Dzhokhar Tsarnaev, 28, was ordered back on to death row by Friday’s ruling, when a majority of justices said they agreed with the Biden administration’s call to execute Tsarnaev over the April 2013 terror attack that killed three and maimed 255 others.
‘Dzhokhar Tsarnaev committed heinous crimes,’ Justice Clarence Thomas wrote for the majority, with conservatives ultimately voting to reinstate, with liberal justices coming out against. ‘The Sixth Amendment nonetheless guaranteed him a fair trial before an impartial jury. He received one.’
The First U.S. Circuit Court of Appeals in Boston ruled in 2020 that the trial judge improperly excluded evidence that could have shown Tsarnaev was deeply influenced by his older brother, Tamerlan, and was somehow less responsible for the carnage. Tamerlan was shot dead by cops in the Boston suburb of Watertown four days after the terror attack.
The appeals court also faulted the judge for not sufficiently questioning jurors about their exposure to extensive news coverage of the bombing, but the Supreme Court has now ruled that this was a moot point.
Associate Justice Stephen Breyer, writing a dissent that was joined by two of his colleagues, noted that when ‘death is at stake…particular judicial care’ is required.
‘In my view, the Court of Appeals acted lawfully in holding that the District Court should have allowed Dzhokhar to introduce this evidence,’ Breyer wrote.
Daniel Habib, a lawyer for Tsarnaev, declined to comment about the ruling. Judy Clarke, another lawyer representing Tsarnaev, did not immediately reply to DailyMail.com’s request for comment.
Tsarnaev was found guilty in 2015 for the deaths of Lingzi Lu, a 23-year-old Boston University graduate student from China; Krystle Campbell, a 29-year-old restaurant manager from Medford, Massachusetts; and 8-year-old Martin Richard, of Boston….

I strongly believe in capital punishment. In other words, the state has the right to terminate a convicted criminal’s life, as even if he or she shows some remorse it is not going to benefit the community in a great way, when in confinement. Capital punishments may not reduce crime, as seen in Arab countries but the Left, as always pretends to have great ideas but it cannot produce a single leader who can fulfill its “holy ideals”.

Dzhokhar Tsarnaev thought he would be ‘martyred’ along the line and go to jannah to enjoy Allah’s playboy mansion.

This “sword” is meant for the punishment of the murderers, like this mozlum creep, this terrorist, and freeloading liar, and with this punishment of the guilty, it is a protection for the innocent.
Those who wish to conduct themselves as this mozlum murderer and terrorist did, should have some fear of that “sword,” and if they did, might not engage so freely in the evil actions. Death is a final punishment meant for those who take the lives of others. His older brother might have been the “leader” of the pack, but this murdering slime went along for his share of the murders.
His lawyers should have read more cases and precedence. They could have found out that the driver…who only drives…of a car used in a crime such as robbery, and where someone is murdered, is held just as guilty as are the ones robbing and murdering. He took part. He had a large share. Rightly he returns to death row.

Walter, I don’t believe that capital punishment accomplishes anything. Nor do most clergy of most churches and your church’s leaders would in a great majority be against it. It would not be easy to reinstate the death penalty anywhere for that reason.
I make an inconsistent exception for jihadists, since they have already expressed their willingness to die for Allah. Let them receive what they wanted at the hands of the public executioner. If a jihadist completely abandons Islam, then I would give him the chance to deprogram others right out of Islam.

Sadly the American tax payer has been supporting this mass murder for the past ten years along with his defense lawyers. Our legal system needs reforming alright, this shit should have been over 7 or 8 years ago. How many more years will we pay his legal team to keep him alive at our cost? This isn’t justice this is ripping off the tax payer by lawyer. Who cares what his brothers influence was on him, he murdered innocent people and new what was going to happen when that bomb went off.
We need to pass laws that limit the appeal time. And while we are at it we need a review system for prosecutors who decline to prosecute cases that involve the political and elite’s in our society.
