Marathon bomber Dzhokhar Tsarnaev is suing the federal government for $250,000 over what he says in a hand-written lawsuit is “disturbing” and “unprofessional” treatment inside the supermax prison in Colorado.
Tsarnaev, now 26, accuses guards and the warden at the Federal Correctional Complex Florence — called the “Alcatraz of the Rockies” — of being “unlawful, unreasonable and discriminatory.”
He specifically cites the confiscation of his white baseball cap and bandana that he purchased at the prison commissary and not being able to take more showers. He adds the harsh treatment has made his life inside the prison’s H-Unit so anxious it is adding to his “mental and physical decline.”…
Tsarnaev’s death sentence was thrown out last fall over concerns with the jury selection process. Federal prosecutors are asking the U.S. Supreme Court to review the case, calling it “one of the most important terrorism prosecutions in our nation’s history.”…
The bombing killed Martin Richard, 8; Krystle Campbell, 29; and Lu Lingzi, 23. More than 260 people were injured. MIT Police Officer Sean Collier, 27, was shot execution-style days later by the Tsarnaevs.
Boston Police Officer Dennis Simmonds, 28, injured in the Watertown shootout in which Tamerlan Tsarnaev was killed, died in April 2014.
Former Florence prison warden Bob Hood told the Herald on Wednesday that Tsarnaev’s lawsuit is common among inmates.
“I get it. He wants more than three showers a week,” Hood said. “But he’s twentysomething living in a 7-foot box where life is worse than if he did get the death penalty.”

But felons can file suits. Some few of these are valid, and really do point to abuses–but most of them are frivolous nuisance suits. Some prisoners are notorious for filing one suit after another–most of them are thrown out of court, of course,

In Canada, the late C.R. Olson, who serially murdered at least 11 children and teenagers, was notorious for filing frivolous lawsuits. He even started to get a pension while in prison, before he died of cancer.

And Muslims are particularly prone to waging “lawfare” against the Infidels. This has two purposes–to generally cause annoyance, but also more specifically to bring in aspects of Shari’ah law, including special benefits for Muslims like catered Halal meals and time off prison work for prayer time.

Mortimer, prison should be a living hell for anyone who commits such atrocities.
It’s a prison, not a day spar as the bleeding hearts would have it.
Part of me would like to see him executed using the slowest form possible, but a big part of me knows that even that would be too quick for someone who thinks it’s “Allah’s will” to murder kids and civilians. I hope Tsarnaev is in solitary for a long long time. Kept fit and healthy so he can appreciate every moment of his miserable life.
This should be the punishment for ANYONE who commits a terrorist act upon civilians.

I get the feeling that people like this terrorist get more civil rights protection and freedom of speech protection than innocent bystanders. The victims and their families of this terrorist could sue him for violence and murder, but they would never get anything for the trouble. Maybe he should get some instructionon on how he would be treated in the courts and prisons of his homeland. Or if sharia law were applied to him, assuming it did not justify and acquit him. The authorities in the US, especially ones under Obama and Biden, should have done more to protect the public from such people. They just make a blue-eyed assumption of innocence of all people from violent, dangerous backgrounds. They are not held accountable for making the crimes possible. I wonder how many such people will get in under Biden’s compassionate immigration policies, which we will soon be able to enjoy.

Jim, you may have an idea. He may have nothing at the moment; BUT because he is in prison, I think a judgment obtained against him would last his entire life instead of expiring in 10 or 20 years. Then, IF he ever wins a single dollar the judgments obtained by his victims would take any money he is awarded as a result of his suits. “Prior in time equals prior in right.” That would destroy any motive he has for filing groundless jackpot lawsuits.
Any other plaintiff must be concerned with Rule 11 sanctions or Litigation Accountability Act awards for filing groundless suits. The same perpetual duration of such awards now could limit his zeal to file future false claims.
If there were any restitution award as part of his conviction, that would take any money coming under his control. And I doubt that any judgment against him would be discharged in bankruptcy. Check out the Mike Nifong stories, removed from office, disbarred, sued, lost, bankrupted, denied discharge of the Duke Lacrosse players judgments, criminally prosecuted and convicted.

My understaning is that only plain white baseball caps are sold at prison commissaries. No colors–they might be gang colors–and certainly no slogans, not even ones that might at first glance appear innocent or meaningless.

As far as I can tell, Marathon bomber Dzhokhar Tsarnaev is being treated the same as other prisoners at ADX Florence.
His lawsuit is totally frivolous.
Recommend that he be put back on death row…

These type of demands that maggots like this scumbag, and other such prisoners, make are amazing, but I suppose that they have nothing to do with their time except to find things to whinge and whine about. I agree with the other comments that he should have already been executed for the extremely evil act this piece of crap committed. His victims didn’t get to go on enjoying their lives and he should be long gone from this world instead of being allowed to continue hanging around.

What terrible gall the jihadist Tsarnaev, to complain ,let alone sue about not allowed to take more showers and having his hat. What a spoiled brat, what a crybaby.
Tsarnaev should be glad that he’s allowed to take any showers and to be given any garment to wear ,after the three people he murdered by those two bombs and how he viciously injured and maimed many other people.
The three people he killed are never against go to take a shower or put on a hat.
It’s very likely that the innocent people heal injured and maimed find it very difficult to take a shower because they are now handicapped, because of him.
Tsarnaev should be glad and happy that in his cell he was given a bed to sleep in.

Thats why the death sentence for murders like Dzhokhar are appropriate. Why should we the tax payor continue to pay for his support and provide him free legal council to continue his jihad and harassment. He’s in PRISON and should not have the right to file a law suit over his hat and the number of showers he gets to take. Next thing he’ll do is file a suit because he can’t have a Mickey Mouse tee shirt or hair stylist weekly.
