between a civilian and government, after courts decided.
Here is a case were government decides a foreign heavy criminal national has to leave the EU according to Dutch government, though rejected by court. The Council decides that Dutch government was right and the foreigner has to leave the EU:

Cases are very fact based, and the main purpose seems to be building a federal EU system of case law.
In this case a heavy criminal foreigner that resides 50 years in Holland has to leave and go back to his country of birth, which country the criminal left at the age of 4 years. Ridiculous to kick out a person after 50 years, that resides lawfully for 50 years in a country. Like said: it is about building EU law in the EU jurisdiction, and those 70 Dutch law academics have got nothing to do with Holland, but their main target is building EU law, for which they are paid richly.
The main reason the British wanted to leave the EU is this type of clubs, that decide for Britain what to do with their laws.
