This is a war, and the New York City truck jihad massacre was one battle in that war. Yet authorities continue to prosecute these jihadis as if they were a series of criminals committing separate and discrete criminal acts that are unrelated to one another. If we had arrested and tried separately in criminal court every German and Japanese soldier captured during World War II, which side would have won that war? This myopia is self-defeating at best, and as the jihad continues, that will become increasingly obvious.

A federal grand jury returned a 22-count indictment Tuesday against Sayfullo Saipov in connection with the deadly terror attack on Manhattan’s West Side on Halloween.
The indictment treats the Islamic State, in whose name Saipov told police he carried out the attack, like a mafia family. It charges Saipov with murder in aid of racketeering, a charge federal prosecutors typically use in organized crime cases.
“Consumed by hate and a twisted ideology, Sayfullo Saipov allegedly barreled down a pedestrian walkway and bicycle path on a sunny afternoon on the west side of Manhattan, killing eight innocent people,” acting U.S. Attorney Joon Kim said.
Saipov, a 29-year-old Uzbek native who had been living in New Jersey, has been in federal custody since the attack that killed eight people, including five Argentine men visiting New York to celebrate a high school reunion.
Saipov had previously been charged in a criminal complaint that accused him of two crimes, one of which made him eligible for the death penalty.
According to the indictment, Saipov allegedly told authorities he was inspired to carry out the attack by ISIS videos he had watched on his phone.
The indictment states “he decided to use a truck to inflict maximum damage against civilians,” federal prosecutors said. He rented the truck a little more than a week prior to the attack on Oct. 31 to practice driving it….
Saipov wanted to display ISIS flags in the front and back of the truck during the attack, but decided against it because he did not want to draw attention to himself, the indictment states.
He requested to display ISIS’s flag in his hospital room and stated that he felt good about what he had done, police said.

To Jaladhi- I just checked Wikipedia and in 2008 the NYS Senate voted to have the death penalty for killers of law enforcement but the NYS assembly voted it down. No action taken since then. But I truly wish this demonic Muslim would get the death penalty for taking innocent lives who did absolutely nothing to him.

Jim, I am pretty sure under the concept of “dual sovereignty” trial in federal court does not “override” but instead operates in parallel with state law. If both federal and state criminal charges are involved a person can be charged and tried in both courts, regardless of the outcome in the other jurisdiction. I assisted the prosecution of a treacherous thief before I retired who was convicted in both courts and sentenced.

My uncle, who lived from 1893 to 1980, taught me many times there are almost always at least 3 sides to every story: yours, mine and right. I happen to share the dissatisfaction with the “system” failing to call terrorism what it is: Levying war on the United States and giving aid and comfort to an enemy in time of war (Treason, the only crime defined in the Constitution).
Thinking of the “other” side of the issue, handling a criminal case based on well-established law and precedents, with a substantial record of convictions based on that law, PLUS, allowing prosecuting lawyers to spend their scarce, expensive time and resources on terror cases instead of enforcing other less “noteworthy” cases, gives just enough cover for the “system” to do as it does. Consider all of the corruption and other crimes that are being ignored because of this effort to litigate in “ordinary court” high-profile terror cases. And do not forget the highly paid and expense reimbursed public defenders who would have less work and less taxpayer money if an alternative approach were followed. Where is my uncle’s “right” side to this?

Al Qaeda and Islamic State declared war on the US. We should reciprocate and declare war on them. The Geneva conventions do not apply to the terrorists, as they are not in a uniform. Removal to Gitmo, military tribunal, and execution for attacking the US. If far-left FDR could figure this out in WWII, why can’t we do this today?
Look up what happened to the German saboteurs that landed on Long Island in 1942. Some of them were US citizens. They all got fried.
The truth is, our government refuses to ID and hold responsible so called friends and allies like Pakistan, Turkey, and the KSA, who fund mosques and Imams that push the jihad message. Plus, these guys are all in cahoots with MS-13 and similar gangs that seek to undermine the US, as well as Antifa and similar far left groups.

1.While relevant agencies should and must do a better job of “connecting the dots”, the belief by many Muslims and Muslim groups–here and abroad–that they’re at war with the U.S. and that the New York City truck jihad massacre was one battle in that war, no recognized nation or nation state has declared war on the U.S. That given, such acts carried out on U.S.soil are criminal offenses. The “Underwear Bomber” as one case–among many–for example.
2. Germany and Japan–both recognized nations–did declare war on us.

PRCS, thank you for your courteous response. This question is another of those with at least 3 answers: terrorist acts are 1) criminal, 2) illegal combat (war/piracy on land), and 3) the “right” answer that is not obvious but is out there somewhere.
The cost of criminal prosecution of millions of terrorists (estimate $500,000 total government cost for each case, which is probably low), the need for courtrooms, and all associated people and facilities guarantees that the terrorists will win. There are more or less 1.5 Billion muslims and exploding, both demographically and otherwise. Surveys show anywhere from 10 to 20 percent want sharia imposed worldwide through war. Many are willing to blow themselves up to help that goal. Criminal prosecution starts usually after people are killed. I think about the many European cases reported and discussed here where someone under watch drops off the “list” of priorities only to show up again as part of an attack. I think those are just a few of the reasons criminal prosecution does not act to prevent the “crimes”, but in fact may encourage them. Using criminal prosecution as the only remedy means more of “us” are killed, jihadists get their names “in the lights” and we bankrupt ourselves. Sounds to me like an excellent plan for “them” to win. I think Hitler, as one example of several, won power this way.
Granted, we are doing a pretty good job of bankrupting ourselves without any help. Thank you again.

Jack, and others, I believe if you look at 18 United States Code Section 1963 and following (Racketeer Influenced Corrupt Organizations or RICO), racketeering prosecutions are based on violation of any of several “predicate” acts. Several (quite a few) statutes are listed as “predicate acts”. The potential sentences, especially if there are multiple charges for conviction, can add up to multiple lifetimes. RICO has been used with a substantial measure of success, meaning that prosecutions using it are less demanding, more likely to result in convictions, and more likely to force plea bargains than trying a first-of-a-kind legal theory that may be enormously more satisfying to you and me, but also have a real possibility of failing to convict. As long as criminal prosecution instead of military prosecution is the choice, using the most developed and proven legal theory to obtain convictions and long sentences seems to me at least tolerable. Please see for yourself and form your own view.
